AN ORDINANCE: VACATING A PORTION OF PUBLIC RIGHT-OF-WAY
PURSUANT TO CODE OF VIRGINIA (1950)AS AMENDED,
SECTION 15.2-2006
The Council of the Town of Leesburg in Virginia hereby ordains:
SECTION I. That on motion of the Town Council and following a duly advertised
public hearing held on May 14, 2013, and pursuant to Code of Virginia(1950), as amended,
Section 15.2-2006, the following public right-of-way is hereby vacated:
Tolbert Lane (formerly Route 654, being a 50' wide right-of-way)
From: West of Miller Drive
To: East of Battlefield Parkway, a distance of.23 miles
And being more particularly described by Plat dated February 13, 2013, entitled
"Plat Showing the Abandonment of a Portion of Land as Dedicated for Public Street
Purposes in Deed Book 454 at Page 369 in the Name of the Commonwealth of Virginia
prepared by Rinker Design Associates, P.C.
SECTION All prior ordinances in conflict herewith are hereby repealed.
SECTION Severability. If a court of competent jurisdiction declares any provision of
this ordinance invalid,the decision shall not affect the validity of the ordinance as a whole or any
remaining provisions of the Leesburg Town Code.
SECTION This ordinance shall be effective upon its adoption.
