" , April 5, 1995 Dear Mayor and Town Board The Purpose of my visit is as follows: 1- Show you the next two sculptures. ~~\~ A) The Cowboy (and accompanying story) t/ B) The Rancher (you've seen the story) ,^,rI'~ , 2- Follow up on your request to have Michael Blimes come up and meet with Town Board to discuss potential corporate and foundation funding of: A)Sculptures B)Production of CD ROMS for accessibility of this educational exhibit to schools and libraries around the world. C)Production of a ten minute sound film to be used in conjunction with the information center. It will take pressure off the centers staff in peak tourist seasons, as people get stacked up wanting information on the exhibit as well as where to eat, stay, hike, etc. Such a film would enrich their visit. D)Automatic overhead or .floor mounted machine/screen to show video tape, sculpting process, research, and other pertinent information. E)Audio tape and earphones for blind and sighted persons who wish to independently tour the outside sculptures or the master bronzes in the welcome center. F)Funding of a traveling educational exhibit for a tour of the nation and possibly foreign capitals. (note: this collection would be gifted to the Smithsonian, Gilcrease, Cowboy Hall of Fame, or other appropriate institution following the tour.) In order to accomplish the above, the park must hp- nprre9n ~ nnu I2rofit 501 c3 corporation, which would be owned and managed by the Town of Fraser. It's a technicality, but a critical one if you wish to accomplish the above goals with private or foundation funding. Please instruct the Town attorney to report back quickly the mechanics of such an incorporation of the Walk Through History Park. Also, please have the town attorney answer the following concern. In the Town's contract with me concerning the park, the town accepted all legal liability involving the sculptures after placement in the park. If a child or adult were to climb up and falloff a sculpture, their attorney might also sue me as having contributed to the creation of an attractive hazard or some such thing. I'm not worried about someone winning such a suit, but the cost of defending myself could be devastating. Circumstances_may require my attorney not be the Town's attorney. Would the town's insurance pay for a separate attornev? This does make me nervous, particularly with the park's adjacency to the new . . " lO~Sing project. The park isn't a piayground, but you can appreciate my concern. Also, it's critical for security and liability that gJ.l sculptures be illuminated at night. This has not been on the front burner in the past and that'must be corrected if you value the exhibit and the work and money I've put into the educational exhibit. I hope to meet with the housing project manager, parents, and children if possible to explain the need tp protect the park's sculptures.
