INITIATION:
1. The regular meeting of the City Council was called to order by
2. Mayor Nunamaker at 7:30 P. M. The Mayor then gave the invoca-
3, tion and then led the Pledge of Allegiance to the Flag.
4. ROLL CALL:
PRESENT: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nuna-

ABSENT: Councilmen -None
ALSO PRESENT: City Attorney.Shatford & City Manager Woollett
APPROVAL OF MINUTES:
a. Regular Meeting of March 23, 1964
b. Special Meeting of April 8, 1964.
City Manager Woollett referred to the minutes of the Special
Meeting of April 8 where Mr. Sam Braeger stated the percentage
signed should be 61.20% and not 61.8 %. Councilman Fitzjohn
moved to approve the minutes of both minutes with the above cor-
rection, Councilman Merritt seconded, carried by following vote:
AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker
NOES: Councilmen -None
ABSENT: Councilmen -None
OLD BUSINESS:
PUBLIC HEARINGS: 7 :30 P. M. CURB & GUTTER.
a. Lemon Ave. south side Oak to Trelawney
b. Loma Ave, east side between Broadway and Olive.
The City Manager advised on Lemon Ave. the lineal footage is
770 ft. with 100% signed up. The estimated cost is about $2334.
which includes rebate to the property owners, necessary design,
staking, supervision, pave -out etc.
Councilman Dickason moved to open the public hearing, Council-
man Fitzjohn seconded, and carried. The Mayor asked if anyone
wished to speak for or against this improvement. No one came
forward. Councilman Fitzjohn moved to close the public hearing,
Councilman Dickason seconded and carried.
Councilman Merritt moved to declare the project to be in public
interest, approve the expenditure of funds for this project, and
instruct the Supt. of Streets to cause the work to be done,
Councilman Dickason seconded, carried by the following vote:
AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker
NOES: Councilmen -None
ABSENT: Councilmen -None
The City Manager advised the Loma Ave. improvement involved
651 ft. of which 624 ft. or 89.1% were sic3ned up. The estimated
cost to the City would be $2203.00. Councilman Dickason'moved
to open the public hearing, Councilman Fitzjohn seconded, and
carried. The Mayor asked if anyone wished to speak for or
against the improvement. Mo one came Forward. Councilman Fitz-
John moved to close the public hearing, Councilman Dickason se-
conded and carried, Councilman Dickason moved to declare the
project to be in public interest, approve expenditure of funds
for this project, and instruct the Supt. of Streets to cause the
work to be done, Councilman Merritt seconded, and carried by
the following roll call vote:
AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker

OF STREET: Daines Dr. north side Halifax
to Pal Mal
The project represents 70k lineal ft. of which 1.61 ft. or 65%
have signed up the City Manager reported, and also all of the
property owners who are offering to dedicate some property free
of charge to the City to make a full street have signed agree-
ments to do so. The estimated cost to the City would be $2816.
Councilman Merritt moved to open the public hearing, Councilman
Dickason seconded, and carried. The Mayor asked if anyone wish-
ed to speak for or against.
Mr. Arley Coleman, 5502 N. Halifax, asked information regarding
procedures. Mr. Warren Coleman of the same address asked how
the rebate was handled. The City Manager explained in detail
the procedures. No one else came forward to speak.
Councilman Fitzjohn moved to close the public hearing, Council-
man Merritt seconded, and carried. Upon request of the Council
the City Manager broke down the estimated cost of this improve-
ment, Councilman Merritt moved to declare the project to be in
public interest, to authorize the City to provide survey, de-
sign, staking, inspection and preparation of right -of -way deeds,
necessary pave -out, and 5O per lineal foot rebate for those
qualified, and to instruct the Supt. of Streets to cause the
work to be done, Councilman Fitzjohn seconded, roll call vote
to carry as follows:
AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker

DETERMINATION OF ASSESSMENTS.
a. 6277 Golden Wst, $196.92, curb, gutter & sidewalks
Councilman Fitzjohn moved to open the public hearing, Councilman
Merritt seconded and carried. The Mayor asked if anyone wished
to speak for or against the assessment. No one came forward.
Councilman Dickason moved to close the public hearing, Councilman
Fitzjohn seconded, and carried. Councilman Merritt moved to
determine the assessment to be accurate and correct and that the
property be so assessed, Councilman Tyrell seconded, carried by
the following called vote:
AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker
NOES: Councilmen -None
ABSENT: Councilmen -None
b. 9055 Rancho Real, $103.20, curb and gutter.
The City Manager presented the above assessment For approval by
the Council. Councilman Merritt moved to open the public hearinn
Councilman Fitzjohn seconded, and carried. The Mayor asked if
anyone wished to speak for or against this assessment. No one
came forward. Councilman Fitzjohn moved to close the public
hearing, Councilman Merritt seconded, and carried. Councilman
Merritt moved to determine the assessment to be accurate and
correct and that the properties be so assessed, Councilman
Nunamaker seconded, carried by the following called vote:

NEW BUSINESS:

PLANNING COMMISSION RECOMMENDATIONS:
5. TENTATIVE TRACT #29569, area bounded by Olive on the north
Green St. on the south, Baldwin on the west, and Glickman
on the east.
Planning Advisor Cushman - -- advised this tentative tract map was
Filed in February when R -1 zoning was 5000 sq. Ft. The Planning
Commission reviewed the plan and requested a re- design and con-
tinued their public hearing;. The map marked Study A was pre-
pared and submitted which adds more depth to the lots. The
Planning Commission recommends approval with revised conditions
and design as shown on Map titled "A" study.

The "A" study also provides better lot frontage. The conditions
recommended to be imposed by the Planning Commission are: street
width be modified to 42 ft., and 36 ft. of pavement right -of -way,
provide planting, sidewalks and pedestrian access easements alone
both sides of "A" street and add a six foot grapestake fence
where adjacent to property sidelines on north side of street,
make Degas Ave. 50 ft. wide and 36 ft. between curbs within these
rights -of -way, that required 50 ft. radius for turnaround in "A"
St. be modified to permit 35 ft. radius, provide street trees
and lights and energy until subdivision in brought into lighting
district and signs in accordance with City standards, also that
Green St. be dedicated and improved across parcels involved with
subdivision and east to lots presently improved with curb and
gutter, and provide standard sidewalks four feet adjacent to curbs
throughout subdivision. Also to comply with Road Dept. require-
ments re street and drainage improvements and easements for street
drainage, easements shall be granted within rights -of -way propos-
ed to be deeded or dedicated For public streets until tract re-
corded unless subordinated to road easement by certification on
title sheet of final map, align center lines of all streets with-
out jogs at intersections, design streets to have minimum center 1
line curve radii to satisfaction of Road- -Dept. Also provide
contributory drainage From adjoining properties, approved grad-
ing plans by the City Engineer and grade approval of road plans
by the Street Dept., and suggested subdivider use the existing
easement from end of Zadell Ave. to northerly boundary of sub-
division for drainage, and that he provide drainage structure in
said easement. If needed the City Engineer will design and Sub-
divider construct that portion of the structure within the sub-
division. Also approval contingent upon installation and- dedica-
tion of local sewers to serve subdivision. Easements are tenta-
tively required to determine final locations and requirements
which City Engineer will determine as well as sewer design re-
requirements. Adequate size water system required to include
fire hydrants, size and location determined by Fire Chief. All
existing trees to be removed from street right of ways, new
street trees to be planted with City to issue permit and speci-
fications. Sanitary Sewers to be installed and used for sewage
disposal. Also suggested a flood hazard report be obtained from
the City Engineer.
Mrs. Margaret Placek, 10111 Green St., advised a part of her prop-
erty was in escrow as a part of this tract and she was not in
favor of the map approved by the Planning Commission, and she
presented a new map with the street going back along her remain-
ing property, and that she had so required in her escrow. The
City Attorney advised this was not a city problem, and that this
problem was entirely between herself and the builders.
John Waade, 5734 N. Sultana, the subdivider, advised he was sure
a satisfactory agreement could be worked out with Mrs. Placek.
He also spoke in favor of his tract plans.
The Council discussed the various conditions.Councilman Merritt
raised the question regarding the grapestake fence which the City
will have to maintain, and he felt that a cement block fence
should be required.rfollowing discussion Mayor Nunamaker moved
to approve the Tentative Tract Map recommended by the Plannino
Commission for Tract #29569 with conditions as read, Councilman
Fitzjohn seconded, and carried by the following called vote:
AYES: Councilmen Dickason, Fitzjohn, Tyrell, Nunamaker
NOES: Councilmen- Merritt

6. ZONE CHANGE CASE NO. 64 -83: August J. Westfal1, et al,
10147 E. Green St.
Planning Commissioner Cushman presented this Case whi-ch cover
the area in Tentative Tract #29569, which is zoned A -1 -1 acre
and will be R -1 -5000, the minimum sq. footage required in Febru-
ary at the time the plan was filed with the City. City Attorney
Shatford advised this zone change was not needed as in approving
the Tract the Council has approved sub - standard size of lots.
He advised in our Subdivision ordinance it permits sub - standard
lots to be placed in a subdivision of this type.. Under the new

Ordinance lot size requirement is 7200 sq. ft. We are now put-
ting together a subdivision which has sub - standard lots which
is in the Subdivision law we now have. 1 think we should have a
condition that this subdivision shall meet requirements as per-
tained to R -1 -5000 classification. This Subdivision map was
filed prior to the effectiveness of the new zoning ordinance.
The City Attorney advised the subdivision ordinance provides you
can have sub - standard lots if we approve the particular tract
map.
The City Manager stated we are approving R -1 -5000 Subdivision
in an area zoned 7200 sq. ft. without a public hearing.
The City Attorney stated that is right, that this is a unique
situation here, where subdivider does not own the property and
a substantial thing has been done that this can proceed on prior
law. Following the City Attorney's opinion no public hearing
was scheduled.
7. TRAFFIC COMMISSION RECOMMENDATIONS:

Traffic Engineer Envall recommended 15 ftl.:nof:•double yellow
centerline striping on Baldwin Ave. at Daines Dr. be blasted from
opening northerly of Daines Dr. which will aid turning movements
into Daines Dr. Councilman Tyrell moved to approve, Councilman
Fitzjohn seconded, roll call vote to carry as follows:
AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker

The recommendation under item 7 approved by the Council also
included No Stopping at any Time" signs 150 ft. east of Ryland

R. RESOLUTION NO. 64-359: ,\1arrants & Demands.
Councilman Fitzjohn moved to approve Resolution No. 64 -35,
warrants & demands in the sum of $36,468.70, Nos. 4767 through
No. 4350, Councilman Merritt seconded, carried by called vote:

The City Manager presented the following changes:

Precinct 9 Mrs. Laura Gottmers, 5729 Camellia replaces Mrs.

Hammond as Inspector
Mrs. Nora Hammond, 5500 N. Persimmon moves from Clerk
to Judge

Councilman Tyrell moved to approve the chances as recommended,

10. COMMUNICATIONS:
a. City of Santa Monica, their Res. 3022, requesting support
of their views in regard to Senate Bill #41
Following discussion it was agreed to table any action until
the Councilmen read Bill 441. Councilman _Tyre l 1 • so moved, Coun-
cilman Fitzjohn seconded, and carried.
b. Demeurons: request for permit to hold car wash at Ray's Stan-
dard Station on April 13. Councilman Tyrell moved to approve,

TIME FOR THOSE I N THE AUDIENCE WHO WISH TO SPEAK:
Mrs. Marie Goumbard, 94.62 Lemon, said she had a drainage pro-
blem on her property as the water comes down from the school
and runs down her driveway to the rear of the lot. They now
have a house in the rear and a block well and there is no place
for the water to go. The City Manager advised we would have
the drainage engineer check this out to see what can be done.
II12. MATTERS FROM CITY OFFICIALS:
The City Attorney presented Resolution No. 64 -361, RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AUTHORIZING EX-
ECUTION OF LEASE BETWEEN CITY OF TEMPLE CITY AND M. P. KETTLE
AND SYLVIA KETTLE FOR USE OF LOTS 687 & 671 OF TRACT 6561 FOR
MUNICIPAL PARKING LOT PURPOSES. There followed considerable
discussion about the lease and rental. The City Manager advis-
ed the County had the lease and parking meter fund which was
paying the lease ran out the end of November and they still had
the lease but no money coming in. He also recommended the
lease be drawn from April 15, 1964, until July 1, 1965. The
City Attorney stated the City owes rental for December, January,
February and March and if the lease runs from April 15, 1964,
to July 1, 1965, to cover this the rental would be $140.00 per
month, due the 1st of each month except the first of this month
with rental to be from April 15, 1964. The City Attorney re-
commended with these changes that the Council adopt Resolution
No. 64 -361. Councilman Fitzjohn so moved, Councilman Merritt
seconded, and carried by the following called vote:

The City Attorney presented Resolution No. 64 -360, RESOLUTION CF
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AUTHORIZING EXECU-
TION OF LEASE BETWEEN CITY OF TEMPLE CITY AND A. CUKIER & TIMA
CUKIER FOR USE OF LOT 713 OF TRACT 6561 FOR MUNICIPAL PARKING
LOT PURPOSES. He advised this lease is for the parking lot
which lies just westerly of the Shopping Mart and is a lease of
long term duration. This is a conditional lease only in effect
until Parking District #i is formed. This lease is $85.00 per
month for a ten year period. Also this lease enables the City
to include and have the cooperation of the property owner of
this market property in the formation of this District. The City
gets the benefit of this lot for public parking. The rental
will just pay the assessment against that property which does
not need public parking. The $35.00 goes back into the parking
district by paying of assessment and enables the creation of the
parking district. The City has to maintain as any other parking
lot. This lease is designed to cause creation of Parking Dis-
trict #1 and without it will not probably succeed. It also
provides a parking lot on main street for ten years.
Mayor Nunamaker stated we should move forward and he was for it,
and made the motion the City accept this lease and sign it,
Councilman Fitzjohn seconded. Roll call vote to carry as follows
AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker

The City Manager advised the staff had completed the estimated
street needs for 1964-1974, which is a detailed report of the
presentation he and the Asst. City Manager made to the Council
about three months ago. He requested the Council to direct the
City Manager to submit three copies with a map of the City to
the State Division of Highways. Councilman Merritt so moved,
Councilman Fitzjohn seconded, and carried by the following vote:

Councilman Tyrell asked the City Manager regarding the opinion
concerning newspaper publications. The City Manager stated
the Government Code states an adjudicated newspaper of general
circulation, and although physically published in another city

it could be used. Councilman Tyrell then commented we could
use any in the County.
Councilman Dickason asked about the progress in the Temple City
Park design and the City Manager advised the architects are
still working on it, and he will try and get a report.
The City Attorney presented an opinion on the Southern Pacific.
He stated some weeks ago we submitted an Agreement between the
Southern Pacific Railroad, the City of El Monte, City of Rose-
mead and City of Temple City. We all approved but the City of
Rosemead objected to where it recited as to reimburing the
Railroad "at all costs ". They submitted a new Agreement on
direct labor and equipment costs. They also did not want to
pay 1/3 of all expense for maintenance of tracks. This now pro-
vides such expense shall be borne by each city pro - rated. He
recommended the City approve the Agreement and authorize execu-
tion of it by the Mayor and City Clerk. Councilman Tyrell so
moved, Councilman Fitzjohn seconded, and carri ed.
Councilman Merritt moved to adjourn to April 21, 1964, at 7:30
P. M. in the Council Chambers, Councilman Fitzjohn seconded and
carried. Council adjourned at 9:15 P. M. until April 21, 1964,
at 7:30 P. M. in the Council Chambers, 9664 Las Tunas Dr.
