HomeMy Public PortalAbout2014_07_22_O024 Amending Chapter 34 for Utility Rates The Town of Leesburg, Virginia PRESENTED July 22, 2014 ORDINANCE NO. 2014-0-024 ADOPTED July 22, 2014 AN ORDINANCE: TO AMEND AND REORDAIN SECTIONS OF CHAPTER 34 (UTILITIES), ARTICLES II (WATER SYSTEM) AND III (SEWERS AND SEWAGE DISPOSAL) OF THE TOWN CODE OF LEESBURG, VIRGINIA, 2009, AS AMENDED AND SECTION 34 OF APPENDIX B, FEE SCHEDULE REGARDING WATER AND SEWER FEES, RATES AND CHARGES WHEREAS, the Leesburg Town Council authorized Public Resources Management Group, Inc. (PRMG) to conduct a water and wastewater cost of service analysis for the period of Fiscal years 2015 -2019. WHEREAS, PRMG found the current user rates for water and wastewater do not produce sufficient revenue to cover revenue requirements for FY 2015 and several following years; and WHEREAS,the Town of Leesburg is committed to a fair and equitable user rates for water and services,and WHEREAS, additionally, during the course of implementing water and sewer fees and charges by the Department of Utilities ("Utilities"), Utilities has identified the need for code changes to clarify and further define various sections of Chapter 34, Article II and III of the Town Code; and WHEREAS, an increase in the fees and charges for certain activities performed by Utilities is necessary to offset the costs associated with the services provided by Utilities; and WHEREAS, the increase in fees and charges is comparable and in some cases, lower, than the fees and charges for similar services in neighboring jurisdictions with similar population sizes; and WHEREAS, the Leesburg Town Council conducted a public hearing on July 22, 2014 and recommended approval of the proposed amendments. -2- AN ORDINANCE: TO AMEND AND REORDAIN SECTIONS OF CHAPTER 34 (UTILITIES), ARTICLES II (WATER SYSTEM) AND III (SEWERS AND SEWAGE DISPOSAL) OF THE TOWN CODE OF LEESBURG, VIRGINIA, 2009, AS AMENDED AND SECTION 34 OF APPENDIX B, FEE SCHEDULE REGARDING WATER AND SEWER FEES, RATES AND CHARGES THEREFORE, ORDAINED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. That Chapter 34, Article II of the Town of Leesburg Code, be and the same is hereby amended to read as follows: Sec. 34-60. Rates established. (a) The charge for use of water from the town water system shall be based on quarterly meter readings taken to the nearest 1,000 gallons charged for all bills rendered on or after the effective date at the rates established by town council. (b) If metered Metered water consumption during any quarter shall be charged based on account classification at the rates established by town council. ether Sec. 34-61. Fixed and account charge per quarter. (a) When a connection has been made to the town water system,the fixed charge per quarter for use of the water system shall be based upon the account classification and size of the water meter used to serve the premise customer and said fixed charge per quarter shall be charged for all bills rendered on or after the effective date of the rates as established by the town council. An account charge shall be included with the fixed charge per quarter as established by town council. (b) The sum of the fixed water charge and the account charge shall represent the minimum quarterly bill. a Sec. 34-69. When due and payable; notice, late payment penalty and second billing to delinquent accounts; discontinuance of service to delinquent accounts. Water bills are due and payable within 30 days from the date of billing. Any billing that remains unpaid after 30 days is subject to a ten percent late payment penalty plus an allowance for interest as determined by state code which amounts will be added to the total amount due and payable. A notice shall be mailed, together wit in the form of a -3- AN ORDINANCE: TO AMEND AND REORDAIN SECTIONS OF CHAPTER 34 (UTILITIES), ARTICLES II (WATER SYSTEM) AND III (SEWERS AND SEWAGE DISPOSAL) OF THE TOWN CODE OF LEESBURG, VIRGINIA, 2009, AS AMENDED AND SECTION 34 OF APPENDIX B, FEE SCHEDULE REGARDING WATER AND SEWER FEES, RATES AND CHARGES second billing, which will include the late payment penalty and interest at the end of 30 days from the date of billing, and water service will be discontinued if not paid in full within ten days from the date of such notice. When service is to be so discontinued, a fee for the disconnection and resumption of service in the amount established by the town council shall be charged. In the event water is discontinued and a security deposit has been refunded pursuant to subsection 34-58 (b), a security deposit shall be required under subsection 34-58 (a)before water service will be restored. SECTION II. That Chapter 34 (Utilities), Article III (Sewers and Sewage Disposal) of the Town of Leesburg Code, be and the same is hereby amended to read as follows: Sec. 34-126. Fee for sewer connection. (b) Prior to occupancy approval, a closed circuit television inspection (CCTV) of the sanitary sewer connection must be requested by applicant and performed by town staff. The inspection shall ensure the sanitary sewer pipe has been installed per policies,procedures and standards published in Town of Leesburg Design and Construction Standards Manual, as amended from time to time. A fee shall be charged for each inspection in an amount established by town council. Sec. 34-155. Charge where connection made to both water and sewer system. (a) Where connection has been made to both the town water and sewer system, the charge for use of the sewer system shall be based on quarterly water meter readings taken to the nearest 1,000 gallons at the account classification rates charged for all bills rendered on or after the effective date as established by the town council. (b) family-detached-dwellings:- Sec.34-155.1. Cooling Tower. Whenever any user considers that significant quantities of metered water used in the determination of the customer's quarterly sewage bill is not returned to the public sewage works due to evaporation from use of water in application fo cooling towers, such user may request that the billings be based upon the metered water that represents sewage that is not returned to the Town's public sewage works. If approved by the town manager, such user shall be solely responsible for the purchase,installation, repair and maintenance of a meter that is compatible with the town's metering system. The meter shall be accessible for inspection by the town manager at all times, shall be read as if it were a public meter and shall be maintained to provide an accurate record of the water that is not returned to the -4- AN ORDINANCE: TO AMEND AND REORDAIN SECTIONS OF CHAPTER 34 (UTILITIES), ARTICLES II (WATER SYSTEM) AND III (SEWERS AND SEWAGE DISPOSAL) OF THE TOWN CODE OF LEESBURG, VIRGINIA, 2009, AS AMENDED AND SECTION 34 OF APPENDIX B, FEE SCHEDULE REGARDING WATER AND SEWER FEES, RATES AND CHARGES public sewage works. The town manager shall promulgate rules and regulations to implement the requirements of this section. Sec. 34-156. Fixed charge per quarter. (a) When a connection has been made to both the town water and sewer system,the fixed charge per quarter for use of the sewer system shall be based upon the account classification and size of the water meter used to serve the premise customer and said fixed charge per quarter shall be charged for all bills rendered on or after the effective date of the rates as established by the town council. (b) The fixed sewer charge shall represent the minimum quarterly bill. Sec. 34-157 Charge where connection made to sewer system only–Generally (1) Where residential connection has been made to the town sewer system only, the flat charge for use of the sewer system shall be as established by the town council. (2) Whenever any user considers that significant quantities of rainwater enters the town public sewage works due to outdoor drains, such user may request a sewer system only connection. If approved by the town manager,the flat charge for use of the sewer system shall be as established by the town council. The town manager shall promulgate rules and regulations to implement the requirements of this section. (3) A fixed charge per quarter for usle of the sewer system only shall be established by town council. An account charge shall be included with the fixed charge per quarter as established by town council. Sec. 34-159. Same—When user has metered private water supply. Where a commercial user within or outside without the corporate limits of the town connects to the public sewage works only and where such user has a metered private water supply, a the meter compatible with the town's metering system shall be purchased,installed, repaired and maintained by the user to measure water use from the private water supply . •- .• •. - • • - -: - .. and be read as if it were a public meter. The charge for the use of such public sewage works shall be an amount equal to the amount normally charged for the water metered, as if the connection were to the town water supply SECTION III. That Section 34 of APPENDIX B FEE SCHEDULE be and the same is hereby incorporated and shall be amended to read as follows: Sec.34-22. Damage or obstruction of water system property; cross connections; unauthorized connections. Sec. 34-28. Water system connection and meter installation fees: (1) The fee for any connection within the town's service areas, as established by town council, where the town provides all materials, equipment and labor for installation of a water connection shall be x&00$80.00 residential,$120.00 commercial plus the direct cost of labor, equipment, materials, and administrative overhead of fifteen (15)percent of such direct costs. (2) The fee for any connection within the town's service areas, as established by town council,where a developer or subdivider provides all materials except the meter, meter box, lid and setting setter shall be $50.00$80.00 residential, $120.00 commercial plus the direct cost of materials furnished by the town including administrative overhead of fifteen (15) percent of such direct costs. (3) In addition to the connection fee, a fee for installation of the meter shall be $50.00. Sec.34-39. Cross connection and backflow prevention control program: (1) Disconnection and resumption of water service for failure to comply with Cross Connection and Backflow Prevention Control program: $30.00. (2) As required by the Commonwealth of Virginia/State Board of Health, Waterworks Regulations,the Town will conduct annual cross connection/backflow prevention inspections of non-single family residential plumbing systems connected to the Town's water distribution system. The charge for each inspection per connection, premise or account shall be: 5/8" Meter $25.00 3/4" Meter $32.50 1" Meter $47.50 1 'A" Meter $75.00 2" Meter $120.00 3" Meter $225.00 4" Meter $375.00 6" Meter $750.00 Sec. 34-58. Water service deposit for new accounts: (1) For residences and small commercial users: (estimated water flow less than 350 gallons per day per public facilities permit.) $65.00 $75.00. Sec. 34-69. Disconnection and Resumption of water service for nonpayment of charges: $30.00 Sec. 34-71. Miscellaneous fees and charges: (6) Private Pumpers (septic per 1,000 gallons): $50.00 (7) Private Pump and Haul Contractors (per 1,000 gallons): $10.00 (8) Imported Waste Activated Sludge(per 1,000 gallons): $50.00 (9) Tanker Truck with Operator(per hour): $100.00 (10) Tuscarora Landscapers' Choice (TLC) (25 pound bag): $4.00 plus $10.00 for delivery * (11) TLC (50 pound bag): $6.00 plus $10.00 for delivery* (12) TLC (bulk by the ton): $70.00 plus $20.00 for delivery* *TLC price and delivery charges apply to commercial users. TLC product is free to Leesburg utility customers. (13) Water or Sanitary Sewer Hydraulic Model: $250.00 each (14) Water flushing: $50.00 service charge in addition to outside town non- residential rate per 1,000 gallons of all water drawn (15) Bacteriological Test: $25.00 per test (16) Replacement materials to be used in Town water or sewer system: cost of the replacement material and administrative overhead of fifteen (15) percent. (17) Hydrant Flow Test Fee: $300.00 (18) Re-Inspection Trip Fee: $50.00 (19) Re-inspection fee for television sewer connection inspection: $100.00 per commercial re-inspection, $50.00 per residential re-inspection. Sec. 34-126. Sewer connection fee: (1) The fee for any connection within the town's service areas, as established by town council,where the town provides all materials, equipment and labor for installation of a sewer connection shall be $50.90$80.00 residential,$120.00 commercial plus the direct cost of labor, equipment, materials, and administrative overhead of fifteen (15)percent of such direct costs. (3) The fee for a closed circuit television (CCTV) inspection of the sewer connection: $100.00 per inspection for a commercial connection and $50.00 per inspection for a residential connection. Re-inspection fee for CCTV: $100.00 per inspection for a commercial connection and $50.00 per inspection for a residential connection. Sec. 34-132 Damaging, defacing, etc., sewage works property: The cost shall be$50.00 plus the direct cost of labor, equipment, materials and administrative overhead of fifteen (15) percent of such direct costs.
