AN ORDINANCE AMENDING ORDINANCE NUMBER 2518-1971, AN
ORDINANCE AUTHORIZING A DEVELOPMENT UNIT PROJECT, IN
ACCORDANCE WITH ARTICLE 45 OF ORDINANCE NUMBER 2325-1968,
COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF
RICHMOND, INDIANA.
WHEREAS, the Common Council of the City of Richmond,Indiana,
has enacted Ordinance No. 2518-1971 authorizing
a Development Unit Project pursuant to ordinance
No. 2325-1968, commonly known as the Zoning Ordinance
of the City of Richmond, Indiana, and
WHEREAS, said Ordinance provided for the construction of a
community shopping center to be located at 2031
Chester Blvd., Richmond, Indiana, and more particularly
described as -;follows:
Beginning at a stone in the middle of the
Richmond and Newport Turnpike Road and 116
rods south of the northwest corner of the
southwest quarter of Section 21, Township 14,
Range 1 west; thence south 8 rods to the middle
of said gravel road 80 rods to a stake or stone;
thence north 8 rods to a stone corner; thence
west 80 rods to the place of beginning, contain-
ing 4 acres, more or less.
Part of the southwest quarter of section 21,
township 14, range 1 west, bounded and
described as follows; towit: Beginning
at a stone in the middle of the Richmond and
Newport Turnpike road 108 rods south of the
northwest corner of said quarter section,
running thence south 8 rods; thence east
80 rods; thence north 8 rods; thence west
80 rods to the place of beginning, containing
4 acres more or less.
WHEREAS, it is the intent of this Ordinance to amend Ordinance
No. 2518-1971 to add 79.45 feet to the entire length
of the south property line to permit the use of an
existing residential structure at 2023 Chester Blvd.
as an office facility for the adjoining subdivision.
This additional property is more particularly described
as follows:
Part of the southwest quarter of Section.21,
Township 14, Range 1, beginning at the inter-
section of a road with the west line of said
quarter section, said point of intersection
being 36.30 rods north of the southwest corner
os said quarter section; and running thence east
with said road 49.84 rods; thence South 4.815
rods to an iron pipe; thence west 49.84 rods
to the west line of said quarter section; thence,
north 4.815 rods to the place of beginning, con-
taining 1-1/2 acres, more or less,EXCEPT a part
of the southwest quarter of section 21, Township
14 North, Range 1 West, beginning at a point,
said point being 524.5 feet north and 740.5
feet east of the southwest corner of the of
the southwest quarter of Section 21, and running
thence east 60 feet to an iron pipe; thence north
79.45 feet to the center of a roadway;
thence west along said roadway 60 feet; thence
south 79.45 feet to the place of beginning,'
containg an area of .l1 acres, more or
EXCEPTING ALSO, a part of the southwest quarter of
Section 21, Towship 14 North, Range'.lwest in
Wayne Townhip, Wayne County, Indiana, and being
more particularly described as follows, to -wit:
Beginning at a point, said point being 524.5
feet north and 740.5 feet east of the southwest
corner of the southwest quarter of Section 21
and running thence west 120 feet; thence north
79.45 feet to the center of a roadway; thence east
along said roadway 120 feet; thence south 79.45
feet to the place of beginning, containing an
area of 0.22 acre, more or less.
SUBJECT to a right-of-way for purposes of ingress
and egress to and from U.S. Road #27 along the
roadway mentioned in the above description which
runs along the north side of said above real estate
and west to said U.S. Road #27.
WHEREAS, (see attached sheet - conditions)
NOW THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL of the
City of Richmond, Indiana, that Ordinance No. 2518-1971
is hereby amended to include the additional property
as described above.
This Ordinance shall be in full force and effect from and
after its passage, approval by the Mayor and publications as
by law required.

ORDINANCE NO. 3001-1975
WHEREAS, the following requirements shall hereafter and at
all times be met by the owner, leasee or any persons,
firm or corporation using such real estate.
1. Prior to occupancy of the building on Tract #1
the access drive from University Blvd. to the
supermarket parking lot must be constructed in
accordance with the provision for access drives in
Article 45 of Ordinance #2325-1968, commonly known
as the Zoning Ordinance of Richmond, Indiana.
2. The radii at the intersection of the access drive
and University Blvd. shall be the same as the radii
of the access drive immediately south of University
Blvd.
3. Tract #1 is defined as the area west of the
Eastern edge of the access drive to U.S. #27 and is
79.45 feet wide.
Tract #2 is the area east of the eastern edge
of the access drive.
4. No development shall take place on Tract #2
until specific plans are presented to the Plan Com-
mission for approval.

Dear President Merchanthouse, Council Members and Mrs. Mellen;
The Richmond City Plan Commission held a public hearing on Tuesday,
June 24, 1975, at 7:30 P.M. in the Council Chambers of the Richmond
Municipal Building on the petition of Charles Miles, Inc., 2001
Chester Blvd., requesting to extend Planned Unit Development to
the South 79.45 feet to use existing dwelling as office facility
for adjoining subdivision.
All parties interested in or affected by this request were heard. Five
letters were mailed to adjoining property owners and one was returned
unopposed.
On the same date, the Plan Commission voted six to 0 to recommend approval
of the amen&nent to the Common Council with the attached conditions (see
Exhibit A). It is important to note that Commissioners EZstro,
Solomon and Van Pelt were not present at the meeting.

CONDITIONS FOR APPROVAL OF MILES PETITION
1. Prior to occupancy of the building on Tract #1, the access drive
