AN ORDINANCE:
APPROVING CONCEPT PLAN AND PROFFER AMENDMENT TLZM-2006-0011,
MARKET SQUARE AT POTOMAC STATION, AMENDING #ZM-154 TO PERMIT
A MIXED USE DEVELOPMENT CONSISTING OF A MINIMUM OF 35,000 TO A
MAXIMUM OF 44,000 SQUARE FEET OF NON-RESIDENTIAL USES AND UP
TO 320 MULTI-FAMILY DWELLING UNITS ON PARCEL A OF THE POTOMAC
STATION COMMERCIAL CENTER AT POTOMAC STATION DRIVE AND
BATTLEFIELD P ARKW A Y, NE
WHEREAS, application has been filed by Potomac Station Mixed Use, LLC for a concept plan and
proffer amendment to #ZM-154 for Potomac Station Commercial Center Parcel A; and
WHEREAS, a duly advertised Planning Commission public hearing was held on June 5, 2008; and
WHEREAS, at their regular meeting of June 19,2008 the Planning Commission recommended
conditional approval of this application to the Town Council; and
WHEREAS, the Town Council held a duly advertised public hearing on this application on September
23, 2008; and
WHEREAS, staff recommended denial; and
WHEREAS, the Council has concluded that the approval of the application would be in the public
interest and in accordance with sound zoning and planning principles; and
THEREFORE, RESOLVED by the Council of the Town of Lees burg in Virginia hereby approves
Concept Plan and Proffer Amendment TLZM-2006-0011, Market Square at Potomac Station, subject to the
proffers last dated October 14,2008.
