AN ORDINANCE: APPROVING TLOA 2015-0002, REMOVING DAVIS AVENUE AS AN
URBAN BOULEVARD.
WHEREAS,the Town Council initiated zoning text amendment TLOA-2015-0002 on
June 9, 2015 to consider the removal of Davis Avenue from Town of Leesburg Zoning
Ordinance Section 7.10.11.A.2(a) Urban Boulevards; and
WHEREAS,the zoning text amendment TLOA-2015-0002 is being concurrently
reviewed with rezoning application TLZM 2013-0006, Crescent Parke; and
WHEREAS, a duly advertised Planning Commission public hearing was held on July 16,
2015; and
WHEREAS, at the August 20, 2015 meeting, the Planning Commission recommended
denial of this application to the Town Council; and
WHEREAS, the Town Council held a duly advertised public hearing on this application
on October 13, 2015; and
WHEREAS, the Council has concluded that the approval of the application would be in
the public interest and in accordance with sound zoning and planning principles.
THEREFORE, ORDAINED by the Council of the Town of Leesburg in Virginia:
SECTION 1. The zoning text amendment application TLOA 2015-0002 Davis Avenue,
eliminating Davis Avenue from the Urban Boulevard section from Town of Leesburg Zoning
Ordinance Section 7.10.11.A.2(a), is hereby approved; and

SECTION 2. That the following sections of the Zoning Ordinance of the Town of
Leesburg,Virginia, 2003, as amended, be and the same are hereby amended to read as follows:
7.10.11 Streetscape Requirements
A. Streets. Streets, including associated streetscape improvements, in the CD
District shall be provided according to the following requirements.
1. Street Locations. Street locations shall be guided by the locations shown
on the Crescent District Future Streets Policy Map in the Town Plan.
2. Street Types. The street shall be in accordance with the applicable street
cross sections shown in the accompanying drawings. Cross sections are
typical midblock sections and may vary in width and lane configuration at
intersections based upon Town engineering standards. The location of
street improvements within the CD District shall be measured from the
center line, as specified in Sec. 7.10.4.C.1 Required Build-to Line and
Parking Setback. Cross sections are provided for the following streets:
a. Urban Boulevards. This designation includes the extension of Davis
Avenue, E. Market Street and Catoctin Circle. The cross section for E.
Market Street within the CD District extends only from the southern curb
line to the outside edge of the sidewalk. The location of the curb line
and edge of sidewalk shall be measured from the center line, as
specified in Sec. 7.10.4.C.1 Required Build-to Line and Parking
Setback. See the illustration below. As an option, the Urban Boulevard
may include a median in place of the turn lane subject to special
conditions, including sufficient demonstration of adequate ingress and
egress and compliance with Town and VDOT traffic engineering
standards.
SECTION 3. All prior ordinances in conflict herewith are hereby repealed.
SECTION 4. Severability. If a court of competent jurisdiction declares any provision of
this ordinance invalid,the decision shall not affect the validity of the ordinance as a whole or any
remaining provisions of this ordinance.
SECTION 5. This ordinance shall be in effect upon its passage.
