HomeMy Public PortalAbout2016_07_26_O018 Amending Section 32-199 re Through Truck Traffic - Battlefield Pkwy The Town of Leesburg, Virginia PRESENTED: July 26. 2016 ORDINANCE NO. 2016-0-018 ADOPTED: July 26. 2016 AN ORDINANCE: AMENDING SECTION 32-119 OF THE TOWN CODE PERTAINING TO CERTAIN THROUGH TRUCK TRAFFIC PROHIBITED WHEREAS, a public hearing to consider prohibiting certain through truck traffic was held on July 26, 2016; and WHEREAS. all Town requirements were followed, notification to the trucking industry was provided, proper signage was posted and an origin and destination study of Battlefield Parkway was performed; and WHEREAS, the traffic study revealed there is a need to prohibit certain through truck traffic on Hope Parkway. THEREFORE ORDAINED by the Council of the Town of Leesburg in Virginia as follows: SECTION 1. Section 32-119 should be amended to read as follows: SEC. 32-119. Motor truck prohibited upon streets of town, except where specifically permitted. " (a) Prohibited. No motor truck shall be operated in the town upon the streets of street intersections except when necessary for the purpose of receiving loads of making deliveries. (1) King Street (Route 15 Business) between Battlefield Parkway and Catoctin Circle. (2) Market Street (Route 7 Business) between Liberty Street and East Loudoun Street. (3) Loudoun Street between Dry Mill Road and East Market Street. (4) Dry Mill Road between Catoctin Circle and Loudoun Street. (5) Harrison Street between Catoctin Circle and East Market Street. (6) Edwards Ferry Road between Plaza Street and East Market Street. (7) Lawson Road between Battlefield Parkway and Tuscarora Creek. (8) Davis/Lee Avenue between South King Street and Dry Mill Road. -2- AN ORDINANCE: AMENDING SECTION 32-119 OF THE TOWN CODE PERTAINING TO CERTAIN THROUGH TRUCK TRAFFIC PROHIBITED (9) Heritage Way between Fort Evans Road and Edwards Ferry Road. (10) Catoctin Circle between Battlefield Parkway and Edwards Ferry Road. (11) Hope Parkway. between Sycolin Road and Miller Drive. (12) Battlefield Parkway. between North King Street and Route 15 Bypass. (13) Battlefield Parkway. between Route 15 Bypass and Edwards Ferry Road. (b) Receiving loads and deliveries. The operation of a motor truck on any of the streets or street intersections, designated by ordinance, shall be considered necessary for the purpose of receiving loads or making deliveries within the town only when the place of receipt or delivery may be accessed only by travel upon such street or street intersection and then only to the minimum extent that travel upon such street or street intersection is necessary for ingress-egress to the place of receipt or delivery. (c) Definition. The following words, terms, and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning: Motor truck means: (1) Every motor vehicle designed to transport property on its own structure independent of any other vehicle and having a registered gross weight in excess of 7,500 pounds; and (2) Every motor vehicle designed and used primarily for drawing other vehicles and not so constructed as to carry a load other than a part of the load and weight of any vehicle attached thereto. (d) Exceptions. Subsection (a) of this section does not apply to the following: (1) The operation of emergency vehicles upon any street or highway within the town. (2) The operation of motor trucks or vehicles owned or operated by the town, or agents of the town, public utilities, or motor trucks owned or operated by the state department of transportation or its agents. (3) The operation of motor trucks or vehicles upon any official established detour within the town. SECTION II. All prior ordinances in conflict herewith are repealed. SECTION III.
