ESTABLISHING A LOCAL
ENVIRONMENTAL COMMITTEE
WHEREAS, the Goveming Body of the Borough of Carteret finds that preserving the
Borough's natural resources will promote the general health and welfare of the residents
of the Borough of Carteret; and
WHEREAS, the Governing Body has determined that the establishment of a Carteret
Environmental Committee can help to protect, preserve and restore, while allowing for
the prudent and productive use and development of, the natural resources of the Borough
of Carteret.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough
of Carteret that there shall be created a Carteret Environmental Commission for the
purpose of protecting, preserving and promoting the Borough's natural resoumes.
BE IT ORDAINED by the Mayor and Borough Council of the Borough of
Carteret (the "Borough") as follows:
SECTION 1.
Establishment.
There shall be an Erlvironmental Committee in the Borough consisting of seven (7)
regular members and two (2) alternate members. Upon passage and publication of this
Ordinance according to law, the Carteret Shade Tree Commission and Air Pollution
Control Board shall be abolished. Thereafter, the respective duties and responsibilities of
the aforementioned bodies shall be assumed by the Environmental Committee.
Composition; member appointment; terms.
A. The members of the Committee shall be appointed by the Mayor and shall serve
without compensation. The mayor shall designate one of the members to serve as
chairman and presiding officer of the Committee. The terms of office of the first
Committee members shall be for 1, 2 or 3 years to be designated by the mayor in
making his/her appointments so that the terms of approximately 1/3 of the
members will expire each year, and their successors shall be appointed for terms
of 3 years and until the appointment and qualification of their successors
B. The mayor may remove any member of the Committee for cause, on written
charges served upon the member.
C. A vacancy on the Committee occurring otherwise than by expiration of a term
shall be filled for the unexpired term in the same manner as an original
appointment.
D. Alternate members shall be designated at the time of appointment "Alternate'
No. 1" and "Alternate No. 2." An alternate member may participate in discussions
of the proceedings but may not vote except in the absence or disqualification of a
regular member. A vote shall not be delayed in order that a regular member may
vote instead of an alternate member. In the event that a choice must be made as to
which alternate member is to vote, Alternate No. 1 shall vote first.

Powers and Duties.
The Environmental Committee shall have the following duties and functions:
A. Perform the duties and responsibilities previously undertaken by the Shade Tree
Commission and the Air Pollution Control Board.
B. Conduct research into the use and possible use of the open land areas of the
municipality and may coordinate the activities of unofficial bodies organized for
similar purposes.
C. Advertise, prepare, print and distribute books, maps, charts, plans and pamphlets
which in its judgment it deems necessary for its purposes.
D. Keep an index of all open areas, publicly or privately owned, including open
marshlands, swamps and other wetlands, in order to obtain information on the
proper use of such areas.
E. Recommend to the mayor and governing body plans and programs for inclusion in
the municipal master plan for the development and use of such areas.
F. Study and make recommendations concerning open space preservation, water
resources management, air pollution control, solid waste management, noise
control, soil and landscape protection, environmental appearance, marine
resources and protection of flora and fauna.
G. Enforce health code, property maintenance, and other applicable Ordinances, and
issue summons for violations thereof to the extent permitted by law.
H. Such other duties and responsibilities as may be assigned to it by the mayor and
governing body fi.om time to time.
Organization; operation
A. The Committee shall keep records of its meetings and activities and shall make an
annual report to the governing body.
B. The governing body may appropriate funds for the expenses incurred by the
Committee. The Committee may appoint such clerks and other employees as it
may fi.om time to time require and as shall be within the limits and purposes of
funds appropriated to it.
SECTION 2. All Ordinances and/or provisious thereof inconsistent with the provision
of this Ordinance shall be and are hereby repealed as to the extent of any such
inconsistencies.
SECTION 3. If any section, subsection, part, clause or phrase of this Ordinance shall be
declared invalid by judgment of any Court of competent jurisdiction, the section,
subsection, part, clause or phrase shall be deemed to be severable from the remainder of
this Ordinance.
SECTION 4. This Ordinance shall take effect upon passage and publication according
to applicable law.
