HomeMy Public PortalAbout18-16 SALE OF CITY PROPERTY WORTH TWO HUNDRED FIFTY DOLLARS OR LESS 1st Reading: August 1, 2018 2nd Reading: September 26, 2018 Public Hearings:August 1, 2018 and September 26, 2018 Adopted: September 26, 2018 Effective Date: September 26, 2018 Sponsor: City Manager ORDINANCE NO. 18-16 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA AMENDING CHAPTER 2 ADMINISTRATION, ARTICLE VI PURCHASING, SECTION 2- 322 SALE OF CITY PROPERTY WORTH TWO HUNDRED FIFTY DOLLARS OR LESS OF THE CITY OF OPA-LOCKA CODE OF ORDINANCES; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 2, Sec. 2-322 entitled Sale of city property worth two hundred fifty dollars or less of the City of Opa-Locka Code of Ordinances ("Code") allows the City Manager to sell property he deems to be obsolete and valued at two hundred and fifty dollars ($250.00) or less; and WHEREAS, the Code does not prescribe a method to dispose of property valued at greater than two hundred and fifty dollars ($250.00); and WHEREAS, the Commission of the City of Opa-locka finds that it is in the best interest of the City of Opa-locka to delineate a process to sell obsolete property valued at greater than two hundred and fifty dollars ($250.00). NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA AS FOLLOWS: SECTION 1. RECITALS The recitals to the preamble herein are incorporated by reference. SECTION 2.ADOPTION That Chapter 2, Article VI, Sec. 2-322. - Sale of city property worth two hundred fifty dollars or less is amended in the following manner: Sec. 2-322. - Sale of city property worth two hundred fifty dollars or less Ordinance No. 18-16 The city manager shall be authorized to sell any city property certified by him to be obsolete and unusable without securing competitive bid if it appears that the obsolete and unusable property shall be of less value than two hundred fifty dollars ($250.00). If the property is valued at greater than two hundred fifty dollars ($250.00), the City Manager must attain an appraisal of the property and certify in writing that the sale is in the best interest of the City of Opa-locka. The item must be sold at market value and if the value exceeds two thousand five hundred dollars ($2,500.00), the City Manager must attain City Commission approval prior to sale. SECTION 3. SEVERABILTY If any clause, section, or other part or application of this Ordinance is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portions or application of this Ordinance. SECTION 4. CONFLICT All ordinances or resolutions or parts of ordinances or resolutions in conflict herewith, are hereby repealed. SECTION 5. CODIFICATION This Ordinance shall be codified in the Code of Ordinances when the code is recodified. SECTION 6. SCRIVENER'S ERRORS. Sections of this Ordinance may be renumbered or re-lettered and corrections of typographical errors which do not affect the intent may be authorized by the City Manager, or the City Manager's designee, without need of public hearing, by filing a corrected or re-codified copy of same with the City Clerk. SECTION 7. LIBERAL CONSTRUCTION. The terms and provisions of this Ordinance shall be liberally construed to affect the purpose for which it is adopted. SECTION 8. EFFECTIVE DATE. This Ordinance shall take effect upon the adoption of this Ordinance by the Commission of the City of Opa-locka and is subject to the approval of the Governor or his designee. This ordinance was moved for adoption by Commissioner Riley.
