Section 2.87 (AIRPORT COMMISSION) of Article VII (COMPENSATION FOR BOARDS AND COMMISSIONS) of the Town Code of the Town of Leesburg, Virginia, 2006, as amended, is hereby repealed. Section II. Section 2.88 (BOARD OF ARCHITECTURAL REVIEW) of Article VII (COMPENSATION FOR BOARDS AND COMMISSIONS) of the Town Code of the Town of Leesburg, Virginia, 2006, as amended, is hereby repealed. Section III. Section 2.89 (BOARD OF ZONING APPEALS) of Article VII (COMPENSATION FOR BOARDS AND COMMISSIONS)o f the Town Code of the Town of Leesburg, Virginia, 2006, as amended, is hereby repealed. Section VI. Section 2.91.1 (PARKS AND RECREATION COMMISSION) of Article VII (COMPENSATION FOR BOARDS AND COMMISSIONS) of the Town Code of the Town of Leesburg, Virginia, 2006, as amended, is hereby repealed. XXIII. Section 2.1-3 (COMMISSION DUTIES) of Chapter 2.1 (AIRPORT) of the Town Code of the Town of Leesburg, Virginia, 2006, as amended, is hereby repealed. XXIV. Unless specifically noted each Board and Commission shall consist of seven members who shall be residents of the Town or Town business owners (as allowed bylaw) and appointed by the Town Council ii. The term of Board and Commission members unless specifical~ noted shall correspond to the official tenure of the Council member who nominated them. iii. In all cases at least four members of any board or commission shall be residents. (b~ Appointment Process i. With the exception of the Board of Architectural Review the following procedure shall apply to appointment of individuals to the Town Boards and Commissions. 1. In the event of a vacancy inclusive of the conclusion of regular terms, the Clerk of Council shall advertise such vacancies. Submitted letters of interest and/or qualifications shall be forwarded to Council. 2. In the year of election newly elected or reelected Council Members including the Mayor shall be encouraged to consider incumbent members of Boards and Commissions when determining their nominee 3. In the year of election, each newly elected or reelected Council member includin thg e Mayor nominates one person to each Board or Commission to fill vacancies. 4. The Council shall vote to approve or disapprove the selection. 5. Board and Commission members shall serve at the pleasure of the Council (except for members of the Planning Commission who pursuant to State Code may only be removed for malfeasance and/or nonfeasance). (c) Duties i. The Chair shall report any attendance problems to the Town Council, which has the authority to require a member to resin if the said member is absent from three consecutive meetings. iii. The Board/Commission shall meet monthly or more often as necessary upon the call of the chair or two or more members. iv. The Board/Commission shall provide at least annually a report to Town Council on the activities and accomplishments of the Board/Commission. v. The Board/Commission shall adopt rules/b l~governing the conduct of its business and meetings. vii. The Board/Commission shall be knowledgeable of the requirements of the Freedom of Information Act. Conflict of Interest Requirements, and the Town's Board and Commission Handbook. viii. Unless otherwise noted all actions of Boards and Commissions shall be subject to Council approval. ix. The Chair, or their designee, shall provide to the Clerk of Council "key events/actions" from each meeting which shall be provided to Council in a summary format monthly reporting on Board and Commission activities. x. The Board/Commission shall assist in and carry out such other duties as may be assi ng ed by the Council. ,(d~ General Meeting Requirements i. A majority of the voting members of the Board or Commission shall constitute a quorum. The majority of votes necessary to take action or to transact business shall be a maIority of those present and voting_ ii. Meetings shall be open to the public under the Freedom of Information Act. iii. Compensation for the Mayor and Members of the Council after Julv 1 2000 shall be $8 500 00 and $8 000 00 per annum, respectivel~payable in equal monthly installments ii. Unless specifically noted; compensation of members exclusive of the Councilmanic liaison shall be $600 00 per annum, payable in equal monthly installments. ~fl Councilmanic Liaison i. At the bi-annual organizational meeting of the Council members may nominate a Liaison to each Board and Commission. ii. The role of the Councilmanic liaison shall be as follows: 1. Councilmanic liaisons are non-voting members who provide a link between the Board or Commission and the Town Council. 2. Councilmanic liaisons serve as resources for relatin relevant Town Council actions to the Board or Commission and for sharing relevant Board or Commission matters to the Town Council. 3. Councilmanic liaisons are encouraged to attend advisory roup meetings and/or communicate regularly with group members and remain current on all activities of the adviso roup so that theX can be accessible to members or provide information on behalf of Council. 4. The Executive Airport Commission is hereby recreated and re-established. (b). The Leesbur~Executive Airport Commission oversees rules and regulations at Leesburg Executive Airport. The Commission makes recommendations to the Town Council and the Airport Director to ensure effective and efficient administration of the airport. (c). Membership - Exclusive of the rules outlined in Section 2-87 membership on the Executive Airport Commission may consist of Town residents, Town property owners, Town business owners, or anyone employed in the Town. An additional member shall be appointed by the Loudoun County Board of Supervisors to serve atwo-year term and shall serve as the liaison to the Loudoun County Board of Supervisors. (d). Additional Powers and Duties: i. Review all requests for services, leases and proposals for airport developments originated with or directed by the Commission, and refer the Commission's recommendations to Council if necessary. ii. Prepare and maintain a capital improvement plan for development of the airport. iv. Adopt rules governing operations at the airport as are necessary and appropriate. v. Review and make recommendations to the Council of proposed annual budgets for airport improvements and operations. vi. Make recommendations to the Council on development and utilization of land and commercial operations at the airport, including leases thereof. vii. Perform such duties and have such powers as prescribed b~ the airport rules and regulations. viii. Establish rates of charge for services provided by the department, such as aircraft tie-down, hangar and other rents, fuel and lubricant charges and landing fees. ix. Maintain liaison with county offices to promote implementation of appropriate land use controls affecting the airport. x. Initiate timely actions with both the Federal Aviation Administration, Virginia Department of Aviation and the State Corporation Commission, division of aeronautics to provide priorit~pport to proposed improvement or expansion of the airport. xi. Conduct public surveys and meetings, as appropriate, to aid in planning improvements and acquiring public support for the airport. The Thomas Balch Library Commission is hereby recreated and re- established. (b). The Thomas Balch Library Advisory Commission serves as advisors to the Library Director on collection development and policies and report to Town Council about their activities. The_y helmspublicize Thomas Balch Library ~onsor the annual Loudoun History Awards, and work with Friends of the Thomas Balch Library, Inc., to promote and support programs and collections. cl. Membership -Exclusive of the rules outlined in Section 2-87 membershi may consist of anyone with a stated interest in the Thomas Balch Library The Council shall also appoint a member of the Board of Supervisors as a member of the Commission whose term shall correspond to the official tenure of office as supervisor. The Commission shall consist of seven members not less than four members shall be residents of the Town (d). Additional Powers and Duties: i. To assist in marketing the Thomas Balch LibrarX, ii. To encourage and coordinate efforts of private fund raising, donations to the collection, completeness and protection of the collection, and effectiveness of the facility. The Planning Commission shall advise the Town Council on all matters relating to the orderly growth and development of the Town of Leesburg. The Tree Commission shall disseminate technical information for professional groups and developers, and shall strive to inform the eneral public of the community need for tree preservation. iii. (b) All license fees imposed by this section, except as herein otherwise provided, shall become due and payable on or before July first of each license year (July first to June thirtieth of each fiscal year). Where a fixed base operator begins licensed operations after July first of a license year, such fee shall be paid at the time the license application is approved by the Airport Commission. All fees that are paid after the date due are subject to a late fee of ten percent of the amount owned and ten percent per annum interest payment until paid in full. Fees for first-year operations shall be based on estimates of gross receipts from operations in accordance with the formula provided in sections 17-29(a)(1) and 17- 29(a)(2) of the Town Code and adjusted after the close of the fiscal year for actual receipts. The director of finance shall assess or refund the erroneous amount to the fixed base operator, as appropriate. (c) The Airport Commission may waive any license fees established herein for any government or governmental agency or department or person performing nonprofit public services to the aircraft industry, or performing air search and rescue operations, or performing fire prevention or fire-fighting operations. (d) Every person who is conducting, operating or engaging any of the following services shall pay to the town all of the fees hereinafter provided: (1) Aircraft sales. For each aircraft sales license, $20.00 plus 0.25 percent of the licensee's gross receipts from aircraft sales. (2) Parts and accessories sales. For each parts and accessories sales license, $20.00 plus one percent of licensee's gross receipts from parts and accessories sales. For each aircraft rental license, $20.00 plus one percent of the licensee's gross receipts from the aircraft rental. (5) Flight instructions or ground schools. For each flight instruction or ground school license, $20.00 plus one percent of the licensee's gross receipts from flight instruction or ground schooling. (6) Maintenance services. For each maintenance service license, $20.00 plus one percent of the licensee's gross receipts from maintenance services. (7) Line services. For each lines services license, $20.00 plus one percent of the licensee's gross receipts for line services. (8) Aircraft storage. For each aircraft storage license, $5.00 per month for each occupied outdoor aircraft storage space and $5.00 per month for each occupied inside aircraft storage space. ~ee~-~. Section 2.1-4 Definition of "based aircraft." A "based aircraft" for the purpose of this section, is one that is normally housed, hangared, tied down, or otherwise sited on airport property for over 60 days in any 12 month period. ~ee~:~-8: Section 2.1-5 Airport user fees. Any aircraft "based" at the Leesburg Municipal Airport during any part of the previous calendar year shall pay an annual airport user fee. The user fee shall be established by multiplying the gross aircraft weight, as found in the Aircraft Bluebook, by $0.035. Jet aircraft shall pay a flat fee in accordance with their gross takeoff weight. (1) $600.00--20,000 lbs. or less. (2) $1,200.00--Greater than 20,000 lbs. up to and including 40,000 lbs. All airport user fees that are paid after the date due are subject to a late fee often percent of the amount due and ten percent per annum interest penalty. ~z °: Section 2.1-6 Aircraft registration. Any person who bases an aircraft at the Leesburg Municipal Airport shall register that aircraft with the airport director within 30 days of arriving. The registration form shall be in a format approved by the Airport Commission. At a minimum, the form shall include: the aircraft FAA registration number, gross weight, color, number of engines, owner's name, phone number and address. SECTION XXVI. If any provision of this ordinance is declared invalid, the decision shall not affect the validity of the ordinance as a whole or any remaining provisions of the ordinance.
