RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TEMPLE CITY AUTHORIZING
THE ADVANCE OF FUNDS FOR THE ACQUISI-
TION OF CERTAIN REAL PROPERTY FOR
PUBLIC PARKING PURPOSES IN CONNECTION
WITH PARKING DISTRICT NO. 2 PURSUANT
TO THE PROVISIONS OF VEHICLE PARKING
DISTRICT LAY' OF 1943
WHEREAS, Temple City Vehicle Parking District No. 2 has been
duly formed pursuant to the provisions of the Vehicle Parking District
Law of 1943, and
WHEREAS, the City has hereto entered into an agreement with
Waiva Wells and Maude Kemp to purchase itself or its nominee Lot 254,
Tract 6561, Pages 34 and 35, Book 72, Official Records of Los Angeles
County, hereinafter referenced as the Subject Property, for the pur-
chase price of $29,000.00, and
WHEREAS, the necessary legal steps relating to the formation
of the subject Parking District No. 2 have been completed, but there
remain certain matters to be done before the said Parking District will
have available the funds with which to pay for all of the real property
to be acquired, and
WHEREAS, Waive Wells and Maude Kemp are greatly in need of
obtaining payment for their subject property, and
WHEREAS, the Vehicle Parking District Law of 1943 provides
(Section 31710, Streets and Highways Code) that the legislative body
may advance from the general fund of the City or out of any other
available funds such amount of money as may be necessary to acquire
property in relation to finalization of the particular Parking District
and
WHEREAS, the City Council desires to advance at the present
time a sum not to exceed $29,000.00 to secure the Subject Property,
in the event the said Parking District No, 2 does not have sufficient
funds for this purpose.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Temple City does
hereby find that it is in the public interest to advance in the inter-
est of Parking District No. 2 the sum of $29,000.00 which sum shall
be used to pay Waiva Wells and Maude Kemp the sum of $29,000.00 pursu-
ant to the terms of that certain agreement between the City and Waiva
Wells and Maude Kemp.
SECTION 2. The Mayor and City Manager are hereby authorized
and directed to do such acts and things which shall be reasonably re-
quired to carry out the intent of this Resolution, including the ex-
ecution of any escrow instructions in accordance with the above refer-
enced agreement.
SECTION 3. The City Council does hereby declare that any
money advanced by the City pursuant to this Resolution shall be repaid
from the monies available from cash collections of assessments or sale
of bonds or both following the recordation of the assessment in res-
pect to Parking District No. 2, as provided in Section 31710 of the
Streets & Highways Code after payment of monies to be paid as author-
ized by Resolution No. 65 -434.
