The Council of Bal Harbour Village not at the Administration
Building, Monday, June IS, 1951s at 8:00 o'clock P. M.
There were present: Messrs. Beatty, Simons, Stokely and.
Dr. Leonard
Absent: Mr. Harry Brown
Also present were W. H. Webb, Village Manager; Mary Wetterer,
Village Clerk; and. Fred Baisden, Village Attorney.
The minutes of the previous meeting were read and upon motion
of Dr. Leonard* seconded.:by Mr. Simons, the minutes were unanimously
approved as .read.
Mr. Stokely said he would like to clear up all unfinished patters
from the last meeting and,told the council a letter had been prepared
in answer to.Mr. Barnes! letter# and read the letter -to the couneik,
Mr. Simons brought np the subject of the ownership,of, the village
water mains and Mr. Webb "said that he had asked Miami - Beach "Heights
to ;assign, all the mains. vast "of.Collins Avenue to the Village., He
said it was his underatanding that. Miami Beach Heights,had,grani+ei"
this requeat and Mr. Thergel was preparing .. the,asa:jgmwats at this
time for both the mains on the east and west of Collins Avenu § It
was then moved by Dr. Leonard, seconded by Mr. Simons, that in view
of the fact that the water situation had not been cleared up that
the letter would be withheld temporarily, and unanimously voted.,,

4r. Simons was asked what information he had in regard to
having resolt}tions printed for retiring councilmen. He said that
lie didn't have this information, but would lave it for the next"
meeting.
Mr. Stoke]* said that the Village tanager had,seoured copies of
House Joint Bill #993 and that all the councilmen had received
eopies.of the bill, but that the Legislature had.:;adjoorned without
taking any action on the subject.
Mr. Webb informed the council that there was one tax bill left
unpaid and explained that it, was an assessment of $40.00.to the
Sskay Drug Company which had operated in the Sea View Hotel during
the 1950 winter season and was no longer at that4oeation. He said
siith.the councils permission he would like.to have this =paid tax
charged off to the discount and abatements fund, Upon motion of

Mr. Beatty, seconded by Mr. Simons, it "was unanimously voted that
the $40.00 vagaid personal property tax bill be„ charged off, to
discounts and abatements.
The Village Clerk.presented a form resolution from the Miami
Beach First National Rank authorizing the signatures on the Village
checks and informed the council that checks =7 either be signed'
by the Village Manager or the Mayor. On motion of Mr. Simons,
second=ed by 'lr. Leonard, the resolu*J n was unanimously "passed "and
Mr. Stokely or Mr. Webb were author3ied to sign thd; village clocks.

Mr. Baisden explained to the.couacil that he had written Mr.
Henry as instructed -by the- council and ordered the four signs •in,
.
front of the ,Emerald Isle Hotel removed by June 15th. He read his
- letter to the council and also the reply from Mr. Henry in which he
refused to remove the signs. Mr. Baisden then said it was up to the
council to decide what course they wished to take and explained: the
different ways the situation could be handled. After discussion it
was the consensus of opinion that the signs were not in �eepiug with
the Bal Harbour policy and it was moved by Dr. Leonard, seconded by
Mr. Beatty, and unanimously voted that Mr. Baisden was to notify Mr.'
Henry of the action of the council and if the signs were not removed
within ten days the village manager was empowered to remove the
objectionable signs which were not instilled in accordance with
Ordinance #24.
Mr. Webb read to the council the results of the survey held to
determine the flow of traffic through Bal Harbour and said.he had
asked °Miami Beach Heights permission to contruet•temporary turn-
arounds at Bal_Bfy Drive and 96th Street and Camden Drive at Park:
Drive, which had''bbeen granted and he understood that Zurwen4-
Whittaker were preparing plans for the turn arounds. He asked that
the council transfer $500.00 from the village.surplus to do this
work. Dr. Leonard suggested that - perhaps the traffic count was A
not entirely accurate due to the number of construction trucks and
cars in the village and also that with the streets off 96th Street
closed there was a bad left turn at 96th Street and hest Bal Harbour
Boulevard, Mr. Webb informed him that a survey was being conducted
now'and a traffic light to correct this situation was being included
in the new budget, Mr. Stokely brought up,the point of whether it
was proper to spend the village money on something they had nothing
- to do with. Mr. Webb said that at the annual meeting of Bal Harbour
Club the members had authorized the streets closed, and that the.!
Camden entrance was really a private street -owned by Miami Beach '
Heights and they had authorized it closed. It was moved by Yx.
Simons, seconded by Mr. Beatty, that the Village ?tanager be author
ized to take $500.00 from surplus to close the undedicatedopeni.ng
(Camden Drive) and•Bal.Bay Dri a at 96th Street and unanimously
voted.
Mr. Webb said that he was preparing the budget for the next
meeting and that he would 14e to have a Board of i'qualization.meet.
ing the first or second week -.1n July and that he would like to have
the council's opinion on whether or not they would approve raises
for the employees. Mr. Stokely suggested that if Mr. Webb thought
this could be worked out to go ahead and get up the figures and see
how it worked out. 'Mr. Baisden suggested that the budget this year
carry an item of around $1,000.00 for litigation fees.
Mr. Webb reminded the council that it had been decided that the
Village would invest some of its surplus in government bonds„ but
that the bank had cautioned against it at this time. He said that
instead of buying government bonds he would prefer to'install side -
walks on both sides of Collins Avenue and assess the property owners
with interest at a rate of 6%, the assessments to be paid off in
two years. He said he believed it would cost about .$5',000.00.' The
council asked him to get definite figures on this for the next meeting.

Mr. Webb also ,stated that the village police car was in ,very;
bad oondition and that he had an appraisal made on it and bad �a
price of a net Plymouth,Svrburban. He said that he wouldMe,to

see the council appropriate $1,300.00,from surplus and then turn
the old car in right away and have an item in the new badget "k r
another replacement next summer. It was moved by Dr. Leonard,.
seconded by Mr. Beatty, and unanimously voted that a new car be.,
purchased right away with money taken from surplus.
The Village Manager said that about this time last year the
council had approved the placing of sprinklers in the parks along
Harbour Way and asked for $2,000.00 from surplus to install: sprinklers
in the park behind the apartments in Block 7. The councilseked .
him to get definite figures on this job and perhaps they would have
a special meeting on dune 20th.
It was moved by Mr. Beatty that -Ahe meeting be adjourned. .Mr. .
Simons said that he had some questions to ask before adjourning.
He wanted to know what vas being done about acquiring a site 'or the
municipal building. , Mr. Webb said that he had asked Mr. Grabam
about this, but.had not received an answer.
Mr. Simons asked if as Long as the village streets were priva�e
property if they couldn't be taxable. Mr. Webb said that this bad
been discussed with, Mr. Lummas when the plat was recorded and he had .
agreed to accept the dedication and not tax them. The only- stipula-
tion was that if for any reason Bal Harbour Village would, be disolved'
the streets would revert to the county.
Mrl Simons wanted to know what the rate of assessment was for
the land known as the "Business,Section". Mr. Webb said that it
was taxed for 1950 at $8,800.00 per acre. Mr. Simons then asked.}
what the difference was in an assessment for residential land and -
the business section. Mr. Webb said that he would have to convert .
land imlues in the residential lots to an acreage basis a4& make a
comparison. Mr. Simons said -that he was talking to Mr. Lmmus,.the
county assessor, the other das$� and didn't think this comparison
was accurate and should be choked.
Upon nation of Mr. Beatty, seconded by Mr. Simons, it was
unanimously voted that the meeting be adjourned.
