HomeMy Public PortalAbout050117publicpacketSTM Technical Amendments UNPAID BILLS ARTICLE NO. 1: To see what sums the Town will vote to appropriate, and also to raise, borrow pursuant to an applicable statute or transfer from available funds for the payment, pursuant to Chapter 44 Section 64 of the Massachusetts General Laws, of unpaid bills from previous fiscal years, including any bills now on overdraft, or to take any other action relative thereto. (Board of Selectmen) (Nine-tenth Vote Required) Motion: Move that One Hundred Thirty Five Dollars ($135.00) be appropriated from Historic Preservation Professional Services of the Community Preservation Committee (CPC) Fund to pay the CPC unpaid bills from prior fiscal years; and Two Thousand One Hundred Twenty Nine Dollars and Twenty Seven Cents ($2,129.27) Fifteen Thousand Three Hundred Sixty Nine Dollars Thirty Nine Cents ($15,369.39) be transferred from Free Cash to pay the General Fund unpaid bills from prior fiscal years: Department Vendor Amount a. Town Administrator Cape & Vineyard Electric Cooperative $2,129.27 $15,369.39 Subtotal General Fund $2,129.27 $15,369.39 Total All Funds $2,264.27 $15,504.39 COMMENT This article will authorize the payment of outstanding bills from a previous fiscal year. According to Massachusetts General Laws, a Town cannot pay a bill from a previous fiscal year with the current year’s appropriation. Therefore, Town Meeting authorization is required. a. Eric Day Consulting – This bill is for consulting services for CPC and was received in December of 2016 and included work conducted in June of 2016, a prior fiscal year. Cape & Vineyard Electric Cooperative – There are four unpaid bills for administration charges related to solar panels throughout the Town from February 2016 to June 2016 in the amount of $2,129.27; in addition, the town has a contractual obligation from Fiscal Year 2016 to reimburse CVEC for taxes paid on Brewster’s behalf in the amount of $13,240.12 for a grand total due to CVEC of $15,369.39. Selectmen: Yes 5, No 0, Abs 0 Finance Committee: Yes 6, No 0, Abs 0 ATM Technical Amendments OPEIU COLLECTIVE BARGAINING AGREEMENT ARTICLE NO. 18: To see if the Town will vote to appropriate, and also to raise or transfer from available funds a sum of money to be used to meet the terms and conditions of the proposed Collective Bargaining Agreement, effective July 1, 2017, between the Town of Brewster and the Office and Professional Employee’s International Union, Units A & B, or to take any other action relative thereto. (Board of Selectmen) (Majority Vote Required) Motion: Move that Twenty Eight Thousand Five Hundred Twenty Seven Dollars ($28,527) be transferred from the Fiscal Year 2018 General Fund Contractual Obligations budget to the general fund departments with Office and Professional Employees International Union, Local 6 employees; and Eleven Thousand Three Hundred Eight Dollars ($11,308) be transferred from Fiscal Year 2018 Special Revenue Water Revolving Contractual Obligations to Water Revolving Fund Salaries; and Three Thousand Seven Hundred Thirty Five Dollars ($3,735) be transferred from Fiscal Year 2018 Special Revenue Golf Revolving Contractual Obligations to Golf Revolving Fund Salaries; all amounts to fund the cost items for Fiscal Year 2018 in a collective bargaining contract between the Town of Brewster (represented by the Board of Selectmen) and the Office and Professional Employees International Union (OPEIU), Local 6 employees in accordance with Chapter 150E of the Massachusetts General Laws, and to amend the Town’s classification, compensation plan and Fiscal Year 2018 Building Department, Council on Aging, Finance & Operations, Health Department, Natural Resources Department, Planning Department, Public Works, Water Department, Golf Department, and Town Clerk Operating Budget accordingly to reflect such contract. COMMENT This article would fund the costs associated with the contract settlement expenses between the Office and Professional Employee’s International Union, Units A & B and the To wn. The current contract expires on June 30, 2017. Selectmen: Recommendation Deferred Finance Committee: Yes 0, No 0, Abs 0 NON-UNION PERSONNEL WAGE FUNDING ARTICLE NO. 20: To see if the Town will vote to appropriate, and also to raise or transfer from available funds a sum of money to fund wage and salary adjustments effective July 1, 201 7 for eligible and non-union employees dictated by the Compensation Plan developed pursuant to the Personnel Bylaw, Section 36-4 of the Brewster Town Code, effective July 1, 2017, or to take any other action relative thereto. (Board of Selectmen) (Majority Vote Required) Motion: Move that Sixty-three Thousand One Hundred Two Dollars ($63,102) be transferred from the Fiscal Year 2018 General Fund Contractual Obligations budget to the general fund departments with non-union personnel. Further; all amounts to fund the cost items for Fiscal Year 2018 non-union personnel as outlined in the Town Personnel By-Laws, and to amend the Town’s classification, compensation plan and Fiscal year 2018 Building Inspections, Council on Aging, Finance & Operations, Fire Department, Health Department, Library, Natural Resources, Planning, Police, Public Buildings, Public Works, Recreation, Selectmen & Administration, and Town Clerk’s General Fund Operating Budget accordingly to reflect such increases. COMMENT This article would fund the costs associated with the wage adjustments for employees covered under the Personnel Bylaw and other non-union employees. Selectmen: Recommendation Deferred Finance Committee: Yes 0, No 0, Abs 0 LIBRARY UNION COLLECTIVE BARGAINING AGREEMENT ARTICLE NO. 21: To see if the Town will vote to appropriate, and also to raise or transfer from available funds a sum of money to be used to meet the terms and conditions of the proposed Collective Bargaining Agreement, effective July 1, 2017, between the Trustees of the Brewster Ladies Library and the Library employees, or to take any other action relative thereto. (Board of Selectmen) (Majority Vote Required) Motion: Moved that Six Thousand Nine Hundred Thirty Five Dollars ($6,935) be transferred from Fiscal Year 2018 General Fund Contractual Obligations budget to the Library budget to fund the cost items for Fiscal Year 2018 in a collective bargaining contract between the Town of Brewster (represented by the Board of Selectmen) and the Library Union employees (represented by Service Employees International Union, Local 888 employees) in accordance with Chapter 150E of the Massachusetts General Laws, and to amend the Town’s classification, compensation plan and Fiscal Year 2018 Library Operating Budget accordingly to reflect such contract. COMMENT This article would fund those costs associated with the contract settlement agreement between the Library Union and the Library Trustees. The current contract expired on June 30, 201 7. One Day Liquor License – Maplewood at Brewster is requesting a one day liquor license for a professional seminar with cocktail reception on Thursday, May 18th from 5pm – 7pm. Beer & wine will be served. ADMINISTRATIVE RECOMMENDATION We recommend the Board vote to approve this request. 2. One Day Entertainment License – El Patron is requesting a one day entertainment license for a music DJ for Cinco De Mayo on Friday, May 5th from 8pm - Midnight. ADMINISTRATIVE RECOMMENDATION We recommend the Board vote to approve this request. 3. Local Initiative Program Eligible Purchaser Certificate - Leah DeTellis is purchasing 156 Yankee Drive, Brewster, MA which is a DHCD property. The Town is required to co- sign the “Local Initiative Program Eligible Purchaser Certificate” to be recorded prior to closing. This certificate has already signed by the DHCD. ADMINISTRATIVE RECOMMENDATION We recommend the Board vote to authorize the Town Administrator to sign the Local Initiative Program Eligible Purchaser Certificate.
