RESOLUTION APPOINTING THE CARTERET REDEVELOPMENT
AGENCY TO ADMINISTER REDEVELOPMENT AGREEMENT
BETWEEN BOROUGH AND KAPLAN AT CARTERET, LLC
Wltle~REAS, on February 25, 2004, the Borough and Kaplan at Carteret, LLC
entered into a Redevelopment Agreement for the redevelopment of the Lower Roosevelt
Avenue Redevelopment Area 0Redevelopmen~ Agreement"); and
W~tF~REAS, the Carteret Redevelopment Agency ("CAKA") was created and
exists for the purpose of furthering the redevelopment goals and policies of the Borough;
and
WItEREAS, pursuant to their respective powers under the Local Redevelopment
and Housing Law, the Borough wishes to appoint CARA to administer the Redevelopment
Agreement on behalf of the Borough, but not to designate CARA as the redevelopment
entity to implement the Redevelopment Agreement, such statutory responsibility to remain
with the Borough.
NOW, TltEREFORE, BE IT RESOLVED, subject to acceptance by CAKA
pursuant to resolution of such agency, that the Borough Council hereby appoints CARA to
administer the Redevelopment Agreement on behalf of the Borough, such administration to
occur in consultation with the Borough and its professionals.
BE IT FURTltER RESOLVED, that the Borough shall retain the statutory
responsibility as redevelopment entity for implementation of the Redevelopment
Agreement.
BE IT FURTHER RESOLVED, that a duly executed copy of the Redevelopment
Agreement shall be forwarded to CARA.
BE IT FURTHER RESOLVED, that a duly executed copy &this resolution shall
be filed in the office of the Borough Clerk.
