Subject: Mixed-use definition
On January 17, the Board approved Maryvale, LLC's request to change the intended and
approved use of Planning Area 28 from residential to mixed-use contingent upon an acceptable
definition of "mixed use." This memo presents three options:
. one reflects Fraser's need for additional commercial and industrial zoning areas
. one would not allow industry uses in a POD zoned district and
. one al10ws the Town and developer to negotiate al10wed industry uses.
Town Attorney Rod McGowan is also reviewing these options and will provide the Town with
specific legal language based on your direction next Wednesday night.
Background
Fraser's POD Ordinance currently defines mixed use as A POD that integrates two or more uses
such a.f; residential, commercial, office, or industlY uses in the same development area, building,
or group of buildings.
Staffs concern with this definition is that the term "industl)! llses" is vague and may aUow
certain uses that are not appropriate for a given POD area. Specific to Maryvale, two areas have
been designated mixed use -- PA 14 (immediately north of Winter Park and west of US 40) and
now, PA 28 -- areas that from a land-use perspective have very different "highest and best uses."
Option 1
Amend Fraser's code to include definitions for and "commercial" and "industry uses:"
Section 13-3-12 (3) (b) (xxii) Commercial: rental, retail and/or wholesale establishments;
personal service establishments; research and development of materials and/or supplies
that do not qualify as industry uses; public facilities; storage facilities; neighborhood
businesses; day care facilities; not-for profit clubs and/or service organizations;
entertainment and/or food establishments; hotels, motels, condo-hotels, and lodges; bed
and breakfast establishments; and normal accessory uses for all of the above.

Section 13-3-12 (3) (b) (xxiii) Industry Uses: all uses pennitted in the Commercial
planned areas plus contractor trades, including uses such as auto services (including
storage, operations, and maintenance); construction trades (roofing, material supplies,
plumbing, excavation, etc.); warehouses; fabrication and repair of small equipment;
commercial firewood cutting and storage; recycling facilities; public facilities; and
normal accessory uses for all of the above.
Option 2
Amend Fraser's POD Ordinance, mixed use definition, by deleting any language about industry
uses:
Mixed Use: a specified area l'fJifhb7 a PDD that i171egrates two or more uses such as
residell1ial, commercial, or (!tlice in the same development area, huilding, or group (!f
buildings. All commercial and ofJice developments must comply with Fraser's
applicable business zoning codes and may not include industTY uses.
And develop a new zone in Fraser to be called "/l1dustTY Uses" using the definition above as a
baseline.
Option 3
Amend Fraser's POD Ordinance, mixed use definition, to allow the Town and developer to
negotiate what is specificaHy allowed in a mixed use zone:
Mixed Use: a specified area within a PDD that integrates two or more llses such as
residential, commercial, office, or industl)' uses in the same development area, building,
or group (?lbuildings. Combined uses mllst be approved hy the Town prior to FPDP.

I am writ' g you to.follow up our discussion of the mixed use de:fmition which is proposed for
revised pI . g area 28 of the Maryvale PDD (revised in that the area will now include the
original si plus the 1.25 acre + area between it and the Elk Creek or Tubing Hill Road).
At the Jan 3, 1996 Town Board meeting, it was my understanding that the resolution which
passed ap roved multi-family residential and storage warehouse uses together with added use
de:fmitions to be recommended by the Town staff and ourselves, as owners, and subsequently
approved y the Town Board. At that time a wide variety of possible use was discussed to
include us of the site for the Town shops, use for the bus transit facility, and a light industrial -
office use. In this past month, it is my understanding that the Town has reviewed the site and
has dete . ed that it is not large enough or of suitable conformation to be used for the shops.
We have b ard nothing further respecting the shuttle bus use, but presume you haven't ruled this
out. The ffice - light industrial use remains viable but needs further definition. I will try to
suggest so e language.
Mixed use approved or allowed for Revised Planning Area 28 shall include:
a) Multi-family residential housing with a density not to exceed 20 units/acre.
b) Storage or warehouse use.
c) Business office use.

As Maryvale moves closer to petitioning the Town for annexation of the 200 acre parcel, and as
we have kept building our knowledge base about the original annexation agreement and Fraser's
regulations, and as we have positioned the developers in such a way that they're coming back to
the Town with a revised POD and an amended annexation agreement, the Board needs to ask
itselfa few (!'1) simple (?I) questions (and provide answers):
. what do you want from Maryvale and the revised PDD?
. (and does their revised plan fit this bill?)
. do you want to totally rewrite the annexation agreement?
. do you want to amend the existing agreement?
. do you want to move away from an annexation agreement and simply have the
developer meet all subdivision regulation requirements?

Two Winter Park Council members would like to sit down with two Fraser Board members and
discuss the future of Kings Crossing Road. Winter Park has had discussions with Maryvale
about swapping land that wilt allow them to straighten Kings Crossing Road and wilt provide
Maryvale access to their development west of the railroad tracks. Winter Park has some
concerns about the timing of the swap, traffic loading, and more. lVolunteersf7

response to their letter, I followed-up on a request from the Library District to Grand County for
donation of the building to the district as it would be easier to discuss their request with two
parties at the table instead of three.

Old Things
Attached you'll find a "project status report," an update the requests you have made since the
beginning of January (except assistance in plowing driveways). A couple of items to note:
. The US 40 trail is way past any hope of plowing. We'll stay on top of Mountain
Madness to pack this regularly. . . ,
. I discussed Jeffs request for additional patrol from the Sheriffs office with Rod Johnson
-- that is why the request is marked as "completed" on the status report. Now whether or
not any additional patrol comes from our discussion remains to be seen. . .
. Larry Roumph was unable to move the SEALY mattress trailer by 2/1 as originally
promised. He said it needed to stop snowing for awhile before he could clear the space
for the trailer (and move the snow so that John Augustine could take his old trucks off the
property). He promised to get to it ASAP but if you see him, make a pitch. . .
. I asked Dean Boyd if he would request a withdrawal ofthe approved PUD on the Village
at Winter Park Ranch property. He declined due to the fiduciary responsibility he has to
the stockholders of Community First but appreciated the question. . .
· . We probably won't be able to clean graffiti until the snow stops falling, or until we've
pushed it back far enough to keep plowing.

The Town of Fraser and the Grand County Library District are discussing the future use of their
current building in Fraser with the goal of identifying mutually beneficial alternative uses for the
site. As you know, Fraser owns the ground on which the Library sits and Grand County owns the
building. It would be of great assistance to our discussions if Grand County would donate the
building to the District. Key reasons for Grand County to do this include:
. Grand County's assistance in redevelopment and/or construction of the other
Libraries in the district
. Grand County governmental jurisdictions have a strong tradition of assisting newly
formed jurisdictions with similar in-kind donations
. The towns of Fraser and Winter Park have made substantive commitments to build
the new Library, warranting a similar commitment from Grand County.

To the Citizens of the Fraser Valley,
The creation of a Grand County Library District was approved by county voters in November of
1994, and passed overwhelmingly in the Fraser Valley. Included in the fonnation of this new lIbrary
district was a pledge to build a new h"brary for the Fraser Valley. In June of 1995, the Library District
Trustees formed a building committee of wnoemed and dedicated valley residents. This newly formed
Fraser VaUey LRmu:y Building Committee was charged with multiple tasks: :finding a. suitable
building site, conducting a search for an architect, aiding the arohiteot in the design of the library,
eliciting feedback from valley residents, and finally raising sufficient mnds for oompletion of the
project.
The Library District plans to fund oonstroction of the new libmry through a ten year lease/purchase
arrangement, spending approximately $50,000 a.nnually (or 11 % of total district revenue) on this
project. With allowances for fees, interest, do. this will amount to a total of approximately $450,000.
This will still leave a shortfall in total available building:funds of between $500,000 and $550,000 as
we antioipate total constnwtion costs at somewhere between $950,000 and $1,000,000. This includes
a budget of $50,000 for the purchase ofland.
To date we have secured a donation of a magnificent building site located on St. Louis Creek in
downtown Fraser. We have already had several services associated with approval of the site itself
donated, and have been promised future donations of labor, excavation, water & sewer lines, etc. We
anticipate the savingB from these generous donations at between $50,000 and $60,000. We have
pledges from the towns of Fraser and Winter Park totally $15,000, and have oolleotedcloseto
$20,000 in cash donations from individuals.
Our donation of both services and cash to date will sttl11eave us with between $350,000 and
$400,000 to be raised from the community, foundations and businesses. Our original goal was to
:raise approximately 20% of the building cost through individual oash donations. We have raised
$20,000 of the $200,000 needed, and look to the connnunity for the remaining $180,000. If only 180
individuals oontribute $100 each over the next ten years, we oan meet our goal
However, we are not merely attempting to build a library, but to build a community. This library will
be a place for our ohildren, adults, visitors & seasonal wotkers. It will be designed with state-of-the-
art access for our gt'owing disabled. population, and public access oomputers to help usher the Fraser
Valley into the technology of the twenty-first century. We have the opportunity, with this project, to
do something very special for ourselves, and to leave an extraordinary legacy for our ohildren and our
ohildren's children. With generous tax-deductible donation we can make this building a reality.
