Public Hearings Request for Determinations of Applicability National Grid requests determinations as to whether the work—gas main extensions within a roadway within 100 feet of inland wetlands, and the areas -are subject to the Wetlands Protection Act and jurisdiction of the BWP By-law, on Route 6A/Main Street from #3771 Main Street east to the Orleans Town Line, Assessors' Maps 126 and 138, Parcels NA(11, 29, 30). Summary of Applicant Testimony Brad Malo, Coastal Engineering, Inc., represented the applicant. Mr. Malo briefly described the inland resource areas involved and the project as contained in the Request for Determination and accompanying displayed plan*. Brewster Conservation Commission Minutes October 21, 2014 1 Mr. Malo explained all the work is proposed entirely in the road layout of Main Street, except in the rare case where a utility might interfere; in which case work would be in the road shoulder. Summary of Public Comments Bob Williams, Director of the Brewster Animal Rescue League located on Main Street abutting the subject area, enquired on the time period of the project, which Mr. Malo explained to his satisfaction. Summary of Staff/Conservation Comments Hayley Winfield moved, Michael Tobin seconded the motion to close the public hearing and issue determinations as recommended by the Conservation Administrator*, as shown: Positive Determination 2b.The boundaries of resource areas listed below are not confirmed by this Determination, regardless of whether such boundaries are contained on the plans attached to the Determination or to the Request for Determination Vegetated wetland Negative Determination 3. The work described in the Request is within the Buffer Zone, as defined in the regulations, but will not alter an Area subject to protection under the Act.Therefore, said work does not require the filing of a Notice of Intent, subject to the following conditions (if any). 6. The area and/or work described in the Request is not subject to review and approval by Town of Brewster Pursuant to the Code of the Town of Brewster Wetlands Protection By-law. Coastal Engineering Company,Inc. National Grid Environmental Sketch Plan Showing Proposed Gas Main,9/29/14 Notice of Intent Amundson Family Realty Trust proposes to place approximately 500 cubic yards of compatible sand onto a coastal beach. Access will be sought from Linnell Landing, on 18 Muskrat Lane, Assessors' Map 103, Parcel 11 (formerly 9/50). The project is located on the MA Natural Heritage and Endangered Species Map* as an area of rare plant and wildlife habitat and rare wetlands wildlife.* Summary of Applicant Testimony John O'Reilly, PE, PLS represented the applicant. As contained in the Notice of Intent, narrative, variance request and accompanying displayed plan*, he described the controlling resource areas; coastal dune and coastal beach in addition to land subject to coastal storm flowage and land under the ocean, He explained that his clients have witnessed that part of their dune has moved landward approximately 18 feet over the 20+ year period since they purchased the property. Mr. O'Reilly added that the Notice of Intent has been revised since it was filed with the Conservation Commission to extend the sand nourishment west behind the existing snow fence, for a total of approximately 765 cubic yards of sacrificial sand. The project proposes to bury the existing snow fence and maintain it as needed. Mr. O'Reilly added that his clients believe the proposal is preferable at this time to the listed alternatives of leaving the area as is or exploring the feasibility of installing a biodegradable coir erosion control system. Summary of Staff/Conservation Commission Comments The Conservation Commission did not confirm the edge of the resource area, coastal dune at this time due to delineation label discrepancies on the submitted plan. Discussion centered on whether beach grass is proposed, and the importance of using appropriate sand material as contained in the Commission's special condition requirements for sand, as follows: Brewster Conservation Commission Minutes October 21, 2014 2 A2N. Sand used for beach nourishment shall be compatible in size, color, and texture with existing sand in the area. The proponent shall provide a grain size sieve analysis of both the native beach at the project location and the sand to be used for nourishment. The sieve analysis shall also include the Munsell Soil Color of both the native beach and the sand to be used for nourishment. A3N. Sand for nourishment shall be screened through a one quarter inch (1/4') screen and shall contain less than 10% fines or be washed. Fines shall be defined as material passing a#200 Sieve. The sand must be coarse and free from clay, silty loam (as described above) and other undesirable materials. A4N. Receipts of sand delivery showing amount(s) and source(s) of the material shall be submitted to the Conservation Commission upon completion of each beach nourishment activity. Mr. O'Reilly responded that his clients intend the sand purely as sacrificial for nourishing the coastal beach, so do not propose to plant American beach grass at this time. Mr. Gallagher suggested that any Order of Conditions issued for the project might include a special condition permitting construction and maintenance of a sand drift fence should the buried wire fence alone not be successful. Summary of Public Comment There was no public comment. Shana Brogan moved, Michael Tobin seconded the motion to continue the hearing to Wednesday, November 5, to allow receipt of response from the MA Division of Fisheries and Wildlife, MA Natural Heritage and Endangered Species Program (NHESP) as to the project's occurrence in and potential effect on Priority Habitat for non-wetlands plant and wildlife under the MA Endangered Species Act(MESA), and Estimated Habitat Map of Rare Wildlife under the WPA-and for the Conservation Administrator to draft findings and special conditions for an Order of Conditions for the project The motion was approved unanimously. *List of documents submitted for the Notice of Intent and discussed at this hearing: 1. Show Cause Hearings/Violations 1. Susan and Terence Lichty,42 Barberry Lane, 68/13 (5/218), clearing and destruction of vegetation within 100 feet of wetland resources bordering Myrick's Pond Matt Farrell, J. M. O'Reilly, Inc., and Theresa Sprague, MALD, Blue Flax Design, attended on behalf of their clients, Susan and Terence Lichty, to discuss an enforcement order`and Notice of Violation` issued to them on September 16, 2014. Ms. Sprague and Mr. Farrell explained their clients maintain that such alterations have been historic, since before they purchased their property, and that they, unaware of the wetland laws, continued this practice using hand-held tools. They have also planted non- Brewster Conservation Commission Minutes October 21, 2014 3 native plants in the 100 and 50 foot buffer zone area. However, after receiving the enforcement order, they removed the exotic plants from the 50 foot buffer zone. Mr. Farrell submitted a plan*showing the subject area as it exists with recent vegetation alteration in the 100 and 50 foot buffer zone consisting primarily of(approximately 100) altered native red oak, bayberry, arrowwood and blueberry, and pitch pine saplings, as described by the representatives, and areas of re-growth of altered native sweet pepper bush in the bordering vegetated wetland (off of the owners' property). Ms. Sprague explained that due to improper cutting, she believed the oak stumps cannot generate into healthy canopy-sized trees, so further planning on this will be required, but the altered sweet pepperbush should re-emerge as healthy native shrubs. Ms. Sprague added that her clients hope to maintain both a view to the pond and a four- foot wide path to the pond. Ms. Sprague then requested the Commission's recommendations on a mitigation plan. Summary of Commission Comments Mr. Klein expressed the seriousness of the Lichty's clear-cutting of the native sweet pepper bush in the wetland itself(next to the pond, off of their property)and requested the plan provide for additional such plantings should they not survive the alteration. Following discussion, the Commission consensually agreed that a professional mitigation plan shall contain a diverse mixture of appropriate* native shrubs and canopy sized trees depicting the species, size and natural spacing of plants. The Commission stressed the importance in particular of a fully protective 50 foot buffer zone containing shrubs high in wildlife value and possibly a fence to delineate and control human activity from this area. Additionally, the Notice of Intent shall contain a maintenance plan for re-planting the altered sweet pepperbush should they not survive, and control of invasive species. The Commission discussed that in addition to the Lichty's alteration off of their property, there exists a (presumably historic) path around the pond maintained by others using Myrick's Pond. 2. Kenney and Denise A. Vettori), and she agreed to continuance. Brewster Conservation Commission Minutes October 21, 2014 4 He recommended the Commission continue the hearings as requested and authorize him to issue amended enforcement orders revising the date for plan submittal, by Friday, November 14 at noon. Hayley Winfield moved, Michael Tobin seconded the motion to continue the above two hearings (2 and 3) to November 19, 2014, with enforcement amendments as described above. Bruce Bourgeois, 228 Cranview Road, 20/12 (51/18-7), septic system components As contained in his Administrative Report, the Conservation Administrator explained he believed the above referenced projects 1 and 2 meet parameters for activities under the Commission's Administrative Review process. The scope of project 3 on 228 Cranview Road reaches beyond the typical Administrative Review, as it involves installation of a septic pump chamber in the 100 foot buffer zone. All of the components of the chamber, however, are proposed within the existing driveway layout and the project would be a clear improvement over the existing leaching system; therefore, Mr. Gallagher stated he would support its approval under the Administrative Review. Following discussion on insurance that the driveway on 228 Cranview Road would remain pervious, Michael Tobin moved, William Klein seconded the motion to approve the above captioned projects with special conditions in the Administrative Review letter to the applicant on 228 Cranview Road, as detailed by the Conservation Administrator. The motion was approved unanimously. Discussions/Report of the Conservation Administrator 1. The Tubman Road project is currently in early stages.We completed feasibility prior to taking title, and we are now in pre-development,just beginning to look at site and home design and permitting, There are many details on the project yet to be determined. What we do know is that this will be a subdivision of fourteen homes that will be sold affordably to our income qualified buyers,and the homes will be affordable in perpetuity. In terms of timing,our grant funding has set the schedule that we be permitted by October of 2016,that we build and sell at least six homes by October of 2018 and that we build and sell the remaining eight homes by October 2121. This will be a community housing neighborhood. Habitat for Humanity of Cape Cod intends to use our tried-and-true "sweat-equity" model to build the affordable homes.With this model our selected purchaser-families will partner with Habitat and devote 250 to 500 hours building their homes alongside community volunteers.This promotes homeowners who are well educated on building and maintenance,and fosters a true sense of community. In fact, ninety-five percent of the homeless clients served by the Duffy Health Center come from the Cape, and every town in Barnstable County is represented. The Town of Barnstable, Cape Cod Council of Churches, Duffy Health Center and other homeless service providers started In From The Streets in 2005. IFTS offers a temporary, safe place for people who are vulnerable— a transgender teen, elderly men and women, a mentally ill veteran - and unable to stay in shelters. IFTS is used For a motel room,a deposit for a sober house placement, or to assist the client to move into safe group housing,while well-skilled case managers help them develop stability plans and access to other community resources. In the past year, of the 15 persons receiving help from IFTS, 13 persons became housed or were provided housing through treatment or special programs. All 15 were enrolled or were reinstated with health insurance benefits,five persons became employed and four others received job training. Duffy Health Center will continue to work with each individual to develop a housing plan of action and to assist with needed benefits and medical, behavioral health,and other support services. This year the success of the IFTS program has,von support from the,United Way in the foon of $16.000. with the challenge that towns across the Cage ioin this effort. The Town of Barnstable has, committed $5.000 to this effort in 2014, and Town Council unanimously passed a resolution, supporting the program (attached). And,the Town of Chatham has approved $1,000 for IFTS. We askfar a commitment of$1,000 by your town so that more Cape Codders can benefit from the program. Others Present: Jay Burgess, Chief Operator;Cyndi Bachman, District Secretary; Beverly Carney, Orleans resident. 1. Meeting called to order at 9:05 a.m.. 2. A motion was made by Martin McDonald to approve the Board of Managers Minutes dated October 1,2014.This motion was seconded by Charlie Sumner and unanimously approved and passed.Vote:3-0 3. Citizen's Forum: • Beverly Carney stated Orleans Taxpayers met last Saturday and one of the things they discussed was the future of the compost building.A representative from Weston and Sampson was there and went to the compost building with a structural engineer who pointed out there were tanks underneath that could actually be accessible.To me this could be a safety issue,since there is still electricity running down there. If a kid ever got into the building there could be an accident or tragedy. Are the security cameras up at that building?You promised to install them. • John Kelly stated this is an Orleans property issue so it really doesn't concern the plant. The electricity is still on because if water gets in down there it will be pumped back to the plant. We are aware of the other issues down there. • Beverly Carney stated her second comment is there should be an annual report on Tri-Town from the Board of Managers every year. 4. Chief Operator Updates—Jav Burgess: • Process—Last month the nitrate number was 49 mg/I. It is back down and is right around 28 mg/I.All other parameters are running in the single digits. • No. 1 Primary Clarifier has been completed and we have new rails, new decking and new flights on the mechanical operation portion of it. All other electrical issues have been taken care of as well. • No.2 Primary Clarifier is down now and is receiving the same treatment,with new grade, new rails,and any other equipment that needs to be replaced.These were two of the safety issues that we talked about regarding first responders possibly walking into unsafe areas.That area is now safe for anyone to walk on. 1 • No.2 Filter Press was completed and we installed the load cell right after the last meeting. I had an industrial electrician here and we worked on it for most of the day. It is back up and running with no weaknesses.As you know,the Edwards and Jones Filter Press Company is out of business and I have lost my contact for parts for these presses. We will now have to improvise until Orleans decides what to do with this plant. • No.2 Receiving Scale has been pulled out and that area has been filled in with concrete. • No. 1 Receiving Scale will be pulled out after this meeting and we hope to come up with one working scale using the parts from this scale.We do have two good working decks that we got off of the No. 2 Scale and are ready to be replaced.Worst case scenario is we may need new load cells and a circuit board card,which will probably cost a few thousand dollars. Hopefully by the next Board meeting we will have a working scale.We now charge a full or half truck when the haulers come in. A lot of them are concerned with the winter coming about leaving portions of loads on their trucks overnight that would freeze, resulting not being able to use their trucks until it thaws.They are requesting if they pump a cesspool of 700 gallons at the end of day and they have the paperwork from the homeowner, instead of charging them for a half or full truck, charge them based on the paperwork so that they don't have a frozen truck in the morning. • John Kelly asked how do you know it is the only load on the truck? • Jay stated they are required to have site glasses and we would be guessing. • John Kelly stated,why don't we see how we do with the scale repair. • Jay stated in the meantime you can give it some thought over the next month. • Martin McDonald asked if there is any way to measure the amount of time it takes to pump a truck. • Jay stated it is all different.Some guys have small vacuum trucks, some have large vacuums,some use two or three inch lines. • Incoming Water Line—Jay stated he sent some information from Wright-Pierce Engineers to this Board for the incoming water line to be added to the list of items that we were waiting for Brewster's approval. • Charlie Sumner stated it has all been approved. • Winter Sale—We already gave Ocean Edge their winter sale rate allowing them to start in December and continue through March.We were talking about a winter sale price of 7 and 8 cents, same as last year,for the rest of the towns. I spoke with the Chief Operator at the Yarmouth Plant, and they are not going to be having a winter sale. • Martin McDonald asked if we will get more volume during that time? 2 • Jay stated he is suggesting that we leave Dennis and Yarmouth out of the sale for the first month because the flow could put us right over the top and the residents of the three towns might be the ones that would be turned away. I am suggesting that Dennis and Yarmouth remain and the standard prices. S. A motion was made by John Kelly to exclude Dennis and Yarmouth from the District's winter sale rate and charge them the normal rate for out-of-town pumpings for the winter.This motion was seconded by Martin McDonald and unanimously voted and approved.Vote:3-0 • Martin McDonald asked what the out-of District rate is. • Jay stated the out-of-District rate is 12 cents per gallon. • Jay stated we are using a temporary worker to clean out the recharge beds back to the way the State wants them with raked sand and no vegetation. • Collections—There is about$13,000 left on the$43,000 that Neighborhood owes us. By the first of next year we should be done with them as they are on a C.O.D only right now in addition to making payments to us through the collection agency. • Grease Tank—We had some flow problems with our grease tank. For some reason we were coming in every morning to full grease tanks and had pumped and processed them the day before and had plenty of room, but found out that our return sludges from outside were backed up and started going to our grease tanks.We found a way around it and that problem is now solved. • Charlie Sumner asked if the walkways and stairwells are being repaired. • Jay stated one has been completely repaired.The stairways were welded and re-grouted. We didn't go with the$50,000 price because there was only one bid from Brewster so we welded the bottom stairs and put new metal in and have new concrete down there.We ordered all new grading for the primary clarifiers and we are done with welding the rails. Brewster Welding did the first one and we did the second on ourselves.They both meet code. 6. The Board reviewed the District's bank balances. 7.
