PRESENT: Mayor Dan Gubler, Council President Rob Geray, Council Member Michael Thompson, Council Member Peter Wadsworth, City Attorney Andrew Rawlings and City Clerk/Treasurer Keri West. ABSENT: Council Member Evan Mann and Public Works Director Zech Prouse. VISITORS: None. Mayor Gubler welcomed everyone and a roll call was taken by Clerk West to open the meeting. ITEMS OF BUSINESS: Discussion of Bonneville County Area of Impact Agreement — Mayor Gubler read an email from Director Prouse stating his concerns regarding the R-1 minimum lot size and frontage requirements. He explained the frontage requirements in Bonneville County's R-1 Zone are 10 feet less than the City's R-1 Zone. In addition, their R-1 Zone allows lots much smaller lots than Iona's minimum of 1/3 of an acre. Council President Geray stated the agreement Attorney Rawlings has drafted does allow the R-1 Zone in the area of impact, but it must be approved by the City for the specific location requested. He continued and stated in the proposed agreement some of the Bonneville County zones are automatically approved and others will require the application be presented and approved by the City Council of Iona. Attorney Rawlings stated he has also structured a pre-approval option in the agreement to require an application be brought to the City Council for approval prior to the applicant applying to Bonneville County. Mayor Gubler agreed but again expressed concern in approving the use of R-1 Zone by Bonneville County's requirements because of the smaller minimum lot size. Council President Geray stated he believes there are areas in the proposed area of impact map where the R-1 Zone would be appropriate. Mayor Gubler understood but continued voicing his concerns and insisted on indicating on the proposed map where the higher density residential and commercial zones would be considered. Council Member Wadsworth agreed. Discussion continued regarding the zones and how to indicate which zones will be approved in various areas of the proposed area of impact map. Council concluded to designate corridors of where specific zones will be allowed. Mayor and Council then began discussing commercial and higher density residential zones and where the appropriate location of those zones should be placed. Council Members discussed various units of measurements from Highway 26 to allow those zones. Council President Geray asked the total length of the Highway 26 portion the City is proposing to add to its area of impact, extending from Ammon Road (35t East) to 81St North. Council Member Thompson measured this on his phone map and calculated the total distance as approximately 6 miles. Council President Geray expressed that allows for a lot of commercial and higher density housing. Attorney Rawlings asked if the City still wants to require a pre-approval application for this area. Mayor Gubler stated the Council is all in agreement now that the corridor along Highway 26 should allow those zones. He continued and stated there is no reason they would need to approve each application if they meet all the requirements. Council then concluded the corridor for commercial zones will be 1/3 mile wide, extending from Highway 26 with the higher density residential corridor extending 2/3 mile from Highway 26. This allows higher density residential zones to be placed in both corridors, but commercial zones can only be placed within IONA CITY COUNCIL SPECIAL MEETING—JANUARY 10, 2023 the first corridor of 1/3 mile next to the highway. Council President Geray stated he does not view those as strict lines; instead it can be flexible depending on the location and the size of the desired building. Council then discussed and determined those zones would need to be approved by the City Council to be allowed outside of those corridors. Council Members discussed the frontage requirements along with drainage requirements, such as curb and gutter. Mayor Gubler stated curb and gutter will need to be required and that is consistent with what Bonneville County currently requires. All Council Members agreed. Mayor Gubler asked Mr. Olsen in the audience if he had any comments. Mr. Olsen started discussing his specific property and his desire to be annexed into the City. Mayor Gubler stated his property is currently in the area of impact, but they cannot be annexed into the City until they are contiguous. Discussion continued until Council President Geray stated this discussion is getting off topic and encouraged the Council to finish the discussion on the Area of Impact Agreement. Council President Geray reiterated everything that was discussed tonight to ensure all Council Members are in agreement. Attorney Rawlings stated he will have all of the updates completed for the Council Meeting next week. Council President Geray requested to add the approval of proposed Area of Impact Agreement and Map to the January 17th Regular Council Meeting. He continued and stated once it is approved by the City Council they can schedule another meeting with Bonneville County P&Z for their recommendation prior to the City Council meeting with the Bonneville County Commissioners. Clerk West then asked the Council's preference on meeting dates and who needs to attend the Bonneville County P&Z Meeting. Attorney Rawlings suggested the Council not have a full quorum at the P&Z Meeting and only have a full quorum at the meeting with the Bonneville County Commissioners. This allows for more negotiations to take place with the Commissioners, who will make the final decision. The Council concluded to have Mayor Gubler, Council President Geray, Council Member Thompson, Attorney Rawlings and Clerk West attend the meeting with Bonneville County P&Z. Clerk West confirmed that is not a full quorum because the majority of the Council will not be present. Attorney Rawlings stated in the proposed agreement he put a requirement that renegotiations need to begin by 2030. He asked the Council's opinion on that topic. Attorney Rawlings further explained the existing agreement will remain in place until a new agreement is approved. Council all agreed. SUGGESTED AGENDA ITEMS: Council Member Thompson requested to discuss the next steps to address the Council's concerns about the City Engineer.
