Approval of the Special Exception and Level 3 Architectrual /Site Plan Review was granted as requested based on the documents and drawings that were presented. If a building permit incorporating the aforementioned improvements is not obtained and construction commenced by February 14, 1998, the Special Exception approval and the Level 3 Architectural /Site Plan Review approval shall expire. The applicant, Kimberly A. Dellastatious, AIA ,as agent for George and Karen Matthews, is seeking approval to replace and expand a screen enclosure on a parcel of property described as a portion of Lot 30, Place Au Soleil subdivision. The nature of the request requires a recommendation to the Town Commission on a Special Exception and Level 3 Architectural/ Site Plan Review. No other Board actions are required. Project Description The applicant wishes to replace an existing screen enclosure at the back of the residence. In addition, the applicant also wishes to extend the screen enclosure into the east side setback in order to line up the east wall of the enclosure with the east wall of the house. The required side setback is 15 feet. The applicant proposes a setback of approximately 11 feet, for a difference of 4 feet. Under the provisions of the Design Manual, applicants may extend non - conforming wall lines with the approval of a Special Exception. The proposed screen will cover about 1,220 square feet. The screen will have a mansard shape and the screen supports will have a bronze finish. The walls of the screen will rise about 9 feet, with the top of the screen at just over 12 feet. C C Architectural Review & Planning Board Members ARPB File #96 -15 January 17, 1997 Page 2 Please note that the proposed front porch referenced on the application form and shown on the site plan is not a part of this request. The applicant is still in the planning stages for this improvement and has included the square footage of the front porch in the calculations only to insure that it would fall within the maximum Floor Area Ratio. Assuming the size of the porch is similar to that shown and the design conforms with all provisions of the Design Manual, the porch likely will require only administrative approval and not be subject to further review by the Board. Special Exception There are two sets of standards that apply to the requested Special Exception. The first set of standards is contained in Article N, Section I.3. of the Design Manual (page N -10). These standards are specific to the requested non - conforming wall line extension. The second set of standards is contained in Chapter 66, Article V.3., section 66 -164 of the Zoning Code. These eg neral standards apply to all Special Exceptions. As discussed, the applicant wishes to extend the screen into the east side setback to match the existing east wall of the house. The screen would then have a setback of only 11 feet where 15 feet typically is required. The applicant notes that any negative impacts associated with the reduced setback are mitigated by the presence of an existing 6 -foot high wooden fence along the east property line and the fact that the screen is not solid and would not be as imposing as a wall. The applicant also notes that the lot to the east is vacant. Specific Standards The applicant has attached an additional sheet to the application form that addresses the specific standards found in the Design Manual. Based on the information submitted by the applicant, staff finds the extension of the screen enclosure to be consistent with the standards found in Article N. Section I.3. of the Design Manual, with the condition that at least two palm trees be planted to the east of the enclosure to provide additional buffering for the lot to the east. General Standards The applicant also has addressed the general Special Exception standards found in the Zoning Code in her responses to Part N.F. of the application form. Based on the documents and plans submitted by the applicant, staff finds the project to be consistent with all of these standards with the same condition. V C. Architectural Review & Planning Board Members ARPB File #96 -15 January 17, 1997 Page 3 Level 3 Architectural/Site Plan Review Chapter 66, Article V.1. of the Zoning Code enumerates the 12 standards applicable to applications for a Level 3 Architectural/ Site Plan Review. These standards include consistency with all applicable sections of the Gulf Stream Design Manual. Based on the plans and documents submitted by the applicant, staff finds the extension of the screen enclosure to be consistent with all of these standards, with the condition that at least two palm trees be planted to the east of the enclosure to provide additional buffering for the lot to the east. Recommendation 1. A motion to recommend approval of a Special Exception to permit the east wall of the screen enclosure to match the existing east wall of the house by extending 4 feet into the required 15 -foot east side setback, based on the plans and documents submitted by the applicant and a finding that the following condition is necessary for the proposed project to comply with all general and specific Special Exception review standards: a. at least two palm trees, or similar type of plant material, shall be planted to the east of the enclosure to provide additional buffering for the lot to the east 2. There is not a conforming location for the screen enclosure because of the existing pool's location. The location of the screen enclosure represents a logical extension of the existing floor plan. 3. The exterior design of the screen enclosure falls in line with the edge of the existing house. The enclosure's size and color is within the same character of the existing neighborhood,s standards. 4. There is a 6' tall fence screening the enclosure from the adjacent properties. Also, the adjacent property to the east (which is where the non - conforming setback occurs) is a vacant lot. The height of the screen enclosure is similar to the screens enclosures in the neighborhood. Since the screen enclosure is not a solid wall like would be found on a house, the impact of the enclosure being closer to the setback is not as difiant as would be a solid wall.
