HomeMy Public PortalAbout2012-03 Qualifying period for the Mayor and Village CouncilORDINANCE NO. 2012-3 AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AMENDING SECTION 2-101 "QUALIFYING PERIOD" OF ARTICLE V "ELECTIONS" OF THE VILLAGE CODE OF ORDINANCES, RELATING TO THE QUALIFYING PERIOD FOR THE MAYOR AND VILLAGE COUNCIL; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Village of Key Biscayne (the "Village") General Election is scheduled for November 6, 2012; and WHEREAS, the Miami -Dade County (the "County") Elections Department has requested that the Village Council's qualifying period for the General Election be modified in order to enable the County Supervisor of Elections to meet statutory deadlines for the mailing of overseas absentee ballots; and WHEREAS, the Village Council desires to modify Section 2-101 of the Village Code of Ordinances to provide that the qualifying period for the Mayor and Village Council maybe modified, if such modification is necessary in order to accommodate a request by the County Supervisor of Elections office or a successor entity or to comply with state or Federal law; and WHEREAS, the Village Council hereby finds and declares that adoption of this Ordinance is necessary, appropriate, and advances the public interest. NOW, THEREFORE, IT IS HEREBY ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS': Section 1. Recitals. The preceding "Whereas" clauses are ratified and incorporated as the legislative intent of this Ordinance. Section 2-101 of the Village Code Amended. The Village Council hereby amends Chapter 2 "Administration" of Article V "Elections," by amending Section 2-101 "Qualifying period" of the Village Code, to read as follows: Sec. 2-101. - Qualifying period. (a) Regular Election. Candidates for the office of Mayor shall qualify with the Village Clerk no earlier than noon on the 77th day and no later than noon on the 67th day prior to the date of the Mayoral primary election, and candidates for the office of Village Council shall qualify with the Village Clerk no earlier than noon on the 85th day and no later than noon on the 75th day prior to the date of the regular Council election of the Village, in the method provided for in the Village Charter or Code, and under the rules of elections prescribed in the Florida Statutes. The Qualifying periods provided for in this section may be modified for a specific election by resolution of the Village Council in order to accommodate a request by the Miami -Dade County Supervisor of Elections office or a successor entity or to comply with state or Federal law. In the event of such modification, the Village Clerk shall publish the modified qualifying dates in a newspaper of general circulation within the Village at least 10 days prior to the commencement of the modified qualifying periods. (bl Special Election. In those situations in which a special election is called for the purpose of filling a vacancy which occurs on the Council or in the office of Mayor during an unexpired term of office, the Council shall by resolution establish the qualifying period during which candidates for the vacant office may qualify with the Village Clerk in the method provided for in the Village Charter or Code, and under the rules of elections prescribed in the Florida Statutes. Section 3. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 4. Conflicts, All ordinances or parts of ordinances, resolution or parts of resolutions, in conflict herewith, are repealed to the extent of such conflict. 2 VILLAGE ATTORNEY Section 5.
