APPROVAL OF AN AGREEMENT BETWEEN THE AGENCY AND ACCESS COMMUNITY HOUSING, INC., AUTHORIZING THE COMMITMENT AND ALLOCATION OF FY 2002 HOME PROGRAM CHDO FUNDS. Comments: To approve an agreement between the Lynwood Redevelopment Agency and Access Community Housing, Inc,, a qualified Community Housing Development Organization (CHDO), to commit the Fiscal Year 2002 HOME Program allocation of f funds in the amount of $104,250 for affordable housing purposes. Recommendation: It is respectfully recommended that the Agency approve the HOME Fund Reservation and Commitment Housing, Inc., to commit the FY 2002 HOME Program CHDO funds in the amount of $104,250 to be used for affordable housing purposes pursuant to the HUD/HOME Regulations 24 CFR Part 92.2. Earnest, Assistant Execubve Director x(. ~ F Y 2003-2004 Year End Review PURPOSE: The purpose of this item is to have the Agency Chakman and Board Members adopt attached resolution amending the Agency's biennial 2003/05 Operating Budget to reflect budget amendment requests. BACKGROUND: On July 1, 2003, the Agency Board adopted the biennial operating budget for 2003105. The biennial budget reflected a broad range of concerns relative to commercial revitalization and housing development. The FY 2003/04 budget included the following: · Funding for the Long Beach/Pluma Project · Commercial Rehab Grants · Funding for Lynwood Springs Project · Real Estate purchases · Sale of Property During the May 10, 2004 year-end review workshop, staff presented spreadsheets ~dentlfying budget amendment requests relative to reductions in personnel costs, reduced interest earnings, and additional appropriation for preparing a Redevelopment Plan Amendment. In addition, staff also informed the Agency that due to the State's Budget cdsis, more than $180,000 in tax increment funds will be taken away by the State. ANALYSIS: In accordance with Redevelopment Accounting practices, the Lynwood Redevelopment Agency's Operating Budget is categorized into three (3) fund types to account for the various operations in each project area. Lou,s Morales, Executive DeTuty D~9~ ALLOCATION OF FY 200Z HOME PROGRAM CHDO FUNDS Purpose: To approve an agreement between the Lynwood Redevelopment Agency and Access Coramtmity Housing, lnc., a qualified Community Housing Development Organization (CHDO), to commit the Fi.seal Year 2002 HOME Program allocation of funds in the amount of $104,250 for affordable housing purposes. Facts: I. The City of Lynwood receives an annual allocation of HOME Investment Partnerships Act (HOME) funds from the Dgpartment of Housing and Urban Development to develop affordable housing programs in accordance with the federal regulations. 2 The federal regulations t'equtres that 15% of thc annual HOME fund allocatton must be reserved and committed to a CHDO to develop affordable housing within two year period. A CHDO must be a non-profit orgamzatlon possessing a 501(0 3 c}ar-4fication. 3. The Agency is a duly orgamzed community redevelopment agency under California Redevelopment Law and quahfies as a subreeipient to administer and commit the HOME Funds in accordance with the Federal regulations and ts able to entec into a commitmeat agreement. 4. Access Community Housing is readily available to enter into a commitment agreement with the Agency and has eompl~ed two previous proj~:ts as a elide at First and Joaeplune and at First and Femwood Avenue (sec attached map). 5. The City has three qualified HUD CHDO's including Curry Temple, Habitat for Humanity and Access Community ltousing. 6 The C~ty is currently in the process of qualifying addmonal CHDO's, i.e. Old Timer Foundation and So Cai Housing. 7. The City has met the HUD funding requirements for total expenditures and reservation of funds and the CHDO commitment is the final requirement (sec the attached HUD Status Report). 8. Attached Is a dralt agreement for the Agency's review and approval. Anal_yam. The federal regulations reqmres that 15 percent of the annual HOME Program allocation must be conmfitted to a qualified CHDO to develop affordable housing within a 24 month period. AGF2IDA I TL2,1 The HOME Program allocation for FY 2002 was $695.000. Of this total. $104,250 must be committed betbre the July 3 I, 2003 deadhn~. I'o comply with this regulation, a legally binding agreement must be executed and include the following: The name of the quahfied non-profit CHDO, · The amount of funds committed; · The specific type of affordable housing project (i.e. new construction, acquisition): · The agreement must specify that the project must begin within a 12-month period. This agreement will commit the 2002 HOME Program Funds with a qualified CHDO for aftbrdable housing projects in accordance wtth the HOME Program regulations. This agreement has been approved by HUD and serves as an administrative tool to meet the program regulations. A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF LYNWOOD APPROVING A HOME FUND RESERVATION AND COMMITMENT AGREEMENT BETWEEN THE LYNWOOD REDEVELOPMENT AGENCY AND ACCESS COMMUNITY HOUSING INC., PURSUANT TO TITLE 24 CFR, PART 92.2 TO CARRY OUT CERTAIN HOUSING ACTMTIES RELATED TO THE HOUSING AND URBAN DEVELOPMENT REGULATIONS AND TO COMMIT THE CITY OF LYNWOOD 2002 HOME INVESTMENT PARTNERSHIP ALLOCATION IN THE AMOUNT OF $104,250 WHEREAS, The City of Lynwood Redevelopment Agency administers a new Housing Rehabilitation Program pursuant HUD/HOME guidehnes at title 24 CFR, Part 92; and WHEREAS, the City of Lynwood is required to reserve and commit 15% of the annual allocation to a qualified Community Housing Development Organization (CHDO) within a 24 month pe~od, m accordance with HUD guidelines, and WHEREAS, The Agency proposes to enter rotc a HOME Fund Reservation and Conumtment Agreement with Access Community Housing Inc., a qualified CHDO, to assist the Agency m carrying out the HOME requirements of providing affordable housing opportunities to Iow and very low income residents, and WHEREAS, The Agency proposes to commit 2002 HOME Investment Partnership Act (HOME Program) funds to a qualified CHDO pursuant to the agreement and in compliance with the HUD/HOME regulations. RECITALS The City of Lyuwood receives federal funds from HUD pursuant to the Home Investment Partnerships Act Program and the implementing regulations thereto set forth ,n 24 CFR 92 I for the purposes of providing affordable housing for Iow income residents of Lynwood in accordance with the HOME Program regulations. The Lynwood Redevelopment Agency is a community redevelopment agency duly organized and existing under California Community Redevelopment Law and is experienced in the acquisition, construction, development and administration of housing programs which are affordable to pet'sons of very Iow, low, and moderate income. The Agency enters into this agreement to comply with the HOME Program regulations regarding the annual allocation of funds for affordable housing and to meet the commitment requirements of Section 92.2 of the HOME Program. The Agency administers a multi-year housing program by providing financial assistance to eligible low income households to improve the existing housing conditions in the commumty and increase the affordable housing opportunities. The C~ty's Consolidated Plan has identified housing programs to address the community and housing needs, including programs for rehabilitation, new construction, acquisition and specific projects related to the identified goals. The purpose of the this HOME Fund Reservation and Implementation Agreement is for the City to reserve and commit FY 2002 HOME Program funds in the amount of $104,250 to a qualified CHDO to develop affordable housing in the City of Lynwood. NOW, THEREFORE, the City and the Agency hereto agree as follows: I Reservation and Commit'men{ of HQME Program Fund~ The C,ty hereby commits to the Agency, as a subrecipient under the HOME Program, HOME Program funds heretofore received by thc City and not already expended, committed, or encumbered, as follows. (a) the 2002 F,scal Year allocation in the amount of $104,250 for the annual CHDO Reservation and Commitment requirement. (b) the funding shall be committed to Access Community Housing, Inc., a non-profit Community Housing Development Organization, for a specific affordable housing project. (el the parties anticipate the aftbrdable housing project will conmience within a twelve month period. 2. Project Description. The HOME Program ~unds will be utihzed and expended towards eligible affordable housing programs. The Agency and the CHDO are committed to estabhshing and miplemenhng a program for the acquisition of property and/or new construction and development of owner-occupied affordable housing units. All of the tbregoing affordable housing programs are directed towards increasing aflbrdable housing opportunities in the City and are here~n collectively referred to as the "Project". (a) The delivery of such reserved funds to or on behalf of the Project IS expressly conditioned by the City and Agency upon (i) establishment of Project gmdeline~ acceptable to the City and Agency, (ii) the selection of eligible borrowers and acceptable property(ies) m the City, and (iii) the execution by the ProJect applicants and borrower(s) of acceptable affordable housing agreement(s) and related documentation, which meet the requirements of the HOME Program. (b) The City contemplates the Agency shall commence utilization of the HOME Program funds fo~hwith for the Project, with activities to commence within the estabhshed program guidelines. (c) Upon mutual agreement between the parties, HOME Program funds may be applied toward other qualifying activities, including without limitation, acquisition of property and/or acquisition of existing housing units in connection with the development of additional owner-occupied affordable housing units through rehabilitation and/or new construction of affordable housing. 3. HOME Program Fund Commitment. The City intends the resea'vation of HOME Program funds which is madc pursuant to this HOME Fund Reservation and Implementation Agreement shall qualify as a "commitment" of funds pursuant to 24 CFR 92.2, as a legally binding written agreement reserving a specific amount of funds to the Project. 4 Annual Commits..ent and Disbur~ement. Thc Agency shall implement and expend the committed HOME Program funds committed by this Agreement in accordance with the Annual Commitment and Disbursement requirements established by HUD under the HOME Program guidelines. 5. Prelect lmplementnflpn Do~:um,enes and Scope, of Affordab]9 Housin~ Agreements. The Project documents and affordable housing agreement(s) shall contain such matters as (i) the total amount and sources of financial assistance to be made available (HOME Program funds and/or Housing Fund monies) toward each portion of the Project, (ii) whether the financial assistance will be in the form of a grant or a loan, (iii) eligible uses of thc financial assistance (such as for acquisition, new construction, eligible off-site improvements), (iv) secunty tbr repayment of the financial assistance provided by the Project (such as deed of trust, guarantee), (v} conditions precedent to disbursement of the financial assistance, (vi) scope of development and schedule for performance for the work, as applicable, or the close of escrow for purchase of real property, (vii) number, size, and term of affordability of affordable units, (viii) affordable housing cost verification and the rent or housing cost limitation formulas, as applicable, for affordable units, (ix) income limits for tenants or owners, as applicable, for atlbrdable units, (x) ongoing maintenance, occupancy, and operation requirements, (xi) recordable regulatory agreement, (xlO other related HOME Program and/or commumty redevelopment requirements, specifically including without limitation the requirements of 24 CFR 504. ,and CRL Section 333334.2, et seq., and (xiii) such other matters as the parties find neces~ry or appropriate for proper implementation of the Project. 0. Cooperation. The City and Agency reciprocally agree and covenant to each other to ncgotmte tn good faith and to cooperate ~n estabhshing the Project gmidelines and m~plementing documents, identiHing suitable properties and sites within the target areas in the Cay, and/or development, evaluating potential Project applicants and participants, and supplying related housing information and analysis which are pertinent to the Project and the subject matter of this Agreement. 7 Notices Any notices, requests or approvals given under this Implementation Agreement from one party to another may be personally delivered or deposited with the United States Postal Service for totaling, postage prepaid, to the address of the other party as stated in this paragraph, and shall be deemed to have been given at the time of pemonal delivery or three (3) days after the date of deposit for mailing. Notices shall be sent to: City and Agency: City of Lynwood 11330 Bulhs Road Lynwood, CA 90262 Attention: Lorry Hempe, City Manager CHDO. Access Community Homing, Inc. 8. Adm~uisB'ation of HOME Funds. Thc City hereby designates the Agency to administer and use the HOME Funds. The Agency agrees to administer and use the HOME Funds in accordance with the applicable laws and regulations. The Agency shall not disburse HOME Funds prior to entering into a written agreement with any HOME programs qualified or eligible contractor or project. 9. Amendment to Alzreeme~t. No modification, rescission, waiver, release or amendment of any provision of this lmplementataon Agreement shall be made except by a written agreement executed by both parties. 10. Entire Agreement. This Agreement constitutes the entire understanding and agreement of the parties. This Implementation Agreement integrates all of the temps and conditions mentioned hereto or incidental thereto, and supersedes all prior and negotiations or agreements, discussions and previous agreements between the City and the Agency concerning all or any part of the subject matter of this Implementation Agreement.
