Definition of “Convicted” for business licenses.
Presented by City Counselor Drew Hilpert. Mr. Hilpert advised that section 17-29, pertaining to
business licenses, allows the Director of Finance to revoke a business license upon a finding that the
licensee has been “convicted” for violating a provision of the Code but the Code did not define
“convicted” leaving open the question about whether the word would exempt persons who had
entered a plea of guilty or a plea of nolo contendere (no contest) to a crime applicable to Section 17-
29. Staff determined a definition should be provided and mirrored state law on the matter. After
discussion and questions by the Council, Councilman Hussey made a motion to move this bill
onto the Council for further consideration, which was seconded by Councilperson Ward. The
motion passed 4-0.
