ROLL CALL: Commissioners Renzi, Ruane, Seggebruch, Womack and Chairman Kiefer were present. Commissioners Heinen and Minnis were absent. Plainfield Fire Protection District was present. Plainfield Township Park District, Plainfield Public Library District and Plainfield Community Consolidated School District 202 were absent. OTHERS PRESENT: Yuchen Ding, Associate Planner; Jessica Gal, Associate Planner; and Jonathan Proulx, Director of Planning APPROVAL OF MINUTES The minutes of the Zoning Board of Appeals dated September 3, 2019 were approved as amended. PUBLIC COMMENTS Chairman Kiefer asked for public comment and there was no response. DEVELOPMENT REPORT Mr. Proulx provided an update on the Special Use for TVA Logistic, the Will County Case, and the Boulevard Project. OLD BUSINESS NEW BUSINESS Case No. 1856-101119-.VAR 15731 S. Portage Ln. Tyler Cap Mr. Ding stated the applicant is seeking a variance to allow a fence in the corner side yard of their property. The fence will be a five-foot (5’) black flat top, open-style aluminum fence. The applicant is requesting an encroachment into the corner side yard of approximately 18 feet. Mr. Ding reviewed the finding of facts in the staff report dated November 19, 2019. Mr. Ding concluded staff welcomes public comments and the Board members’ input based on the findings of fact in this variance request. Chairman Kiefer swore in Tyler Cap, applicant. Mr. Cap stated he is requesting the variance for the safety of his children. Chairman Kiefer asked for public comment and there was no response. Chairman Kiefer asked staff if there is any consideration in changing the ordinance especially for corner lots. Mr. Proulx stated that it has been 3-4 years since fences have been discussed with the Board and it is time to revisit the fence ordinance. Commissioner Ruane asked if he built this home. Mr. Cap stated the home was built in 2015 and they purchased the home a month ago. Commissioner Ruane asked if the applicant was aware of the corner lot fence restriction when they purchased the home. Mr. Cap stated he was not aware of the restriction when the offer was submitted but became aware of the restriction before closing. Commissioner Ruane stated the process is in place for hardships, not convenience. Commissioner Ruane stated his concern is the 3 Zoning Board of Appeals Minutes November 19, 2019 Page 2 of 2 encroachment into the adjacent property’s front yard. Commissioner Ruane stated there are other alternatives like landscaping. Commissioner Womack asked the applicant to show what corner the HOA needed to be at a 90-degree angle. Mr. Cap stated it is the northeast corner of the rear yard. Commissioner Womack stated he is not opposed to allow people to use the side yard but is concerned about the encroachment into the neighbor’s front yard. Commissioner Womack stated he would like the applicant to work with staff and HOA to encroach into the side yard but still maintain the front setback for the adjacent lot. Commissioner Womack stated the fence product proposed is great. Commissioner Renzi stated he does not agree with having the 90-degree angle for the north east corner. Commissioner Renzi stated he does not see how this variance can be approved, since he cannot make the findings based on the evidence presented in the staff report. Commissioner Renzi agreed that the applicant should continue to work with staff and HOA to find a solution. Commissioner Seggebruch asked staff if the fence can come all the way up to the front of the house. Mr. Proulx explained for corner lots it is the distance between the nearest point of the home to the street. Commissioner Seggebruch provided additional solutions for the fence placement. Commissioner Seggebruch stated he is also concerned with the encroachment to the adjacent property’s’ front yard. Mr. Proulx added Creekview Drive does experience higher than normal traffic volumes. Mr. Proulx stated the commission can direct the applicant to clip the northeast corner of the fence and have the applicant revisit that with the homeowner’s association. Commissioner Seggebruch made a motion to adopt the findings of fact of staff as the findings of fact of the Zoning Board of Appeals and recommend approval of a variance to permit a fence up to 18 feet into the corner side yard for the property located at 15731 South Portage Lane. Seconded by Commissioner Womack. Vote by roll call: Renzi, no; Ruane, no; Womack, no; Seggebruch, no; Kiefer, no. Motion did not carry 5-0. DISCUSSION No Discussion. LOCKPORT STREET ANALYSIS On October 31, 2019, the applicant submitted sign permit applications to the Village of Plainfield Planning Department for three wall signs and two projecting signs for the businesses located within the Sanctuary Plainfield commercial building. The applicant was previously advised that internally illuminated signs were not permitted in the Central Sign District. The Central Sign District is intended to recognize the unique character of development within its boundary by providing signage controls commensurate with historic commercial development. The area approximating the boundaries of the central sign district of the village is generally the historic downtown and is illustrated in the map attached. While the current signs are not illuminated, they are equipped with the feature to turn on the internal illumination if and when it would be permitted. The lighting is also equipped with a dimmer to control the intensity of the light output. According to the applicant’s sign contractor, the light can be dimmed 80% of the maximum output before it turns off. Should the requested variance be approved, the applicant would be able to illuminate signs immediately and regulate the intensity of the light. In accordance with Section 9-33 of the Village’s Zoning Ordinance, the Zoning Board of Appeals shall not recommend approval of, nor shall the Village Board grant a variance from the regulations of the Zoning Ordinance unless it makes the following findings based on the evidence presented. The petitioner is seeking relief from Section 9-100 of the zoning code, which sets separate stipulations for signs in the Central Business District that corresponds with its historic development. The findings are as follows: a) The variance is in harmony with the general purpose and intent of this Zoning Ordinance; As set forth in Section 9-91 of the zoning code, the sign regulations are adopted for the purpose of: 1. Preserving, protecting and promoting the public health, safety, and welfare; 2. Regulating outdoor advertising and signs of all types, in an effort to reduce visual confusion and restrict signs which increase the probability of accidents by distracting attention, obstructing vision, or otherwise affecting the public good; 3. Maintaining the inherent right of businesses to communicate reasonably and identify their products and services by promoting the reasonable, orderly, and effective display of signs and outdoor advertising; 4. Maintaining the inherent right of residents and organizations to effectively communicate through signage in a reasonable and orderly fashion; 5. Enhancing the physical appearance of the village; 6. Preserving the value of private property by assuring the compatibility of signs with surrounding land uses. Staff submits that the requested variance is in harmony with the purpose and intent of the general sign provisions as outlined in the zoning code, but strongly conflicts with the purpose of those regulations set forth for signs in the Central Sign District. The applicant’s intention behind pursuing a variance is in order to allow for signage that effectively displays signs for all tenants located within the subject building. A light dimming feature has been incorporated into the wall and projecting signs so that lighting can produce a halo effect. 18 REPORT TO THE ZONING BOARD OF APPEALS Page #3 of 4 1865-121019.VAR 1/7/2020 24216 W. LOCKPORT STREET However, Staff finds that the requested variance does not consider the unique stipulations set forth for signs in the Central Sign District and is therefore inconsistent with surrounding development. The majority of the signs within the historic downtown area are lit by external light fixtures that are discrete and unobtrusive, especially those located along Lockport Street. b) The plight of the owner is due to unique circumstances and thus strict enforcement of the zoning ordinance would result in practical difficulties or impose exceptional hardships due to the special and unusual conditions that are not generally found on other properties in the same zoning district; The applicant states that externally lit fixtures installed to cast down light onto the signs would result in light that shines down and into the dining room floor where guests would be dining. This is due to the all-glass façade that is the primacy façade of the subject building. This side of the building also serves as the main entry from Lockport Street. Other reasons are outlined in the cover letter provided by the applicant’s attorney (attached) and include site characteristics that result in a lack of visibility for patrons visiting the tenants of the building. Staff finds that the unique characteristics, as identified, are related to a lack of lighting which is not prohibited by the zoning code and does not constitute a unique circumstance. External illumination is permitted in the Central Sign District and is encouraged to be used in order to provide patrons direction and communicate their services to the public. The current Zoning Ordinance was adopted in 2006. c) The property cannot yield a reasonable use if permitted only under the conditions allowed by the Zoning Ordinance; and Under the conditions of the Zoning Ordinance, the applicant is permitted to install exterior light fixtures in order to illuminate wall or ground signs. Therefore, Staff submits that the property can yield a reasonable use if external illuminated signs are installed on the subject building. Staff deems that the applicant could have incorporated wall signage mounted flush with the rest of the primary façade and anchored exterior light fixtures that could illuminate this signage. Such can be seen on nearby businesses that include Giambotta and DNA Athletics. Indirect lighting could also be considered to illuminate the sign faces, or other creative lighting methods. d) The variance, if granted, will not alter the essential character of the locality and will not be a substantial detriment to adjacent property. Staff finds that granting the variance has the potential to impact the essential character of the locality. Signs along West Lockport Street are illuminated by external light fixtures, for those that utilize any illumination. The requested variance creates a pattern of inconsistency and is not compatible with the streetscape in the historic district, as well as the subject historic building (c. 1904). CONCLUSION / RECOMMENDATION Staff submits that the findings of fact have not been met in order to recommend approval of the variance request. While the glass wall on the primary façade poses a challenge in incorporating 19 REPORT TO THE ZONING BOARD OF APPEALS Page #4 of 4 1865-121019.VAR 1/7/2020 24216 W. LOCKPORT STREET exterior lighting, Staff believes that there are solutions that can meet the applicant’s desire to illuminate wall signs and comply with the sign regulations set forth in the Zoning Ordinance. Therefore, Staff proposes that the applicant review lighting alternatives with a sign contractor. Staff is seeking input and direction from the Zoning Board of Appeals on whether there is support to allow internally illuminated signs in the historic downtown which could be reviewed through a future text amendment process. Based on the foregoing analysis, prior to any public comments during the public hearing, additional information from the applicant, and discussion by the Zoning Board of Appeals, the following motion is offered for your consideration: I move we adopt the findings of fact of staff as the findings of fact of the Zoning Board of Appeals and recommend denial to allow three internally illuminated wall signs and two internally illuminated projecting signs in the Central Sign District for the business known as Sanctuary Plainfield, LLC located at 24216 West Lockport Street, subject to the following two (2) stipulations: 1. Compliance with the requirements of the Village Engineer; 2.
