The regular meeting of the City Council was called to order 14 Mayor Nunamaker at 7:30 P. M. 2. Invocation was given by Father Burch of St.."Lukes Catholic Church of Temple City, followed by the Mayor leading the Pledge 3. of Allegiance to the Flag. 4. ROLL CALL: Present: Councilmen- Dickason, Fitzjohn, Merritt, Nunamaker Absent; Councilman - Tyrell Also Present: City Attorney Shatford & City Manager Woollett 5. APPROVAL OF MINUTES: Regular meeting of March 9 and Adjourned meeting of March 16, 1964. The minutes of March 9 were corrected to read under "Also Present: "should read Assistant City Manager Koski instead of City Manager Woollett. Councilman Fitzjohn moved to approve the minutes of March 9 as corrected and the adjourned meeting of March 16, 1964, Councilman Merritt seconded, and carried by the Following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker NOES: Councilmen -None ABSENT: Councilman - Tyrell OLD BUSINESS: PUBLIC HEARINGS: CURB & GUTTER IMPROVEMENT: a. Noel Dr. east side, Olive to cul de sac b. Noel Dr. west side, Olive to cul de sac c. Rancho Real, north side, Rosemead to Sultana d. Arden Dr. east side, Olive to Freer. The City Manager reported on item a,the petition was signed by 73.7% of the property, on item b the sign -up represented 65% of the property, item c and d were both signed up 100 %. Councilman Fitzjohn moved to open the public hearing, Council- man Merritt seconded and carried. Mayor Nunamaker asked if anyone wished to speak for or against this installation. M. G. Ellis, 9104 E. Olive St., advised he had signed up his property on Noel and was desirous of having the installation on his property continue on around the corner on Olive. He was advised this could be done under the same conditions as on Noel Dr. Councilman Dickason moved to close the public hearing, Councilman Fitzjohn seconded, and carried. Councilman Tyrell arrived at this time, 7:35 P. M. Councilman Merritt moved to declare projects to be in the public interest and instruct the Supt. of Streets to cause the work to be done, Councilman Dickason seconded, and carried by the following roll call vote: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamake: NOES: Councilmen -None ABSENT: Councilmen -None 6. ORDINANCE NO. 64 -126: 2nd reading. City Attorney Shatford read title to Ordinance No. 64 -126 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIF- ORNIA, AMENDING THE MUNICIPAL CODE TO CORRECT DUPLICATION OF CODE NUMBERS AND TO ASSIGN NUMBERS TO PREVIOUSLY UN- NUMBERED ORDINANCE SECTIONS. Councilman Fitzjohn moved to waive further reading, Councilman Dickason, seconded, carried by following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None Councilman Dickason moved to adopt Ordinance No. 64 -126, Coun- 591 Council Minutes, March 23, 1964, page 2 cilman Merritt seconded, roll call vote to carry as follows: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 7. INSTALLATION OF HIGH VOLTAGE TRANSMISSION POLES ON NORTH SIDE OF DAINES DR. OBJECTED TO BY VERNON HAMMOND, 5500 N. Persimmon Ave. eta]. The City Attorney reported the easement rights of Edison Co. are there and they do have the right to install the power lines which were installed. The City Manager advised - meetings had been held regarding the location of this transmis- sion line and the Flood Control would not give permission to use the channel, also the C. A. A. would not grant permission to use Lower Azusa Rd. because of the El Monte airport. He advised Edison Co. indicated they talked to the property owners. Also the City received a petition containing 79 signatures re- presenting 51 property owners and of these 7 faced on Daines Dr. out of 35 properties facing on Daines Dr. This amount of voltage cannot be put underground. Mr. Vernon Hammond, 5500 N. Persimmon, advised he was not inform ed by Edison Co. and that they felt some other route could have been used. The City Manager advised him if he felt private property rights have been violated that Edison Co. could better answer his questions as the City cannot be responsible as there is an easement on the property and they do have rights to run over the road easement, that the City is not in a position to tell Edison Co. whether or not they can. We can negotiate but we cannot force them, and this is precisely what the City did. Under the present procedure the responsibility is with the Edi- son Co. 0. RESOLUTION NO. 64 -358: Adoption of Gas Tax Budget of Expendi- tures. The City Manager advised the Council some time ago adopted a Resolution regarding how we wished to expend Gas Tax funds during 1963 -64. This new resolution includes the new gas tax otherwise no further change. Councilman Tyrell moved to adopt Resolution No. 64 -358, Councilman Fitzjohn seconded, carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 9. ORDINANCE NO. 64 -120: Urgency Ordinance. City Attorney Shatford read in full Ordinance No. 64 -120 titled AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, READOPTION OF SECTIONS OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO THE ESTABLISHMENT OF THE PLANNING COMMISSION Councilman Dickason Moved to adopt Ordinance No. 64 -128, Coun- cilman Merritt seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 10. ORDINANCE NO, 64 -130: Urgency Ordinance City Attorney Shatford read in full Ordinance No. 64 -130 titled AN ORDINANCE OF THE CITY OF TEMPLE CITY, CALIFORNIA, CORRECTING THE ZONING MAP ADOPTED BY ORDINANCE NO. 64 -124. Councilman Tyrell moved to adopt Ordinance No. 64 -130, Councilman Fitzjohn seconded, and carried by the following called vote: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 11. PLANNING COMMISSION RECOMMENDATIONS: The Planning Advisor stated the off - street parking is to be in a separate ordinance and not yet approved by the Planning Com- mission, and in order to have controls it will be necessary to continue the present ordinance. City Attorney Shatford read in full Ordinance No. 64 -131 AN ORDINANCE OF THE CITY OF TEMPLE CITY, CALIFORNIA, CONTINUING IN EFFECT OFF- STREET PARKING RE- QUIREMENTS AS CONTAINED IN LOS ANGELES COUNTY ORDINANCE N0, 1494 UNTIL ADOPTION OF NEW TEMPLE CITY LAWS. Councilman Tyrell 592 Council Minutes, March 23, 1964, page 3 moved to adopt Ordinance No. 64 -131, Councilman Merritt seconded, carried by the following roll call vote as an urgency ordinance :I AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None (a) Lot Frontage Ordinances 63 -103 and 63 -104. Recommendation continued use of these ordinances. City Attorney Shatford read in full Ordinance No. 64 -129 titled AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, ADDING ORDINANCE NO. 63 -112 TO THE TEMPLE CITY MUNICIPAL CODE AND PROVIDING NUM - BERING OF SECTIONS IN REGARD THERETO, an urgency ordinance which includes the above recommendation. Councilman Merritt moved to adopt Ordinance No. 64 -129 as an urgency ordinance, Councilman Fitzjohn seconded, carried by the following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None (b) Ordinance No. 64 -123: Urgency ordinance City Attorney Shatford read in full Ordinance No. 64 -123 titled AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, AMENDING ORDINANCE NO. 63 -107 TO ESTABLISH A FILING FEE OF THREE HUNDRED DOLLARS FOR SUBDIVISION. Councilman Tyrell moved to adopt Ordinance No, 64 -123, Councilman Dickason seconded, carried by the following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 12. SET PUBLIC HEARINGS: CURB & GUTTER and ASSESSMENT City Manager recommended the following be set for Public Hearing on April 13, at 7:30 P. M. a. petition for curb and gutter improvement on Daines Dr., north side, Halifax to Pal Mal. b. assessment of property for cost of constructing curb and gutter at 6277 Golden '.r lest Ave. Councilman Fitzjohn so moved, Councilman Merritt seconded, and carried. 13. RESOLUTION NO. 64 -357: Warrants & Demands Nos. 4737 to No. 4766 in the sum of $21,299.76 The City Manager presented Resolution No. 64 -357 and recommended adoption. Councilman Tyrell moved to adopt Resolution No. 64- 357, warrants and demands in the sum of $21,299.76, Councilman Nunamaker seconded, carried by the following called vote: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 1 COMMUNICATIONS: The City Manager presented the final map on Tract #28607. He ad- vised the Council had approved the tentative tract map some time ago and recommended this final map for approval. He advised the City Engineer recommends as follows: 1. Approval of the Map. 2. Acceptance of streets and easements as offered for dedication on said map. 3. Approval and acceptance of the following work agreements and bonds after their first being examined and approved by the City Attorney. An Agreement to install sanitary sewers as required by the subject tract, and a surety bond in the amount of $11,000.00 executed by Noel Baldwin & Mary Rita Baldwin and Glen Falls Insurance Company. An Agreement by Noe) Baldwin & Mary Rita Baldwin guaran- teeing setting of survey monuments, tie points, and fur- nishing tie notes, and a surety bond in the amount of $1,010.00 executed by Noel Baldwin & Mary Rita Baldwin and Glen Falls Insurance Company. 593 Council Minutes, March 23, 1964, page 4 An Agreement by Noel Baldwin & Mary Rita Baldwin to construct block walls, and a surety bond in the amount of $800.00 executed by Noel Baldwin & Mary Rita Baldwin and Glen Falls Insurance Company. 4. That your honorable body make a finding as follows: The City Council, pursuant to Section 11587 of the Subdivision Map Act, hereby finds that Noel Baldwin, subdivider of the subject tract, has in good faith attempted to secure the signature of Southern Calif- ornia Edison Company, has been unable to do so and a refusal to accept the map for recording would work an undue hardship on the subdivider. The City Manager recommended the City Council approve the above and also that on the two streets in the subdivision that the 5 ft. easement adjacent to the streets be authorized for side- walks as well as utilities. Councilman Tyrell so moved, Coun- cilman Dickason seconded, carried by following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 15. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Chas. Oakley, 6164 Rosemead, asked again about the property next to him reported unsightly. The City Attorney stated he had written Mr. Janus giving him 30 days to clean up or be cited. 16. MATTERS FROM CITY OFFICIALS: Councilman Dickason requested a status report on Civil Defense for the next Council meeting. He also asked regarding the People to People program and asked if Mrs. Clarkson might not report to the Council at their next meeting regarding the pro- gress she has made. The City Attorney was asked regarding the problem on Kauffman and advised he gets conflicting reports some saying they are going ahead with the development and then again that they are not. He will contact Mr. Waade and find out definitely and if not he will go ahead and serve notice again on the attorneys. There followed some discussion in this regard. Councilman Merritt reported that on March 20 late at night about 18 or 20 teenagers converged on Temple City Park and dis- appeared. A discussion followed regarding lighting and pro- blems involved. The City Manager reported meetings with the Sheriff and Supt. of Schools and some progress had been made. They are cooperating and the Sheriffs Dept. is patroling and checking more often. Also the new plans for Temple City Park will provide adequate lighting. Mayor Nunamaker reported an accident at Garibaldi and Temple City Blvd. in which two teen -agers were hurt and he had been advised it took 35 min. for the ambulance to arrive. The City Manager will check into this report for full information. There followed discussion by the. Council regarding installation of signals at this corner, and possibly at Woodruff and Temple City Blvd. due to number of accidents and requests. 17. ADJOURNMENT: Councilman Dickason moved to adjourn, Councilman Fitzjohn se- conded and carried. Council adjourned at 8:35 P. M.
