HomeMy Public PortalAbout1976_04_14_R058 TO~ OF LEESBURG IN LOUDOUN COUNTY, VIRGINIA RESOLUTION No. 76-58 ADOPTED April 14~ 1976 ACCEPTING DEDICATION OF LAND FOR PUBLIC STREETS, SIDEWALKS, OR OTHER PUBLIC BYAYS FROM GEORGE J. AND ELIZABETH C. BABSON AND VACATING A CERTAIN UTILITY EASEMENT. B~EREAS, the George Jason Corporation by deed dated April 2, 1960, and recorded in the Clerk's office of the Circuit Court of Loudoun County, Virginia, in Deed Book 396, at page 466, granted and conveyed to the Town perpetual right-of-way, or easements 20 feet in width for the construction and maintenance of sani- tary sewer and/or water lines, including manholes, on the western half of land of the said George Jason Corporation; and WHEREAS, by deed made April 9, 1976, George J. and Elizabeth C. Babson dedicated to the Town a certain strip or parcel of land shovm on a plat prepared by DeLashmutt Associates, Certified Land Surveyors, in December, 1975, entitled "Area to be dedicated for public street purposes", on which land the sanitary sewer line and manhole is located. NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Leesburg, Virginia, as follows: SECTION I. That the dedication made by George J. and Elizabeth C. Babson to the Town for all of a certain strip or parcel of land shown on a plat prepared by DeLashmutt Associates, C.L.S., in December, 1975, en- titled "Area to be dedicated for public street purposes", is hereby accepted and the Mayor is authorized to acknowledge the same on behalf of the Town. A RESOLUTION: -2- SECTION II. That the Council hereby vacates and re- leases to George J. Babson all of its rights granted and conveyed to it for the construction and maintenance of sanitary sewer and/or water lines, including man- holes, by the George Jason Corporation insofar as the easement may affect the remainder of the land of George J. Babson after the said dedication, and the Mayor is hereby authorized and directed to execute a quit-claim deed on behalf of the Town releasing the said easement to George J. Babson to this extent.
