HomeMy Public PortalAboutResolution 64-403RESOLUTION NO. 64 -403 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY URGING THE STATE LEGISLATURE TO ADOPT LEGISLATION IN RESPECT TO GAMBLING OR IN THE ALTERNA- TIVE PERMIT LOCAL CONTROL OF GAMBLING NOT SPECIFICALLY CONTROLLED BY STATE LAW WHEREAS, the Appellate Courts of the State of California have ruled that the state of California has preempted the field of regula- tion of gambling and that cities cannot regulate or prohibit gambling games which have not been prohibited by the State of California; and WHEREAS, certain card games, particularly the game of Panguingui, have not been prohibited by the State of California; and WHEREAS, as the result of Panguingui not being prohibited by state law attempts have been made in recent months to conduct such card gambling games in various cities in the County of Los Angeles, particularly the cities of Long Beach, Santa Monica, Culver City, Manhattan Beach and Alhambra, and such card games are now being operat- ed in a number of such cities over the objection of such cities; and WHEREAS, the open conduct of gambling results in an increase of many types of crime and has caused a substantial police problem in the cities where such gambling is now being conducted. NOW, THEREFORE, BE IT RESOLVED BY the City Council of the City of Temple City as follows: SECTION 1: The Legislature of the State of California is hereby urged to adopt, at the earliest practicable date, legislation expressly prohibiting Panguingui and to develop and adopt more compre- hensive statutes in respect to organized gambling, or in the alterna- tive grant to the municipalities the right to regulate and /or prohibit organized card gambling games which are not now prohibited by Penal Code Section 330. SECTION 2. The City Council of the City of Temple City ex- pressly recognizes that a uniform code of laws respecting all penal matters is most desirable but recognizes equally that controls over organized gambling and other problems are of great concern in Los Angeles County and cannot abide further delay by the State Legislature, and hence in the event the State Legislature does not elect to cure the present problem of Panguingui and other matters of recent court action, the legislature must provide the cities of the County of Los Angeles ,., with the legislative right to adopt laws regulating that which is not specifically regulated by the State.
