HomeMy Public PortalAboutResolution 65-425 A1 1 RESOLUTION NO, 65-425A A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY WHEREAS, there have been dedicated unto or the City of Temple City has otherwise acquired the storm drain improvements and drainage systems known as Private Drain No. 515 described in Exhibit A attached hereto; and WHEREAS, the City of Temple City is authorized and empowered to transfer and convey unto the Los Angeles County Flood Control Dis- trict any storm drain improvements and drainage systems for future operation, maintenance, repair and improvement; and WHEREAS, the Board of Supervisors of the Los Angeles County Flood Control District is authorized and empowered under Section 13 -3/4 of the Los Angeles County Flood Control Act, as amended by Chapter 829 of the California Statutes of 1957, to accept on behalf of said District a transfer and conveyance of storm drain improvements and drainage systems lying within the territorial boundaries of said District whenever the governing body of any public agency owning or having jurisdiction over such storm drain improvements and drainage systems by resolution requests said Flood Control District to accept such improvements and systems; and WHEREAS, the best public interest will be served by transfer and conveyance of the storm drain improvements and drainage systems described in Exhibit A attached hereto from the City of Temple City to the Los Angeles County Flood Control District for future operations, maintenance, repair and improvement. NOW THEREFORE, BE IT RESOLVED THAT the City of Temple City through the City Council does hereby transfer and convey to the Los Angeles County Flood Control District the storm drain improvements and drainage systems described in said Exhibit A subject to the acceptance thereof by resolution of the Board of Supervisors of the Los Angeles County Flood Control District. BE IT FURTHER RESOLVED THAT the City Manager of the City of Temple City is directed and ordered to prepare all necessary instru- ments and documents including deeds to effectuate said transfer and conveyance and to obtain the approval thereof of the Chief Engineer of said District and that the Mayor on behalf of the City of Temple City is authorized and instructed to execute said instruments and documents. Reference is hereby made to the plans and profiles of said storm drain improvements and drainage systems on file in the office of the City Engineer and on file in the office of the Chief Engineer of said District for futher data as to the exact location, extent and description of said storm drain improvements and drainage systems. PASSED AND ADOPTED THIS 11th day of January , 1965 AYES: Councilmen- Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen- None ' ABSENT: Councilmen -None Mayor ATTEST: 588 EXHIBIT "A" PRIVATE DRAIN MO, 515 EATON WASH - LA ROSA DRAIN A reinforced concrete pipe conduit, laterals and appurtenant structures beginning in the Los Angeles County Flood Control District channel for Eaton ':dash, thence westerly across Encinita Avenue to a six -foot wide easement along the southerly line of Lot #9, Tract No. 28317, Map Book 727, pages 38 and 39, Records of Los Angeles County and extending 10 feet into Lot #8, thence westerly in said easement to a termination of said drain.
