McCarty Street Large Conference Room ATTENDEES. Committee members present: Jim Branch, Laura Ward, Mark Schreiber, & Ken Hussey (at 8:02 a.m.) Staff present: Steve Crowell, Drew Hilpert, Gail Strope, Bill Lockwood, & Brenda Wunderlich Others present: Mayor Carrie Tergin (at 8:15 a.m.), Madeleine Leroux, Meeting came to order at 8:00 a.m. Councilman Schreiber made a motion to approve the minutes which was seconded by Councilperson Ward. The motion passed 3-0. Councilman Hussey entered the meeting immediately following the vote. Compensation and Classification Plan. Presented by City Administrator Steve Crowell. Mr. Crowell explained his desire to perform a Compensation and Classification plan as to City employees. Mr. Crowell explained the advantages, disadvantages, and costs. After discussion and questions by the Council, Councilman Hussey made a motion to move this onto to the Council, which was seconded by Councilman Schrieber. The motion passed 4-0. Definition of “Convicted” for business licenses. Presented by City Counselor Drew Hilpert. Mr. Hilpert advised that section 17-29, pertaining to business licenses, allows the Director of Finance to revoke a business license upon a finding that the licensee has been “convicted” for violating a provision of the Code but the Code did not define “convicted” leaving open the question about whether the word would exempt persons who had entered a plea of guilty or a plea of nolo contendere (no contest) to a crime applicable to Section 17- 29. Staff determined a definition should be provided and mirrored state law on the matter. After discussion and questions by the Council, Councilman Hussey made a motion to move this bill onto the Council for further consideration, which was seconded by Councilperson Ward. The motion passed 4-0. Reclassification of Law Dept. position. Presented by City Counselor Drew Hilpert. Mr. Hilpert requested that the Administrative Assistant found in the Law/Court/Court Clerk budget be switched to Municipal Court and retitled “Deputy Court Clerk” and remain a 12 grade. Also, the current 10 grade deputy court clerk be moved the Law/Court/Clerk budget and renamed “Administrative Technician” and remain a 10 grade. Mr. Hilpert stated these changes would more accurately reflect the work performed by the position. There would be no change in salary. After discussion Councilman Schreiber made a motion to move the bill onto the Council which was seconded by Councilman Hussey. The motion passed 4-0. The committee expressed that they would be okay with suspending the rules at the next Council meeting to allow the position to be posted. Appointments Review Presented by Human Resources Director Gail Strope. The committee reviewed the recommendations by Mayor Tergin. After Discussion Councilman Schreiber made a motion to move the bill onto the Council which was seconded by Councilperson Ward. The motion passed 4-0. City Administrator Crowell advised staff was looking into to the issue. City Counselor Hilpert mentioned the Arts Committee would be coming to the Public Works Committee to ask the City to take over the maintenance of the Fountain of Hope. There being no further business, the meeting adjourned at 8:26 p.m. 1 LEASE AGREEMENT FOR STOLLWAY AND FOUNTAIN AT ______- E. HIGH. BETWEEN CITY OF JEFFERSON AND JEFFERSON CITY CULTURAL ARTS FOUNDATION, INC. THIS AGREEMENT made and entered into this _____ day of ____________, 2015 by and between the City of Jefferson City, Missouri, a municipal corporation, hereinafter designated as "City" and Jefferson City Cultural Arts Foundation, Inc. hereinafter designated as “the Foundation”. NOW, THEREFORE, for and in consideration of premises and mutual undertakings, agreements and covenants hereinafter set forth, the parties hereto agree as follows: 1. Lease. For and in consideration of the terms, conditions and covenants of this Lease to be performed by the Foundation, all of which the Foundation accepts, City hereby leases to the Foundation and the Foundation hereby leases from City certain property, together with improvements thereon, if any, and certain attendant privileges, uses and rights, as hereinafter specifically set out. 2. Premises. The Premises hereby leased is that certain tract of real estate described as follows: [insert description] 3. Use Of Premises. A. City hereby grants the Foundation the right to use said demised premises for the purpose of constructing and operation of the Fountain of Hope, to be constructed, generally, as described on Exhibit A, hereafter called “improvements”. B. The Foundation shall not use or permit the use of any part of the leased premises in any other manner than set forth below, without the prior written consent of City. 4. Observance of ordinances and building codes. The granting of this lease and the right of the Foundation to use said public property is conditioned upon the Foundation observing and complying with any and all ordinances and building code requirements for the improvement. The Foundation will be responsible for all construction and applying for all permits necessary and needed permits for such construction however the City shall waive any fees associated with the issuance of any and all such permits. 5. Obligations of the Foundation. 2 a. No Cost to the City. The use and occupancy of the leased premises and all improvements by the Foundation will be without cost or expense to the City or any city department. It shall be the sole responsibility of the Foundation to keep, maintain, repair and operate the entirety of the demised premises and all improvements thereon at the Foundation's sole cost and expense. b. Maintenance. The Foundation shall maintain the leased premises and all improvements at all times in a safe, neat and slightly condition and shall not permit the accumulation of any trash, snow, or debris on the premises. c. Modifications to improvements. The Foundation shall not construct, install, or remove, modify and/or repair any of the premises leased hereunder or improvements created thereon, without prior written approval of the Director of the Department of Public Works, such approval not to be unreasonably withheld, but shall be contingent upon approval by City of plans and specifications for the proposed project as well as other operating conditions considered by City to be necessary. d. Indemnification. The Foundation shall hold the City of Jefferson harmless and reimburse it for any and all expenses of any nature whatsoever arising out of any claim for said improvements, changes or repair. Cancellation of the lease shall not be deemed a waiver of the Foundation's other remedies at law. e. Utilities. The Foundation shall assume and pay for all costs or charges for utility services furnished to the Foundation during the term hereof. 6. Term Of Leasehold/Termination. The term of this lease shall be from __________ through ________. Thereafter the lease shall renew for additional one year periods on the anniversary of the lease until canceled. The renewals shall vest and the lease shall renew without action by either party unless either party gives 30 days written notice before the last day of the lease term. 7. Rent. a. City shall not charge the Foundation any rent for use of the demised property so long as the Foundation abides by all covenants of this lease. b. In lieu of any payment for rent the Foundation shall include in any and all promotional or advertising materials that the City is a “sponsor” or “contributor” to this project. 8. Insurance By the Foundation. During all terms of this lease, the Foundation shall obtain at its own expense and deliver to the City an Owner's Protective Liability Insurance Policy naming the City of Jefferson as the insured, in an amount not less than $1,000,000 for all claims arising out of a single accident or occurrence and $300,000 for any one person in a single accident or occurrence, except for those claims governed by the provisions of the Missouri. 3 9. Restoration Of Casualty Losses. In the event of fire or other loss to the improvements, the Foundation shall within ninety (90) days thereafter promptly restore the improvements to their condition prior to such loss. Notwithstanding the foregoing, if the Foundation determines it does not wish to repair the improvements the Foundation shall have the option to remove the damaged improvement and the debris resulting therefrom and restore the surface condition of said demised premises to its original condition, or similar condition as approved by the Director of the Department of Public Works, at which date this lease shall be deemed canceled. 10. Cancellation By City. In addition to other provisions of this lease, the City may terminate the lease in the event the Foundation shall: i. Abandon the demised premises or improvements as evidenced by failure to maintain the premises. ii. Discontinue its use as defined in section 3 of this agreement. iii. If the Foundation shall default in any of the other covenants herein contained and shall continue in such default for a period of thirty (30) days after notice thereof in writing from the City. 11. Assignment And Subletting. The Foundation shall not sublease, or assign this lease without first obtaining the written approval of the City through the Director of the Department of Public Works. 12. Non-Interference with Public Use. The Foundation by accepting this Lease expressly agrees for itself, its successors and assigns that it will not make use of the leased premises in any manner which might interfere with use by the public of any part of City property which is not specifically leased to them or otherwise constitute a hazard. In the event the aforesaid covenant is breached, City reserves the right to enter upon the premises hereby leased and cause the abatement of such interference at the expense of the Foundation. 13. Relocation Of Improvements. In the event City requires the demised premises for expansion or development the City reserves the right, on six (6) months' notice, to relocate or replace the Foundation's improvements in substantially similar form at another location in the downtown area. In said event, the Foundation shall have the right to terminate this Lease. 14. Notices, Consents And Approvals Whenever any notice is required by this Lease to be made, given or transmitted to the parties hereto, such notice or payment shall be deemed to have been given if enclosed in an envelope with sufficient postage attached to insure deliver, and deposited in the United States mail, addressed to: If to the City: If to the Foundation: 4 Department of Public Works Jefferson City Cultural Arts Foundation 320 East McCarty Street Jefferson City, MO 65101 Jefferson City, Missouri 65102 or such other place as either party shall in writing designate in the manner herein provided. 15. AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ENABLING THE CITY OF JEFFERSON, MISSOURI TO JOIN PACE BOARD DISTRICTS AUTHORIZED BY MISSOURI LAW INCLUDING SHOW ME PACE, PURSUANT TO SECTIONS §67.2800 TO §67.2835, RSMO, THE "PROPERTY ASSESSED CLEAN ENERGY ACT," AND STATING THE TERMS UNDER WHICH THE CITY WILL CONDUCT ACTIVITIES AS A MEMBER OF SUCH DISTRICT. WHEREAS, the 95th General Assembly of the State of Missouri has adopted the Property Assessment Clean Energy Act, Sections 67.2800 to 67.2835, Revised Statutes of Missouri (the "PACE Act"); and WHEREAS, it is in the best interests of the health, safety, and welfare of the City of Jefferson, Missouri and its residents to encourage the development, production, and efficient use of clean energy and renewable energy, as well as the installation of energy efficiency improvements to publicly and privately owned real property; and WHEREAS, the primary intent of funding energy efficiency and renewable energy improvements pursuant to the PACE Act is to promote the public purposes described above; and WHEREAS, Section §67.2810.1, RSMo authorizes one or more Municipalities (as defined in Section §67.2800.7, RSMo) to establish a Clean Energy Development Board to initiate and administer a Property Assessed Clean Energy ("PACE") Program so that owners of qualifying property can access funding for energy efficiency improvements or renewable energy improvements to the properties located in such Municipalities; and WHEREAS, the City of Jefferson served as the first City to create a PACE board in Missouri, now known as the Missouri Clean Energy District and continues to participate in the same; and WHEREAS, on June 15, 2015, a clean energy development board named “Show Me PACE” was created with the intention that all Municipalities within the State of Missouri would be eligible to join and participate by approving an appropriate ordinance or resolution; and WHEREAS, it is likely that additional PACE boards will be created which will benefit the citizens of the City; and WHEREAS, it is in the best interests of Jefferson City, Missouri and its residents to join and participate in Show Me PACE and any future qualifying PACE board. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF JEFFERSON CITY, MISSOURI, AS FOLLOWS: A. Title and Definitions. 1. Title. This Ordinance shall be known and may be cited as "Jefferson City, Missouri Property Assessed Clean Energy Ordinance, PART II." 2. Definitions. Except as specifically defined below, words and phrases used in this Ordinance shall have their customary meanings. Words and phrases defined in Section 67.2800.2 of the Missouri Revised Statutes, as amended, shall have their defined meanings when used in this Ordinance. As used in this Ordinance, the following words and phrases shall have the meanings indicated. a. "Show Me PACE" means the Show Me PACE District, b. “District” shall mean the Missouri Clean Energy District, Show me PACE, or any other PACE district created hereinafter which qualifies under Missouri Law. c. "PACE Assessment" means a special assessment made against qualifying property in consideration of PACE Funding. d. "PACE Funding" means funds provided to the owner(s) of Qualifying Property by the District for an energy efficiency or renewable energy improvement. e. "Qualifying Property" means real property located in Jefferson City, Missouri that satisfies the criteria set forth in the PACE Act. B. Program Administration. Each District shall administer the functions of its PACE program within the City by, for any application made to it by qualifying property owners, as follows: 1. providing property owners with an application to apply for PACE Funding; 2. developing standards for the approval of projects submitted by Qualifying Property owners; 3. reviewing applications and selecting qualified projects; 4. entering into Assessment Contracts with Qualifying Property owners; 5. providing a copy of each executed Notice of Assessment to the County Assessor and causing a copy of each such Notice of Assessment to be recorded in the real estate records of the Recorder of Deeds for the County; 6. authorizing and disbursing PACE Funding to the Qualifying Property owners; receiving the PACE Assessment from the County Collector; 7. recording any lien, if needed, due to nonpayment of a PACE Assessment; 8. and exercising all powers granted by Section 67.2810.2 of the Missouri Revised Statutes, as amended, including, but not limited to, the power to levy and collect the PACE Assessment pursuant to an Assessment Contract with a Qualifying Property owner. C. Liability of City Officials; Liability of City. Notwithstanding any other provision of law to the contrary, officers and other officials of the City of Jefferson, Missouri shall not be personally liable to any person for claims of whatever kind or nature, under or related to the City's participation in the PACE program, including, without limitation, claims for or related to uncollected PACE Assessments. Jefferson City, Missouri has no liability to a property owner for or related to energy savings improvements funded under a PACE Program. The District shall for all purposes be considered an independent entity and shall not be considered a political subdivision of the City of Jefferson, Missouri. D. Existing Laws Not Superseded. Any project or improvement at any Qualifying Property which is funded in whole or in part of PACE Funding shall be subject to all ordinances, rules and regulations in effect at that time. E. City as a Non-Party. The City of Jefferson, Missouri shall not be a party to any PACE Funding agreement, loan, or other commitment, however denominated, executed between the District and the owner(s) (or their representatives, together with any successors and assigns) of any Qualifying Property. SECTION 2: Jefferson City, Missouri declares its intent that the provisions of this Ordinance shall be in conformity with federal and state laws. The City enacts this Ordinance pursuant to Sections 67.2800 to 67.2835 of the Missouri Revised Statutes, as amended. SECTION 3: The City of Jefferson, Missouri does hereby request that it be approved by the Board of Directors of Show Me PACE as a duly authorized participant in the District. SECTION 4: The election of the City of Jefferson, Missouri to join Show Me PACE shall in no way constitute an obligation of the City necessitating any corresponding appropriation. SECTION 5: The City of Jefferson, Missouri does hereby authorize the City Administrator to request that the City of Jefferson be approved by future Districts which qualify under Missouri law that it be as a duly authorized participant in that District. SECTION 5: The City Clerk is hereby authorized to deliver a duly executed copy of this Ordinance to the Board of Directors of any qualifying District or its designee, together with the jurisdictional and geographic boundaries of the City for inclusion in the jurisdictional and geographic boundaries of the District. SECTION 6: This Ordinance shall be in full force and effect from and after its passage and approval. Section 7. This Ordinance shall be in full force and effect from and after the date of its passage and approval. Staff recommends forwarding the proposed ordinance onto the City Council for consideration. The Show Me PACE District is now available at Jefferson City. The attached ordinance will allow property owners (initially commercial) to participate in the Show Me PACE District as well as allow participation in future districts which may be formed to serve the City. Essentially, a PACE (loan provider) district is a financial tool which allows property owners (commercial in this particular case) to borrow money for renewable/clean energy and energy efficiency property improvements at little or no upfront costs. The improvement costs are repaid (to the PACE loan provider) as part of the property tax bill of the improved property. The "loan" remains with the property (for example if the property is sold). One advantage of the PACE financing is that an alternative is made available to property owners for financing renewable/clean energy and energy efficiency property improvements. The City incurs no liability or responsibility for the improvements, nor for the funding. One negative of PACE financing is that sometimes other lenders on the property (typically the mortgage lender) MAY have a concern with this type of financing because it is "attached" to the property. In such a circumstance, it would be up to the individual property owner to discuss such alternatives with their mortgage lender, but again the City is not involved in that process. BILL NO. 2015- SPONSORED BY COUNCILMAN __ ORDINANCE NO. AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE CITY CODE, CHAPTER 20, SECTION 10.1 BY SPECIFYING THE CHAPTERS OF THE CITY CODE FOR WHICH AN ADMINISTRATIVE SEARCH WARRANT MAY BE ISSUED. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The City Code, Chapter 20 (Municipal Judge, Court, Etc.), Section 10.1 (Administrative Search Warrants), is hereby amended as follows: Sec. 20-10.1. Administrative Search Warrants. When application is made pursuant to this article for a certificate of compliance with respect to any business, building, license, house, dwelling or unit, the municipal judge of the county circuit court shall have authority to issue search warrants for searches or inspections of such business, building, house, dwelling or unit to determine the existence of violations of chapters 3A(8), 8, 13, 15, 17, 21, 25, and 28 of this Code. Warrants and searches or inspections made pursuant thereto shall conform to and be governed by the following provisions: 1. The city counselor may make application for the issuance of a search warrant. 2. The application shall: a. Be in writing; b. State the time and date of the making of the application; c. Identify the property or places to be searched in sufficient detail and particularity that the officer executing the warrant can readily ascertain it; d. State facts sufficient to show probable cause for the issuance of a search warrant to search for violations of chapters 3A(8), 8, 13, 15, 17, 21, 25, and 28 of this Code; e. Be verified by the oath or affirmation of the applicant; and f. Be filed in the municipal division of the county circuit court. 3. The application shall be supplemented by written affidavits verified by oath or affirmation. Such affidavits shall be considered in determining whether there is probable cause for the issuance of a search warrant and in filling out any deficiencies in the description of the property or places to be searched. Oral testimony shall not be considered. 4. The judge shall hold a non-adversary hearing to determine whether sufficient facts have been stated to justify the issuance of a search warrant. If it appears from the application and any supporting affidavits that there is probable cause to inspect or search for violations of chapters 3A(8), 8, 13, 15, 17, 21, 25, and 28 of this Code, a search warrant shall immediately be issued to search for such violations. The warrant shall be issued in the form of an original and two (2) copies. 5. The application and any supporting affidavits and a copy of the warrant shall be retained in the records of the municipal judge. 6. Search warrants issued under this section shall: 2 a. Be in writing and in the name of the issuing authority; b. Be directed to any police officer or deputy in the city; c. State the time and date the warrant is issued; d. Identify the property or places to be searched in sufficient detail and particularity that the officer executing the warrant can readily ascertain it; e. Be limited to a search or inspection for violations of chapters 3A(8), 8, 13, 15, 17, 21, 25, and 28 of this Code; f. Command that the described property or places be searched and that any photographs of violations found thereof or therein be brought, within ten (10) days after filing of the application, to the judge who issued the warrant, to be dealt with according to law; and g. Be signed by the municipal judge, with his title of office indicated. 7. A search warrant issued under this section may be executed only by a police officer or deputy of the city. The warrant shall be executed by conducting the search commanded. 8. A search warrant shall be executed as soon as practicable and shall expire if it is not executed and the return made within ten (10) days after the date of the making of the application. 9. After execution of the search warrant, the warrant with a return thereon, signed by the officer making the search, shall be delivered to the judge who issued the warrant. The return shall show the date and manner of execution and the name of the possessor and of the owner of the property or places searched, when he is not the same person, if known. 10. A search warrant shall be deemed invalid: a. If it was not issued by a judge of the municipal division of the Cole County, Missouri, Circuit Court; b. If it was issued without a written application having been filed and verified; c. If it was issued without probable cause; d. If it was not issued with respect to property or places within the city; e. If it does not describe the property or places to be searched with sufficient certainty; f. If it is not signed by the judge who issued it; or g. If it was not executed within the time prescribed by subsection (8) of this section. 11. Failure to comply with a search warrant issued under this section shall be a code violation and upon conviction in municipal court, the court shall fine violators of this section not less than two hundred fifty dollars ($250.00) Section 2. This Ordinance shall be in full force and effect from and after the date of its passage and approval. Origin of Request: Law Department Department Responsible: Law Department Person Responsible: Drew Hilpert Background Information: Section 20-10.1 of the City Code allows for the issuance of an administrative search warrant to search or inspect businesses, buildings, houses, or dwelling units in the City. In order for a warrant to be issued, the City Counselor must submit an application to the Municipal Judge that states facts that show probable cause exists to inspect the property for violations of 3A(8) (Adult Business regulations), 13 (Fire Code), 15 (Health and Sanitation), 17 (Licenses), 25 (Planning and Development), and 28 (Restaurants and Food). As written, administrative search warrants issued by the Municipal Judge may not include violations of Chapter 8 (the building code, including the electrical and plumbing regulations) and Chapter 21 (the nuisance regulations, including the property maintenance code). By adding Chapters 8 and 21 to the administrative search warrant criteria, the City furthers its interest in protecting the health, safety, and welfare of residents. Fiscal Information: None BILL NO. Chapter 21 (Nuisances) Section 1 (Definitions) is amended as follows: Sec. 21-1. Definitions.
