HomeMy Public PortalAbout2020_05_26_O010 Residential Solicitors, Canvassers, and Peddlers – Amended Hours of OperationI ( The Town of Leesburg, Virginia ORDINANCE NO. 2020-0-010 PRESENTED: May 26, 2020 ADOPTED: May26, 2020 AN ORDINANCE: AMENDING THE TOWN CODE TO REGULATE THE HOURS OF OPERATION OF PEDDLERS, CANVAS SERS 'AND SOLICITORS WHEREAS, Code of Virginia of ~950, as amended, section 15.2-913 authorizes the governing body to make necessary changes to the Leesburg Town Code to reasonably control the activities of door-to-door vendors for the safety and well-being of the people residing in the locality; and WHEREAS, citizens of this community expect their local government to assist them in preserving their privacy from activities that disrupt the quiet enjoyment of their homes; and WHEREAS, the Town Council finds it necessary in the interest of the health, safety and welfare of the residents of the Town of Leesburg to amend the hours during which such activities are permitted under the ordinance. The Town Council of the Town of Leesburg, Virginia hereby ordains: SECTION I. Chapter 20 (Licenses, Taxation and Miscellaneous Regulations), Article XII (Peddlers, Canvassers and Solicitors), Division 2 (Peddlers License), Section 20-385 \' (Standards of Conduct) of the Town Code of Leesburg, Virginia, 2009, as amended, is hereby J amended to read as follows: 0 Sec. 20-385. -Standards of conduct. No peddler and no other person who peddles in the town shall fail to conform to the following standards of conduct whether or not such person is required to register with the department of finance and administrative services under section 20-383. * * * (5) Such persons shall not go upon any residence or create any sound in any manner calculated to attract the attention of the occupant of the residence, for the purpose of securing an audience with the occupant thereof and engaging in any peddling prior to 9:00 a.m., or aftef 9:00 p.m. later than half an hour prior to sunset of any day of the week. -2- AN ORDINANCE: AMENDING THE TOWN CODE TO REGULATE THE HOURS OF OPERATION OF PEDDLERS, CANVASSERS AND SOLICITORS SECTION II. Chapter 20 (Licenses, Taxation and Miscellaneous Regulations), Article XII (Peddlers, Canvassers and Solicitors) Division 3 (Certificate of Registration for Canvassers and Solicitors), Section 20-397 (Standards of Conduct) of the Town Code of Leesburg, Virginia, 2009, as amended, is hereby amended to read as follows: Sec. 20-397. -Standards of conduct. No canvasser or solicitor and no other person who canvasses or solicits in the town shall fail to conform to the following standards· of conduct whether or not such person is required to register with the department of finance and administrative services under section 20-391. * * *· ( 5) Such persons shall not go upon any residence or create any sound in any manner calculated to attract the attention of the occupant of the residence, for the purpose of securing an audience with the occupant thereof and engaging in any canvassing or soliciting prior to 9:00 a.m., or after 9:00 p.m. later than half an hour prior to sunset, of any day of the week. SECTION III. All prior ordinances in conflict herewith are hereby repealed to the extent of the inconsistency. SECTION IV. Severability. If a court of competent jurisdiction declares any provision of this ordinance invalid, the decision shall not affect the validity of the ordinance as a whole or any remaining provisions of the Leesburg Town Code.
