RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TEMPLE CITY AUTHORIZING THE AD-
VANCE OF FUNDS FOR THE ACQUISITION OF
CERTAIN REAL PROPERTY FOR PUBLIC PARKING
PURPOSES IN CONNECTION 4ITH PARKING DIS-
TRICT NO. 2 PURSUANT TO THE PROVISIONS OF
VEHICLE PARKING DISTRICT LAW OF 1943
WHEREAS, Temple City Vehicle Parking District No. 2 has been
duly formed pursuant to the provisions of the Vehicle Parking District
Law of 1943, and
WHEREAS, the City has hereto, on or about September 8, 1964,
entered into an escrow agreement with Dittman A. Hill and Roselle M.
Bradley to purchase itself or its nominee Lot 253 and the North half
of Lot 252, Tract 6561, Pages 34 and 35, Book 72, Official Records of
Los Angeles County, hereinafter referenced as the Subject Property,
for the purchase price of $36,000.00, and
WHEREAS, the necessary legal steps relating to the formation
of the subject Parking District No. 2 have been completed, but there
remain certain matters to be done before the said Parking District wit
have available the funds with which to pay for all of the real propert
to be acquired, and
WHEREAS, the owners of the above - described property have co-
operated with the City by and through their attorney Samuel A.
Greenburg in respect to the unexpected and unanticipated delays atten-
dant to the formation of Parking Districts, and
WHEREAS Dillman A. Hill and Rosella M. Bradley are greatly
in need of obtaining payment for their subject property, and
WHEREAS, the Vehicle Parking District Law of 1943 provides
(Section 31710, Streets and Highways Code) that the legislative body
may advance from the general fund of the City or out of any other
available funds such amount of money as may be necessary to acquire
property prior to formation of the particular Parking District, and
WHEREAS, the City Council desires to advance at the present
time a sum not to exceed $36,000.00 to secure The Subject Property,
in the event the said Parking District No. 2 does not have sufficient
funds for this purpose,
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY,
CALIFORNIA, DOES RESOLVE AS FOLLOgS:
SECTION 1. The City Council of the City of Temple City does
hereby find that it is in the public interest to advance in the inter-
est of Parking District No. 2 the sum of $36,000.00 which sum shall
be used to pay Dillman A. Hill and Roselle A. Bradley the sum of
$36,000.00 pursuant to the terms of that certain Escrow No. 9688 at
City Escrow Services, Inc.
SECTION 2. The Mayor and City Manager are hereby authorized
and directed to do such acts and things which shall be reasonably re-
quired to carry out the intent of this Resolution.
SECTICN 3. The City Council does hereby declare that any
money advanced by the City pursuant to this Resolution shall be repaid
from the first monies available from cash collections of assessments
or sale of bonds or both following the recordation of the assessment
in respect to Parking District No. 1, as provided in Section 31710 of
the Streets & Highways Code.
