FEBRUARY 15, 1995
The regular meeting of the Town Board was called to order at 7:45 p.m. Board present
were Mayor Pro-tern Klancke, Wirsing, Havens, Olson and Johnston. Also present were
Brown and Wittter.
Minutes of the previous meeting were approved as written.
WAPITI MEADOWS
Ivtary Helen Sanduva! gave a progress report on the development. Rental application are
strong, the larger units are st,ill available. Complex manager applicants will be reviewed in
the next few weeks. The comrmmil.y center construction will start in April and tJte day care
provider position is still open.
Sandoval presented color board of the exterior of the building and well and interior color
board.
Ground water at the North end of the development has been encountererl and they are
considering methods 1.0 de~ll with it.
PUBLIC HEARING/ FLOOD DAMAGE PREVENTION ORDINANCE
Town attorney Rod McGowan gave a blief overview of the Ordit13nce.
E.xhibit A. Proof of publication of this hearing for consideration of the Ordinance.
The Fraser Planning commission has recommended adoption of this Ordinance.
Discussion took place with regards to getting the appropriate mapping of the flood plain.
Brown has been working wil.h the agencies 1.0 gel. a hase tHap updated for the flood plain
with the infonmltion that we have 011 file through the various mapping of new sl1hdivisions.
Havens moved to adopt Ordinance 21.6, 2nd Wirsing, earned.
ENGINEER REPORTS
Opitz reviewed the Highway 40 palh paving project. The bid package will be to CDOT
next week {(.>r their re\~ew. Bid the project in April with the work being done in Jurw. The
lown CI"CW wilt be doing most of Ihe prep wo.-J~ on this projc;cl.

Opitz also advised that there arc 4 telephone pedestals that need to be moved to make the
path better, the est. cost is $7500.00. Johnston moved to have Optiz get this work
accomplished, 2nd Havens, carried.
Mt. Parks Elec. still has concerns with the joint use of the easement.
Pete's Excavation billing for the Highway 40 path was discussed. Pete's has turned in
extras ilnd Opitz also reviewed possible charges the Town can make against them for not
meeting Ihc completion date. Opitz directed to work latc penalties to the amo11nt of the
extras and not go beyond that number on any penally as the work was substantially
complete and they did such a goodjoh.
Brown reported that the water loan had been approved as applied fof. Opitz and Brown
reviewcd Ihe estimated costs for the project. Also reviewed buried cables Vs radio
tr.msmission. The job will be separated lbr bidding purposes. Board authorized Opitz to
staJt bidding process.

Subject: Report of the Winter Park and Fraser Valley Chamber of Commerce
. The Board of Directors of the Winter Park and Fraser Valley Chamber of
Commerce met on March 9, 1995. However, the financial statements for the
month of February were not completed in time for this Board meeting. The
outside auditors were in the Chamber offices last week to conduct their review
of the year end financial statements for 1994. We expect the completion of
their work by the end of this month.
. The last of three planned collateral pieces for marketing of the coming summer
season is the Winter Park and Fraser Valley Mountain Bike Trail Map. These
maps have been completed and distribution is now being planned. We
anticipate that 9,000 of the maps will be distributed through advertising
response fulfillments. The balance of the initial order of 50,000 maps will be
distributed through the Visitor Centers in Winter Park and Fraser, through bike
shops and lodges in the Valley, through the ski area, through front range bike
shops, and through special events now being scheduled.
. Winter Park Music, Inc. (WPM!) is moving forward on planning for the two-day
American Music Festival and for two, one-day festivals, all of which will be held
at the Winter Park Resort. The American Music Festival will be held on the
weekend of July 15 and 16. The plans for the one-day festivals call for a
smaller version of the Winter Park Jazz Festival and a County Music event
which would be promoted in conjunction with the High Country Stampede
Rodeo. These smaller one-day events are scheduled for July 8 and August 19.
WPMI has not finalized the artists for these smaller concerts, but hopes to set
the schedule and the artists by the end of this month.

. The Chamber is moving quickly on the construction of the new Business Office
and Visitor Center on Highway 40 in Winter Park. The electrical work,computer
and phone cabling, new interior walls, doors and trim, and ceiling supports have
all been completed and the schedule calls for carpet installation to occur on or
about April 10, the last step before furniture and office systems can be installed
in the space. The Chamber Board has approved the purchase of a new
computer and phone system that will modernize the communications functions
of the Chamber. The anticipated move-in date for the Business Office is by the
end of March with the Visitor Center still scheduled to open on July 1 st.
. The visitor count for February was 7,290 an increase of approximately 10%
over the visitor count in February of 1994. This increase is due in part to the
expanded hours of operation at the Visitor Center where we are now open
nightly until 7:00pm. The Visitor Center in Winter Park also experienced an
extraordinary volume of visitors during the February blizzard which closed
Berthod Pass' for two separate days leaving travellers stranded and needing
assistance with lodging and directions.
. The Chamber's monthly luncheon will be held this Thursday at the Last Waltz.
The program topic will be a panel discussion of the pending legislation in the
Colorado State House calling for the dissolution of the Moffet Tunnel
Commission. Speakers will include several members of the MTC, two of Grand
County's three County Commissioners and other interested parties both for and
against the legislation. We still have room in what will be an interesting session
and a good lunch. We invite the Trustees of the Town of Fraser to attend this
luncheon.
. During February, seven new members joined the Chamber and one member was
dropped. This brings our total membership to 295. The Chamber is pleased to
be within striking distance of our 90-day goal to reach the level of 300
members.

AN ORDINANCE AMENDING ARTICLE 4-2, SECTION 4-2-2 OF THE CODE OF THE
TOHN OF FRASER AND AMENDING THE UNIFORM FIRE CODE, AS ADOPTED BY
THE TOWN OF FRASER, BY ADDING REGULATIONS GOVERNING THE BURNING OF
BUILDINGS AND STRUCTURES FOR DEl10LITION PURPOSES WITHIN THE Tmm OF
FRASER, PROVIDING FOR THE ISSUANCE OF PERMITS FOR SUCH BURNING, AND
REPEALING CONFLICTING AND REPETITIVE PROVISIONS IN ARTICLE 7-4 OF
THE TOWN CODE.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN
OF FRASER, COLORADO, THAT:
PART 1: AMENDMENT OF TOHN CODE. The Code of the Town of Fraser,
Colorado (herein sometimes referred to as
the "Town Code" ) is
hereby amended as follows:
1.1 Section 4-2-2 of the Town Code
is amended by adding a new
subsection, to be numbered "Section 4-2-2(1) (b)", which adds a new
section to the Uniform Fire Code, as adopted by the Town of Fraser,
and which shall read as follows:
Section 4-2-2. Amendments and Definition~~
(1) The following amendments to said Codes are hereby adopted:
(a) [No change]
(b) An additional section is hereby
added to said Uniform
Fire Code, to be numbered "Sec. 11.206", which
shall read as
follows:
Sec. 11.206 - Dem01ition Burning.
(a) Definitions. As used in this
section, unless the
context otherwise requires, the following words and phrases
shall have the meaning as defined herein:
1. "Board of Trustees" or "Board" means the Board
of Trustees of the Town of Fraser, Colorado.
2 . "Person" means
any individual, firm, company,
corporation, district, or private or governmental entity
of any kind. ,
3 . "Fire District"
means the East Grand Fire
Protection District No. 4.
4. "Demolition
Burning" means the intentional
burning of any building,
garage, house, shed or other
building. or structure, or any portion thereof, wi thin the
Town of Fraser, , for
the purpose of demolishing,
destroying or disposing of such building or structure.
(b) Permit Required; Exceptions.
It shall be unlawful
for any person to undertake, participat~ in or authorize any
Demolition Burning within the Town
of Fraser, except in
accordance with a permit issued for such Demolition Burning as
provided in this section. The
provisions of this section
shall not apply to the burning of \-laste materials and rubbish
produced by mechanical demolition of a building or structure,
but such burning shall be
subject to other applicable
provisions of the Uniform Fire Code, as adopted by the Town of
Fraser, indluding those provisions relating to open burning.

(C) Owner's Obligations. In order to obtain a permit for
Demolition Burning pursuant to this section, the owner(s) of
the property to be burned shall comply
with the following
requirements and conditions:
l. The owner of the building
or structure to be
burned shall make adequate provisions
for the
termination, relocation or protection of all utilities.
2 . The owner shall indemnify the Town
of Fraser
and the Fire District from any
and all liabilities,
losses and expenses, including attorney fees, suffered or
incurred as a result of the Demolition Burning, and shall
provide proof of adequate security
in the form of
insurance or otherwise to guarantee such indemnification.
3 . The owner shall provide an adequate performance
bond or other security acceptable
to the Board of
Trustees to insure that the
site is cleaned up
and
restored in the manner and within the time required by
the terms of the permit.
4. The owner shall pay all costs associated
with
the Demolition Burning, including without limitation the
costs of crowd control and traffic control, if required
by the Board.
5. The Board
may impose such additional
requirements or conditions for
the issuance of a
Demolition Burning permit as it de~ms necessary for the
protection of the health, safety
or welfare of
the
community.
(d) Application for Permit. A written application for a
permit required by this section shall be filed with the Town
Clerk by the owner of the building
or structure which is
proposed to be burned. Such application shall include or be
accompanied by the following:
l. A current commitment for title insurance policy
or other title evidence acceptable
to the Town,
disclosing the identity of the
fee owner(s) of the
property upon which the burn is to occur and any liens or
encumbrances affecting such property.
The permit
application shall be signed by each such owner and the
holder(s) of any lien or encumbrance.
2. A drawing showing the l6cation of the building
or structure to be burned and any other buildings,
structures or improvements situated on the same ~roperty
or on any adjoining property.
3. A burn plan describing in detail
the proposed
burn, which plan shall have been approved in writing by
the Fire District. Such burn plan shall
include, at a
minimum, provisions for the Fire
District to conduct
and/or supervise the burning operation,
the proposed
dates and duration of the
burn, the Fire District
exercises to be performed on or within the structure, any
special conditions or precautions deemed necessary by the
Fire District, proposed provisions for restoration of the
site, and provisions for complying with all other permit
requirements and conditions referred to in this section.
4. Payment of an application fee.
The amount of
the fee shall be established and may be adjusted from
time to time by resolution of the Board of Trustees.

(e) Public Hearing. After a completed application has
been filed pursuant to the preceding subsection, the Board
shall schedule a public hearing on the application, to be held
not later than thirty days after filing of the application.
Such hearing may be continued by the Board for up to an
additional thi~ty (30) days upon request of the applicant or
upon the Board's own initiative. The applicant shall mail
written notice of the time and place of suc~ hearing, together
with copies of the application and burn plan, by certified
mail, return receipt requested, at least ten (10) days prior
to the hearing, to all owners of property within two hundred
feet (200') of the burn site, the Grand County Sheriff's
Department, the Fraser Sanitation District, Public Service Co.
of Colorado, Mountain Parks Electrical Association, TCI Cable
Television, and the Grand County Historical Association. In
addition, the applicant shall cause notice of the time and
place of such hearing to be published. in a newspaper of
general circulation in the Town of Fraser, by one publication
not less than seven (7) days prior to the hearing. Written
proof of the giving of such notices'shall be filed with the
Board prior to or at the public hearing. At the hearing, the
Board shall consider all relevant information presented and
shall render a decision within thirty days after the close of
the hearing, either approving the issuance of a permit for the
proposed Demolition Burning, including any conditions, or
denying the application.
(f) Issuance of Permit. If the application is approved
by the Board, the Town staff shall, within ten (10) days after
such Board approval and satisfaction by the applicant of any
conditions precedent specified by the Board, issue a permit
for the Demolition Burning to the applicant and mail a copy of
the permit to the Fire District. The permit shall incorporate
the approved burn plan and any conditions imposed by the
Board. No such permit shall be effective unless and until it
.has been signed by the applicant to acknowlege the applicant's
agreement to be bound by the terms and conditions set forth in
the permit.
(9) Conduct of Burning. Prior to conducting any
Demolition Burning, the applicant shall cause a notice to be
published in a newspaper of general circulation in the Town of
Fraser not less than seven (7) days prior to the date of the
Demolition Burning, which notice shall state the date and time
of the burning and, if required by the terms of the permit,
shall also describe suggested traffic routes and any other
informatioQ necessary to mitigate any inconvenience to the
'public. Any Demolition Burning shall be conducted strictly in
conformance with the permit issued therefor. The fire chief
may order that any Demolition Burning be postponed or
cancelled if deemed necessary due to weather conditions or
other 'factors.
(2) [No change]
1.2 Article 7-4 of the Town Code, entitled "Prohibiting the
Burning of Structures and Regulating Certain Outdoor Fires", is
hereby deleted and repealed in its entirety.
PART 2: PENALTY CLAUSES. The following section of the Town, Code
contains penalty clauses applicable to violati9ns of this
Ordinance, and such section is herewith set forth in full and
hereby enacted:

TO THE TOWN OF FRASER:

known as ~ Eisenhower in Fraser, We will address each
item in the fire cove-section 4-2-1,
Co-Owners obligation (Church of The Eternal Hills)
1. All utilities have been disconnected from the house
except sewer. The Fire Dept, has said there:~ould
not be any problems with this until after the house
is burned and the ground thaws, Mountain Parks
Electric will disconnect power to the church during
ii, the burn day and then re-connect power, Snow and ice
will be bearmed UP around property to retain water,
2, The Church shall obtain insurance from Daly Insurance
in Winter Park to indemnify the Town of Fraser, The
Fire District does not require insurance from the
C~urch,
3, The Church will provide a Cash in Lou Bond to insure
site clean up, The Church will hire Morrow and Son's
to pick up debris and load in two 30yd end dump trucks
and haul to the county dump, three to four days after
the burn, to make sure all hot embers are out.
4, We will need to close the Eisenhower street from 9 AM
to 9 PM on Saturday April 8, 1995, at the intersection
of Norgren and Eisenhower to i block East of Norgren on
E i senhowe r , This half block lies in front of the
bUilding to be burned, We will also need to close the
alley right behind the property. The County Sheriffs
Dept, has agreed to furnish two Deputies for crowd and
traffic control, The Church will pay the Sheriffs
DePt, for these services from 9 AM to 9 PM on Saturday
April 8, 1995.
5. The Church will respond to request by the Town Board
in regard to the safety of the Community.

(d) Application for Permit:
1. A current proof of ownership shall be furnished to the
town with the legal representative of the Church signing
this permit.
2. The drawing has been submitted, showing structures within
the 200' diameter from all corners of the bUilding to be
burned. There are 14 property owners that have to be
notified.
3. The burn plan is attached.

Re: Burning building in Fraser next to the Church
It is the intention of the East Grand Fire Protection District to utilize the building
for training and then reduce the mass of the building as much as possible. Our
training will include ventilation, search and rescue practice, confined space rescue,
live burns and other fire department functions. These functions will be
performed on the days proceeding the a.ctual burning of the building.
We have planned the final burning of the building for the weekend of April 8th
and 9th during the day time. The other training functions will take place on the
evenings proceeding the weekend burn on April 5th through the 7th.
The volunteers of the East Grand Fire Protection District wish to thank Jim
Coleman, the church board, Clay Brown, the Fraser Town Council and the Town of
Fraser for making this training possible. It will be invaluable to us in the future.

RESOLUTION NO. 1,- I ,~S"
A RESOLUTION ADOPTING PROVISIONS INTENDED TO MAKE FEDERAL FLOOD
INSURANCE AVAILABLE WITHIN THE TOWN OF FRASER.
WHEREAS, certain areas of the Town of Fraser are subject to
periodic flooding, mudslides (i.e. , mudflows), or flood-related
erosion, causing serious damages to properties within these
areas; and
WHEREAS, relief is available in the form of Federally
subsidized flood insurance as authorized by the National Flood
Insurance Act of 1968; and
WHEREAS, it is the intent of the Board of Trustees of the
Town of Fraser to require the recognition and evaluation of
flood, mudslide (i.e. , mudflow) , or flood-related erosion hazards
in all official actions relating to land use in areas having
these hazards; and
WHEREAS, this body has the legal authority to adopt land use
and control measures to reduce future flood losses pursuant to
Colorado Revised Statutes, Title 31, Article 23, Parts 2 and 3.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF
THE TOWN OF FRASER, THAT THIS BOARD HEREBY:
l. Assures the Federal Emergency Management Agency that it will
enact, as necessary, an9 maintain in force in those areas
having flood, mudslide (i.e. , mudflow) , or flood-related
erosion hazards, adequate land use and control measures with
effective enforcement provisions consistent with the
criteria set forth in Section 60.3 of the National Flood
Insurance Program Regulations; and
2 . Vests the Fraser Town Manager with the responsibility,
authority, and means to:
(a) Assist the Administrator, at his request, in his
delineation of the limits of the area having special
flood, mudslide (i.e. , mudflow) , or flood-related
erosion hazards.
(b) Provide such information as the Administrator may
request concerning present uses and occupancy of the
floodplain, mudslide (i.e. , mud flow) or
flOOd-related
erosion areas.

(c) Cooperate with Federal, state, and local agencies and
private firms which undertake to study, survey, map,
and identify floodplain, mudslide (i.e.,
mudflow) , or
flood-related erosion areas, and cooperate with
neighboring communities with respect to management of
adjoining floodplain, mudslide (i.e.,
mudflow) and/or
flood-related erosion areas in order to prevent
aggravation of existing hazards.
(d) Submit on the anniversary date of the community's
initial eligibility an annual report to the
Administrator on the progress made during the past year
within the community in the development and
implementation of floodplain management measures.
(e) Upon occurrence, notify the Administrator in writing
whenever the boundaries of the community have been
modified by annexation or the community has otherwise
assumed or no longer has authority to adopt and enforce
floodplain management regulations for a particular
area. In order that all Flood Hazard Boundary Maps and
Flood Insurance Rate Maps accurately represent the
community's boundaries, include within such
notification a copy of a map of the community suitable
for reproduction, clearly delineating the new corporate
limits or new area for which the community has assumed
or relinquished floodplain management regulatory
authority.
3 . Appoints the Fraser Town Manager to maintain for public
inspection and to furnish upon request, for the
determination of applicable flood insurance risk premium
rates within all areas having special flood hazards
identified on a Flood Hazard Boundary Map or Flood Insurance
Rate Map, any certificates of floodproofing and information
on the elevation (in relation to mean sea level) of the
level of the lowast floor (including basement) of all new or
substantially improved structures, and whether or not such
structures contain a basement, and if the structure has been
floodproofed, the elevation (in relation to mean sea level)
to which the structure was floodproofed.
4 . Agrees to take such other official action as may be
reasonably necessary to carry out the objectives of the
program.

The Town of Fraser is hosting a meeting on April 12th at 7:00 p.m. at the Town Hall to discuss
the development of a comprehensive approach to housing in the upper Fraser Valley.
One of the Town Board's Goals is to develop an organization that can ad9ress this issue without
respect to political boundaries. Another facet of this goal is to create similar policies and
regulations in both towns and the county to address housing needs in new developments.
We have invited Pat Coyle and Kerry Dwyer from the Colorado Division of Housing to share
\\lith us diflcrent organizations that can be created to address the needs in our valley. Part of the
presentation will include the pros and cons of each type of organization.
What we hope will evolve from this meeting is a consensus that we need an organization to deal
with housing issues and hopefully a selection of the type of organization.
Your attendance at this meeting is critical to the successful implementation of a much needed
comprehensive approach to housing issues.

With the oflice stan' expansion, it has become necessary to enhance or replace our
existing phone system and add two additional phone lines.
With this in mind, we checked into a couple of options.
Option 1
Purchase 4 new phones from AT&T with a 3 line capacity (instead of the 2 we presently
have)
US West - Handle wiring for the new onice in the museum room for the planner _
Estimated cost 01'$285.00.
Cost of phones: $200.00 each
x 4
$800.00
This option is somewhat limiting in that it does not allow liS to expand to a 4th line
should we need to in the future. We would have to purchase new phones again to add a
4th line.

Purchase a Telephone System - we talked to Designed Communications, Inc. and 'were
given the following price quotes by Michael Mark.

Phone trade-in - 225.00 (Credit for our 3 existing phones)

This system is expandable to 8 lines by putting in an expansion card in the control box
that would cost $210.00, and the phones are already set for as many as 8 lines ifneeded.

which is required by US West would be an additional cost to US West.

In a conespondence from the Town of Fraser, dated December 20, 1994, you were notified about
the issue of enclosing your trash dumpster. Recently, we have observed that neither of the two

In an unrelated matter, we need to address your letter board sign. We have noticed that the filler
blank in the last slot of this letter board has been removed on the south side of the sign. You need
to ensure that this filler blank is re-inserted onto the south side of the sign so that the last slot can
not be utilized. Without this filler blank, as it exists now, the useable space on the sign exceeds
the allowed square footage and is therefore in violation of the Fraser Sign Code.
'Ale need your prompt attention in dealing with these violations. Please complete the necessary
improvements within thirty (30) days of receipt of this letter in order to alleviate fmther action.
