Our inspection and research of the property leads us to conclude that the property was originally constructed as a single family and has been recognized as such, since; and, the basement unit has been determined to be an unpermitted second unit. Please see the summary of violations and permit history below: Violations, applicable Code Sections, and Compliance Deadlines: 1. Conversion of a single family dwelling into a two family dwelling without permit, in the "S-6" Single Family Residence Zoning District. FACTS: • The property is located in the "S-6" Zoning District, which strictly prohibits two family residences; e A building permit was issued in 1970 to construct a single family residence. No permits have been issued for the second unit; ® A building permit was issued in 1991, to "install a window and a door in basement family room." The application, signed by the owner, indicates the property was a single family residence and would remain as such; • No occupancy permits to convert the single family dwelling to a two family dwelling have been found in the public record (building division); • The bedroom window was found to not meet minimum code requirements for an egress window (minimum opening size and sill height); • The department of public works indicates that only one (1) water -meter is located at this address and recognize the property as only one (1) single family residence; • The department of public works has indicated that only one (1) set of garbage bins have been provided to this address, as it is only recognized as one (1) single family residence; ® The town assessor's office records show the property was assessed as a single family in 1971 (construction of the dwelling) through 1991, when the assessment changed to a two family. COMPLIANCE ORDER/DEADLINE(S): 1. It is hereby ordered that the property be brought into compliance and revert to a single family residence; 2. Submit for all necessary permits to remove the stove/oven no later than Friday, January 25, 2019 and have the property reinspected to ensure compliance no later than Friday, February 8, 2019; 3. Submit all necessary permits to remove the kitchen sink completely, or replace with a wet bar sink (max 15"x15"), or a shop sink, no later than Friday, January 25, 2019 and have the property reinspected to ensure compliance no later than Friday, February 8, 2019.
