ORDINANCE NO. 18-15
AN ORDINANCE OF THE CITY OF OPA-LOCKA,
FLORIDA; AMENDING CHAPTER 11 - GARBAGE AND
TRASH, ARTICLE III — PRIVATE NONRESIDENTIAL
COLLECTION, SECTION 11-65 — FRANCHISE
REQUIRED; RELATIVE RIGHTS OF FRANCHISEE AND
CITY OF THE CODE OF ORDINANCES OF THE CITY
OPA-LOCKA, FLORIDA TO ALLOW THE CITY OF OPA-
LOCKA TO ISSUE MULTIPLE FRANCHISE
AGREEMENTS; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; PROVIDING FOR
SEVERABILITY; PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, under the provisions of the Code of Ordinances of the City of Opa-locka,
Florida ("Code") the City is only authorized to issue an exclusive franchise agreement; and,
WHEREAS, allowing the City of Opa-locka ("City") to issue multiple franchise
agreements will provide better service and prices to businesses within the City; and
WHEREAS, the Commission of the City of Opa-Locka finds that it is in the best interest
of the City of Opa-locka to permit multiple franchises to provide cost-effective commercial solid
waste collection and disposal services that will meet the unique needs of the City.
NOW THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF OPA-LOCKA, FLORIDA AS FOLLOWS:
SECTION 1. RECITALS
The recitals to the preamble herein are incorporated by reference.
SECTION 2. ADOPTION
That Chapter 11 - Garbage and Trash, Article III — Private Nonresidential Collection,
Section 11-65 — Franchise Required; Relative Rights of Franchisee and City of the Code of
Ordinances is amended by the addition of the following language:
(a) The city shall issue an may issue multiple franchise agreements to engage in
commercial solid waste service, provided that applicants for said franchise
agreements shall, in the judgment of the city commission, be qualified to serve in
such capacity, and further provided that said applicants for said franchises shall meet
the specifications set forth in this article as a condition for the issuance of said
franchise agreements, and such other specifications and requirements as the city
commission may from time to time promulgate. The city retains all of the powers of

a municipality of the State of Florida, for the exercise of its police power governing
the health and welfare of its citizens for the purpose of reviewing the services
rendered to the commercial, multifamily and nonresidential accounts, the
maintenance of rate schedules, method employed for the accumulation and removal
of waste, and the imposition of penalties for failure to render service to particular
commercial accounts or the violation of the provisions of this Code.
(b) The city manager or designee shall, with the successful applicants, have the
power to establish the type, frequency and amount of solid waste collection service
needed and to be rendered to all areas of the city and to promulgate rules and
regulations not inconsistent herewith. Further, the city manager or designee, along
with the franchisee, is authorized to implement the terms of the franchise so that
questions of use of public streets, problems of access to customers for service which
might arise from time to time, complaints, if any, and other questions can be justly
and expeditiously resolved. The city shall provide means of egress and ingress to
points to be collected by the franchisee and require the cooperation of its citizenry
and commercial establishments in implementing the services provided by this
article.
(c) The franchisees shall not be authorized to assign it their licenses or
subcontract any portion thereof without the specific written consent of the city.
(d) The city shall determine the monthly rate schedule for service of all accounts
in the city and said rates shall be binding, upon mutually consent, with the
franchisees. The rate schedule shall be subject to review once a year at each
anniversary date of the franchise agreements. The franchisees may petition the city
commission for a change in the scheduled rates and shall submit proper proof and
substantiation to the city commission which, in its discretion, may amend the
schedule of the rates applicable to the franchisees.
(e) The city manager, or franchisees, shall be assigned the responsibility for
enforcement of commercial solid waste collection procedures enumerated herein.
SECTION 3. SEVERABILTY
If any clause, section, or other part or application of this Ordinance is held by any court of
competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not
affect the validity of the remaining portions or application of this Ordinance.
SECTION 4. CONFLICT
All ordinances or resolutions or parts of ordinances or resolutions in conflict herewith, are
hereby repealed.
SECTION 5. CODIFICATION
This Ordinance shall be codified in the Code of Ordinances when the code is recodified.
SECTION 6. SCRIVENER'S ERRORS.
Sections of this Ordinance may be renumbered or re-lettered and corrections of
typographical errors which do not affect the intent may be authorized by the City Manager,
or the City Manager's designee, without need of public hearing, by filing a corrected or re-

codified copy of same with the City Clerk.
SECTION 7. LIBERAL CONSTRUCTION.
The terms and provisions of this Ordinance shall be liberally construed to affect the purpose
for which it is adopted.
SECTION 8. EFFECTIVE DATE.
This Ordinance shall take effect upon the adoption of this Ordinance by the Commission of
the City of Opa-locka and is subject to the approval of the Governor or his designee.
This ordinance was moved for adoption by Vice Mayor Kelley. The motion was seconded
by Commissioner Pigatt, and upon being put to a vote, the motion passed by a 5-0 vote:
