HomeMy Public PortalAbout2009_01_13_O001 - ZO Sec. 6.3 Building Heights The Town of Leesburg, Virginia PRESENTED: January 13, 2009 ORDINANCE NO.: 2009-0-001 ADOPTED: January 13, 2009 A RESOLUTION: AMENDMENTS TO SECTION 6.3.0F THE LEESBURG ZONING ORDINANCE TO INCREASE BUILDING HEIGHT IN SPECIFIC AREAS OF THE B-1 ZONING DISTRICT WHEREAS, the Town Council adopted the Crescent District Master Plan on June 27,2006; and WHEREAS, Chapter XIII of the Crescent District Master Plan identifies a multi- parcel area in the B-1 District where a mixed-use development of up to five stories in height could be developed as Site "b" on the Selected Opportunity Sites Map; and WHEREAS, in order to obtain five story buildings the height maximum in the B- 1 District should be increased to a maximum of sixty-five (65) feet in these specified areas; and WHEREAS, these amendments will provide enhanced redevelopment opportunities in accordance with the Crescent District Master Plan; and WHEREAS, the public necessity, convenience, general welfare and good zoning practice require the proposed amendments. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION 1. That Subsection 6.6.3 Density/Intensity and Dimensional Standards of the Zoning Ordinance of the Town of Leesburg, Virginia, 2003, as amended, is hereby created to read as follows: -2- AN ORDINANCE: AMENDING SECTION 6.3 OF THE ZONING ORDINANCE OF THE TOWN OF LEESBURG, VIRGINIA, 2003, AS AMENDED. 6.3.3 DensitylIntensity and Dimensional Standards All development in the B-1 District shall be subject to the following standards (See also Article 10): B.1 District Standards A. Minimum Lot Area (square feet) Sinale-Familv Detached Single-Family Attached (Interior Lots) Single-Family Attached (Corner and End Lots) Duolex, Vertical Duolex, Horizontal Multi-Familv All Other Development B. Actual setback determined in accordance with Sec. 10.4.5.0. [2] No side yards/setbacks are required for lots fronting on Market Street, Loudoun Street, King Street, Wirt Street or Liberty Street. [3] Side yard setback shall be 0 feet for an interior townhouse lot. [4] Rear yard setbacks for a commercial use or mixed use may be reduced or be provided as a zero-yard setback if all of the following criteria are met: (a) the property fronts on Market Street or Loudoun Street between Liberty and Church Streets; or on King Street between Cornwall and Loudoun Streets; (b) the property contains 4,000 square feet or less; (c) the rear yard is adjacent to non- residential uses; and (d) the applicant can demonstrate to the -3- AN ORDINANCE: AMENDING SECTION 6.3 OF THE ZONING ORDINANCE OF THE TOWN OF LEESBURG, VIRGINIA, 2003, AS AMENDED. satisfaction of the Board of Architectural Review and Zoning Administrator that the proposed setback will facilitate a structure that is harmonious and compatible with surrounding properties. [5] Rear yard setbacks for residential uses may be reduced to fifteen feet (15') if all of the following criteria are met: (a) the property fronts on Market Street, Loudoun Street or Royal Street between Liberty and Church Streets; or on King Street, Wirt Street or Liberty Street between Market Street and Royal Street; and (b) the applicant can demonstrate to the satisfaction of the Board of Architectural Review and Zoning Administrator that the proposed setback will facilitate a structure that is_harmonious and compatible with surrounding properties. r61 Maximum height may be increased up to 65 feet in the following specified area due to its low mean elevation above sea level and low topographical relationship to the rest of the H -1 District if an applicant can demonstrate that all of the following criteria have been met: (a) the property lies within 250 feet of the centerline of Town Branch between Wirt Street and Harrison Street: (b) where a property fronts on Wirt, South, King or Harrison Streets, the elevations adiacent to the street shall not exceed 45 feet for a depth of at least forty feet back from the property line subiect to the Board of Architectural Review in accordance with the H-1 Old and Historic District Design Guidelines. SECTION I1. This Ordinance shall become effective upon its passage. SECTION n1. If any provision of this Ordinance is declared invalid, the decision shall not affect the validity of the Ordinance as a whole or any remaining provisions of the Ordinance.
