AUTHORIZING STIPULATION OFSETTLEMENT
AND GENERAL RELEASE
WHEREAS, the matter of Dennis NaRy v. Borough of Carteret, Docket Number CSVLT
08263-99S is presently pending before the Honorable Joseph Lavery, A.L.J., which
matter has been placed on the inactive list for a six (6) month period pursuant to Court
Order; and
WHEREAS, the matte]' Dennis NaRy v. Borough of Carteret, et. al. Is presently pending
in thc United States District Court for the District of New Jersey with Docket Number,
Civil Action Number 98 Civ. 3664(AMW),; and '-
WHEREAS, the Borough of Carteret and Dennis Nagy desire to settle the
aforementioned matters amicably and to avoid the time and expense of continued
litigation; and
WHEREAS, the Governing Body of the Borough of Carteret is satisfied that resolution
of the foregoing matters pm'suant to the terms of the attached Stipulation of Settlement
and General Release is in the best interest of thc citizens and taxpayers of Carterct.
NOB', THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret, County of Middlesex, State of New Jersey, that the Stipulation of Settlement
and General Release is hereby approved.
BE, IT, FURTHER RESOLVED, that the Mayor and Borough Clerk arc hereby
authorized to execute [he attached form of Stipulation of Settlement and General Release
on behalf of the Borough of Carteret and to take all appropriate and necessary actions to
fulfill its terms and conditions; and
BE, IT, FURTHER RESOLVED, that payment of $90,000.00 to Dennis Nagy,
pursuant to the terms of the Stipulation of Settlement and General Release is hereby
authorized subject to the certification of the Borough's Chief Financial Officer that funds
are available for the same.

and certified as a true copy of the
original on April 6, 2001.
