P iort7~rnnces=296g'i i ©iA r~Ee PreventioD,~~QS i t)(161f14 a- AN ORDINANCE: AMENDING CHAPTER 16 (FIRE PREVENTION AND PROTECTION), ARTICLE II (FIRE PREVENTION CODE) OF THE TOWN CODE TO ADD ADDITIONAL SECTIONS REGARDING BLASTING PERMITS AND HANDLING OF EXPLOSIVES (a) Blasting_operations shall be conducted during daylight hours except when authorized at other times by the fire marshal. (b) Whenever blasting is to be performed the blaster shall notify the department of Public Works 24 hours priot• to blasting Such notice shall include the date and scheduled time blasting will occur, and the duration of blasting activities. (c) Whenever blasting is to be performed within 100 feet of gas, electric, water, sanitary sewer storm sewer fire alarm telephone tele tg_•aph or steam utilities, the blaster shall notify the appropriate representatives of such utilities at least 48 hours in advance of blasting specifying the location and intended time of such blasting Verbal notice shall be confirmed with written notice In an emergency, this time limit may be waived b fire marshal. (d) Whenever blasting_is to be performed the blaster shall notify~by written notice, no later than I S days prior to blasting the occupants of all structures which are located within of: (1) 300 feet of the blast site or (2) the distance at which buildings may at risk to damage as determined by data published by the American Insurance Services Group, Inc., or the Virginia Statewide Fire Prevention code as amended whichever shall contain the more restrictive language except in an emergencysituation which affects the health, safety welfare of the citizens of the town In an emetgency situation, this time period may be varied after approval by both the director of en ing Bering for the town and the fire marshal. This notification shall be done in accordance with the "Town of Leesburg P:\Ordinances\2009\t0I4 Fire Prevention.docx 10/16/09 3- AN ORDINANCE: AMENDING CHAPTER 16 (FIRE PREVENTION AND PROTECTION), ARTICLE II (FIRE PREVENTION CODE) OF THE TOWN CODE TO ADD ADDITIONAL SECTIONS REGARDING BLASTING PERMITS AND HANDLING OF EXPLOSIVES Recommended Blasting Notice to Occupants of Structures Within 300 Feet of Blasting Site" and as amended by the town fi•om time to time. (e) Seismogr~hs shall be used for all blasting events occurring within the town. Where appropriate seismographs shall be placed beside the closest adjacent structure. The seismo ra hs must be able to measure and store data on peak particle velocity, frequency (for all tlu•ee directions), and air blast intensity. All resulting records shall be retained by the blastine company for a period of no less than five years. A direct velocity recordin seismo raph capable of recording the continuous wave form of the three mutually perpendicular components of motion, in terms of particle velocity, shall be used and shall have the following characteristics: (1) Each seismogi_aph shall have a fiequenc~ponse from 2 to 150 Her4z or rg eater and a velocit,~@e from 00 to 2.0 inches per second or greater and shall adhere to design criteria for por4able seismographs outlined in U.S. Bureau of Mines RI 5708, RI 6487, and RI 8506. (2) All field seismographs shall be operated by competent people trained in their con•ect use and seismograph records shall be analyzed and interpreted as ma b~quired by the fire marshal. (f) At a minimum pre-blast survey notices shall be provided to occupants of structures that are situated within 150 feet of the blasting_site. This pre-blast survey notification shall be done in accordance with the "Town of Leesburg, Recommended Pre-blast Survey Notice of Occupants of Structure within 150 feet of Blasting Site." Blasting damage complaints. (a) In the event of a damage complaint the Loudoun County fire marshal shall: (1) Obtain the following information from the complainant: a. Name address and phone number of the complainant; b. Nature and specific location of the alleged damage, c. Dates and time(s) of the blast(s) in question. (2) Notify the appropriate blasting company of the complaint (3) Visit complainant property and meet with the complainant within 48 hours if necessary. (b) Upon receiving a damage complaint unless upon site review the Loudoun County fire marshal deems it inappropriate he shall request pursuant to the Code of Virginia that the blasting company or the geovibration engineering company for the project compile a complete set of blasting data for the time frame in question. This compilation shall include all information required under Virginia law including but not limited to: (1) Location date and time of the blast(s) in question. (2) Seismograph readings (ppv and frequency for each of the three directions and the decibel level . (3) Number of holes and depth. (4) Depth to rock. (5) Burden spacing; (6) StemmingStype and amount). (7) Caps and delays.
