AN ORDINANCE: APPROVING TLZM 2014-0001, POTOMAC STATION
MARKETPLACE, REZONING A PORTION OF MIXED-USE PARCEL
A FROM PRC TO PRN.
WHEREAS,the rezoning application with concept plan and proffers, TLZM 2014-0001
Potomac Station Marketplace,has been filed by Potomac Station Mixed Use LLC, to rezone 14.8
acres of land from PRC, Planned Residential Community,to PRN, Planned Residential
Neighborhood; permitting 33,000 square feet of Neighborhood Retail Convenience Center uses,
55 age restricted multi-family dwelling units, 42 stacked townhouses (or"two-over-twos"), and
61 single-family attached townhouses, with common open spaces on land identified with
Loudoun County Parcel Identification Numbers (PIN) 148-27-3578 and 148-37-4614; and
WHEREAS, a duly advertised Planning Commission public hearing was held on October
15, 2015; and
WHEREAS, at the October 15, 2015 meeting, the Planning Commission recommended
approval of this application to the Town Council; and
WHEREAS,the Town Council held a duly advertised public hearing on this application
on November 9, 2015; and
WHEREAS, staff noted that while may issues with the application were resolved staff
highlighted two areas of concern for Council to consider including the lack of office use in the
proposed plan and concerns that the proposed design guidelines as proffered by the applicant
would not assure community design as envisioned by the Town Plan and Zoning Ordinance; and

WHEREAS, the Council has concluded that the approval of the application would be in
the public interest and in accordance with sound zoning and planning principles.
THEREFORE, ORDAINED by the Council of the Town of Leesburg in Virginia:
SECTION 1. The rezoning application TLZM 2014-0001 Potomac Station Marketplace,
for the property having the Loudoun County Parcel Identification Numbers (PIN) 148-27-3578
and 148-37-4614, is hereby approved subject to the proffers dated October 28, 2015; and,
SECTION 2. The property shall be developed in substantial conformance with the
concept development plan prepared by Dewberry last dated April 3, 2015 and last revised on
October 28, 2015; and
SECTION 3. The following modifications as described in the Planning Commission Staff
Report dated October 15, 2015, as amended, and as noted in the Town Council Memo dated
November 9, 2015, are hereby granted:
TLZO Sec. 8.3.2 Lot Size, to reduce the minimum lot size to 1,000 square feet and
minimum end lot width to 25 feet.
TLZO Sec. 8.4.7 Open Space,to reduce the minimum public recreation space to one and
6/10 acres.
TLZO Sec. 9.3.4 Child Care Center,to allow play equipment within the required yard
setback.
TLZO Sec. 9.3.24(F) Canopy Height,to increase the lowest point of the canopy to 17'-6"
and an overall height of 20'-9".

TLZO Sec. 10.4.5(C)(2) AC Units,to permit a ten-foot encroachment into rear yards; and
may be located zero (0) feet from an interior side lot line, and no closer than one and one-half
(1.5') feet to and end unit side lot line.
TLZO Sec. 10.4.5.(C)(4) Architectural Features,to permit balconies, chimneys, and bay
windows to be located no closer than two (2) feet to any lot line; and, porches, stoops, steps and
landings to be located no closer than one-half(0.5) foot from any lot line.
TLZO Sec. 10.4.5(E)(5) Additional Setback Requirements from Certain Streets,to reduce
the setback from Fort Evans road from 80 feet to 40 feet.
TLZO Sec. 11.6.2,to reduce parallel parking space and townhouse driveway parking
space widths from 9 feet to 8 feet.
TLZO Sec. 12.8.2(G)(2) Buffer-yards, to reduce the width of Buffer-yard A to 25 feet,
and reduce the amount of evergreen trees in Buffer-yard H and allow planting to occur outside
the delineated buffer and reduce plantings in Buffer-yard I.
TLZO Sec. 12.8.3 Buffer-yards, to reduce the width of Buffer-yard B to a 10-foot S-3
buffer, eliminate Buffer-yard C, reduce Buffer-yard D to five (5) feet, reduce buffer-yard G to a
variable width, and reduce Buffer-yard K to six (6) feet.
TLZO Sec. 12.11.4,to waive the 0.5 foot-candle illumination maximum at adjacent
property lines in the vicinity of two pedestrian trails.
DCSM Sec. 7-370(3)(D) Minimum Separation from abutting Residences,to allow
parking courts depicted on the concept plan closer than 25 feet to an abutting residential lot line

SECTION 4, Severability. If a court of competent jurisdiction declares any provision of
this ordinance invalid,the decision shall not affect the validity of the ordinance as a whole or any
remaining provisions of this ordinance.
SECTION 5. This ordinance shall be in effect upon its passage.
