The regular meeting of the City Council was called to order by Mayor Nunamaker at 7:30 P. M. 2. Invocation was given by Elder Calkins of the Seventh Day Adven- tist Church of Temple City, followed by the Mayor leading the 3. Pledge of Allegiance to the Flag. 4. ROLL CALL: Present: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker Absent: Councilmen -None Also Present: City Attorney Shatford, and City Manager Woollett. 5. APPROVAL OF MINUTES: Councilman Merritt referred to item 16 line 15 the word should be "unable" to do so instead of able. Councilman Fitzjohn movec to approve the minutes of the regular meeting of February 24, 1964, as corrected, Councilman Merritt seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None UN'FINISHED BUSINESS: 6, RESOLUTION NO. 64 -353: Granting conditional variance to Robt. C. & Rojeane L. Bitten, Case #63 -75. City Attorney Shatford read title to Resolution No. 64 -353 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY GRANTING APPLICATION FOR A ZONE VARIANCE IN ZONE VARIANCE CASE NO. 63 -75 OF ROBERT C. AND ROJEANE L. BITTEN PERTAINING TO THE REAL PlOPERTY LOCATED AT 6234 NORTH LOMA, TEMPLE CITY. The City Attorney advised he had prepared this as per the request of the City Council, that the applicant had submitted substantia plans for development and would bring present buildings up to code. Councilman Tyrell moved to adopt Resolution No. 64 -353, Councilman Dickason seconded, carried by the following called vote: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamake! NOES: Councilmen -None ABSENT: Councilmen -None 7. PROPOSED PARKING DISTRICT #2. a. Report on proposed acquisition and improvement under Specia, Assessment Investigation, Limitation & Majority Protest Act of 1931. Resolution No. 64 -354. Wm. H. Krelle, Assessment Engineer, presented the report to the Council for their approval, and recommended adoption of Resolu- tion No. 64 -354 setting a public Hearing on said Report for 7 :30 P. M. on April 27, 1964, at the City Hall, 9664 E. Las Tuna- Dr., Temple City. Councilman Merritt moved to adopt Resolution No. 64 -354, Councilman Fitzjohn seconded, carried by the follow- ing roll call vote: AYES: Councilmen-Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None b. Ordinance No. 64 -127 1st reading. City Attorney Shatford read title to Ordinance No. 64 -127 AN ORDINANCE OF THE CITY OF TEMPLE CITY, CALIFORNIA, DECLARING THE INTENTION OF THE CITY COUNCIL OF SAID CITY TO FORM VEHICLE PARK- ING DISTRICT NO. 2 OF SAID CITY AND TO ACQUIRE AND IMPROVE LANDS FOR PARKING PLACES, AS PROPOSED IN THE PETITION THEREFOR, AND FIXING THE TIME AND PLACE FOR HEARING AND GIVING NOTICE THEREOF. ORDINANCE NO. 64 -123: (Unsightliness) City Attorney Shatford advised that following research of other cities he felt that the City already had a section in the muni- cipal code that could be more rigidly enforced and would cover the problem. He advised by Council action an individual can be served with a notice to have his property cleaned up within 30 days, and if not done at the end of that time it can be turn- ed over to the District Attorney for enforcement. Councilman Tyrell made a motion that the City serve notice on Mr. Janus, 6156 Rosemead Blvd., to clean up his premises, Councilman Merritt seconded, carried by the following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 9. ORDINANCE NO. 64 -124: second reading. Re- Zoning Map. City Attorney Shatford read title to Ordinance No. 64 -124 AN ORDINANCE AMENDING ORDINANCE NO. 63 -112 BY ADDING THERETO THE ZONING MAP AS PROVIDED FOR BY SECTIONS 303, 304 AND 2403 OF SAID ORDINANCE NO. 63 -112. Councilman Tyrell moved to waive further reading of Ordinance No. 64 -124, Councilman Merritt se- conded, carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None Councilman Tyrell moved to adopt Ordinance No. 64 -124, Council- man Dickason seconded, carried by the following called vote: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -done ABSENT: Councilmen -None 10. AGREEMENT FOR ENGINEERING SERVICES: re- proposed Vehicle Parking District #3. The City Attorney advised he had reviewed the proposed Agreement and approved of same and recommended the Council instruct the Mayor and City Clerk to sign on behalf of the City. Councilman Tyrell so moved, Councilman Fitzjohn seconded, and carried by the following called vote: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 11. PROPOSED PROCLAMATION OF APRIL 20 -24 AS PUBLIC SCHOOL WEEK Assistant City Manager Koski presented a request for a procla- mation of April 20 -24 as Public School Week from Dr. Jack Rand. Councilman Tyrell moved to so proclaim, Councilman Fitzjohn seconded, and carried. 12. Assistant City Manager Koski presented a letter from the Temple City Y. M. C. A. requesting permission to place metal trash containers in the city parking lots. Following discussion it was agreed to have the Assistant City Manager contact them and get more information regarding the containers, size, covers, etc. and rei`er back to the Council. 13. TRAFFIC COMMISSION RECOMMENDATIONS: George Envall, Traffic Engineer, presented the following recom- mendations: a. Installation of marked parking stalls east side of Kauffman north of Las Tunas Dr. Councilman Tyrell moved to adopt the recommendation of the Traffic Commission, Councilman Fitzjohn seconded, carried by the following called vote: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 586 1 1 Council Minutes, March 9, 1964, page 3 10. Installation of boulevard stop signs on Kauffman Ave. at north and south approaches to La Rosa Dr. with STOP and stop bar pavement markings. Councilman Dickason moved to adopt, Councilman Merritt seconded, carried by the following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 12. Placement of STOP and stop bar pavement markings on Woodruff Ave. at its approaches to Oak Ave. Councilman Merritt moved to approve, Councilman Dickason second- ed and carried by the following called vote: AYES: Councilmen - Dickason,Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 14. SET PUBLIC HEARINGS FOR CURB & GUTTER: The Assistant City Manager recommended the following hearings be set for dates as shown on curb and gutter petitions: a, Noel Dr. east side, Olive to cul de sac, set Public Hearing for March 23, 1964, at 7:30 P. M. b. Noel Dr. west side, Olive to cul de sac, set Public Hearing for March 23, 1964, at 7:30 P. M. c. Rancho Real, north side, Rosemead to Sultana, set Public Hearing for March 23, 1964, at 7:30 P. M. d. Arden Dr. east side, Olive to Freer, set Public Hearing for March 23, 1964, at 7 :30 P. M. e. Loma, east side, Broadway to Olive, set Public Hearing for April 13, 1964, at 7:30 P. M. f. Lemon Ave., south side, Oak to Trelawney, set Public Hearing for April 13, 1964, at 7:30 P. M. Councilman Tyrell moved to set Public Hearings as recommended, Councilman Dickason seconded, and carried. 15. ORDINANCE NO. 64 -126: 1st reading. City Attorney Shatford read title to Ordinance No. 64 -126 AN ORDINANCE OF THE CITY COUNCIL OF THE. CITY OF TEMPLE CITY, CALIFORNIA, MENDING THE MUNICIPAL CODE TO CORRECT DUPLICATION OF CODE NUMBERS AND TO ASSIGN NUMBERS TO PREVIOUSLY UN- NUMBERED SECTIONS. Councilman Tyrell moved to waive further reading of Ordinance No. 64 -126, Councilman Merritt seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None As this was the first reading of Ordinance No. 64 -126 no further action was taken. 16. RESOLUTION NO. 64 -352: Warrants & Demands. Following discussion Councilman Tyrell moved to adopt Resolution No. 64 -352, warrants & demands Nos. 4663 through No. 4736, in the sum of $41,054.69, Councilman Merritt seconded, carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None A warrant in the sum of $369.22 payable to the postmaster for payment of postage for the mailing of the sample ballots for the coming municipal election. Councilman Tyrell moved to approve this warrant, Councilman Merritt seconded, carried by the following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 587 Council Minutes, March 9, 1964, page 4 COMMUNICATIONS: 17. a. L. A. Boundary Commission, proposed annexation #24, City of Rosemead. Councilman Tyrell moved to receive and file, Councilman Dicka- son seconded, and carried. b. City of Downey: requesting revision for formula of matching funds in new gas tax law. Discussion followed as this new gas tax act calls for matching of funds received. The Downey Resolution requests the Legislature to amend this act to eliminate the matching fund provisions. Councilman Tyrell moved to adopt the same Resolution, Councilman Dickason second- ed, and carried. c. City of Redondo Beach, requesting support of a Resolution prohibiting the use of tobacco by minors. Following discussion Councilman Dickason moved to receive and file, Councilman Merritt seconded, and carried. d.. City of San Gabriel: opposing Unruh School Districts Assem- bly Bill #46 and the drastic changes of school districts as proposed. Mayor Nunamaker stated he felt the bill a blow to local govern- ment as it takes everything away from the local people. Coun- cilman Dickason stated the League of Calif. Cities took a posi- tion on this and are against it. The City Attorney suggest the Council hold this over until the next meeting as they are going to introduce another bill which will directly effect Bill 46. After discussion Councilman Tyrell moved we adopt a similar Resolution and forward as requested, Councilman Dickason seconded, and carried. e. Assistant City Manager Koski presented a letter from Town Meetings of Freedom and read in full a Resolution they requested the Council to adopt declaring support of the Monroe Doctrine and to have it strictly and immediately en- forced as it is the only policy which stands between free- dom and ultimate Communist takeover of all Latin America. ** Following considerable discussion by the Council,Councilman Dickason moved to receive and file, Councilman Fitzjohn second- ed, motion not carried by the following called vote: AYES: Councilmen - Dickason, Fitzjohn NOES: Councilmen- Merritt, Tyrell ABSTAINING: Councilman - Nunamaker ABSENT: Councilmen -None Mayor Nunamaker stated he was firmly behind the Monroe Doctrine but felt the wording of the Resolution was wrong to which Coun- cilman Dickason agreed. Councilman Tyrell moved to have the City Attorney draft a new Resolution stating this Council was behind the Monroe Doctrine worded differently than the one pre- sented, Councilman Merritt seconded, carried by the following roll call vote: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamakei NOES: Councilmen -None ABSENT: Councilmen -None f. Assistant City Manager Koski read a letter from the Road Dept. recommending acceptance for maintenance vie strsst. improvements in Tract #27787, and release of the Faithful Performance Bond in the amount of $13,900. with Fireman's Fund Insurance Co., with Principal the American Capitol Corp. Councilman Fitzjohn moved to accept the streets for maintenancE and to authorize the release of the faithful performance bond in the amount of $13,900., Fireman's Fund Insurance Co. as surety and American Capitol Corp. as Principal, Councilman Merritt seconded, carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell,Nuoamaker NOES: Councilmen -None ABSENT: Councilmen -None 1 8 . TIME FOR THOSE 1 N THE AUDIENCE c. MO WISH TO SPEAK: Vernon Hammond,5500 N. Persimmon Ave., requested power trans- mission poles recently installed by So. Calif. Edison Co. be removed to Lower Agusa and up El Monte, or continue up Tyler to Live Oak, or be placed below the surface of the street from McCulloch Ave. to El Monte Ave. He advised the homeowners in 588 1 1 Council Minutes, March 9, 1964, page 5 the area have paid additional cost for underground wiring and they object to the 95 ft. transmission poles in the parkway on Deines Dr. Following discussion the City Attorney was in- structed to research the Tract to see if utility easements were allowed on the parkways of road dedication for their services, and will report back at the next Council meeting. Ray Crume, 5832 N. Primrose, stated his opposition to the plac- ing of trash cans on the parking lots. Mr. Mioli who owns property at 5835 Camellia complained regard - ing the trash cans which are large and with no covers and the trash blows all over his property. The Staff will follow through on this. 19. MATTERS FROM CITY OFFICIALS: Councilman Fitzjohn asked about the signs for the bicycle racks and was advised by Mr. Koski that they are being made and when completed will be installed and the literature distributed to the schools. Councilman Merritt asked Traffic Engineer Envail some questions regarding striping and cross walks and for left turns and was advised on left turns they try to stop at curb lines and it is also policy to extend striping through cross - walks. Mayor Nunamaker commented on the vandalism in tearing apart the Camellia Festival floats and recommended that an officer from the Sheriff's Dept. be stationed there next year to avoid a re- currance. Mayor Nunamaker presented a Proclamation requested by the Tempi( City De Molay declaring the week of March 15 -26 as De Molay Week. Councilman Tyrell moved to so proclaim, Councilman Fitz- John seconded, and carried. Assistant City Manager Koski requested Council approval of 4 recommended changes to the construction contract for the new City Hall as follows: 1. Add new overflow scupper at front roof drain for control of flooding. Cost $16.00. 2. Add one (1) electrical recepticle in Reception Room 2. Cost $16.50. 3. Install three (3) 1" conduit from basement to roof for future antenna cable. Cost $110.00. 4. Revise size of one (1) display board in Council Chamber and in lieu of glass stops with screws, provide metal frame with piano hinge. Cost $363.00. Councilman Tyrell moved to adopt the recommended changes and costs listed above, Councilman Dickason seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaket NOES: Councilmen -None ABSENT: Councilmen -None Mr. Koski also requested the Council to set a public hearing to pass on completion of curb and gutter construction at 9055 Rancho Real and proposed assessment of $96.75, and to set the II hearing for April 13, at 7:30 P. M. at the City Hall. Council- man Tyrell so moved, Councilman Merritt seconded and carried. 20. ADJOURNMENT: Councilman Nunamaker moved to adjourn to 7:15 P. M. on March 16, 1964, at the City Hall, 9664 E. Las Tunas Dr., Temple City, Councilman Fitzjohn seconded, and carried. Council adjourned at 8 :35 P. M. 589
