APRIL 5, 2000
The regular meeting of the Town Board was called to order at 7:30 p.m. Board present
were Mayor Johnston, Soles, Wirsing, Klancke, Swatzell, Sanders and Rantz. Staff
present were Reid, Winter and Havens.
Swatzell made a motion to approve the March 15th minutes with one correction under
staff choice, remove the word not in the second sentence, 2nd Klancke, carried
COMMENTS FROM OUTGOING BOARD
Mayor Johnston, Trustee Swatzell and Sanders each commented about their term. Mayor
Johnston has met in the last couple of days members from a community in Japan and
asked that the new Board consider pursuing sister city status with this Town in Japan or
some other interaction with them.
NEW BOARD OATH OF OFFICE
Mayor Soles, Trustee Larson, Trustee Wirsing and Trustee Shapiro took the Oath of
Office and took their seats.
. Mayor Soles presented out going Mayor Johnston, and out going Trustees Sanders and
Swatzell with gifts from the Town in appreciation for years of service to the Town. A
break for refreshments was taken.
Mayor Soles appointed Kit Klancke as Mayor-Protem.
UPDATES
The monthly report of the Chamber of Commerce was given by Catherine Ross.
Jim Sheehan from the Housing Authority gave an update of the FoxRun project.
ACTION ITEMS
Tucker Townhomes
Winter reviewed the plat and submittals. Staff recommends approval with the following
conditions:
I. Plat needs to give units addresses.
2. Condo. Decs. Need to make a statement that garages shall not be converted
into living space.
. 3. All documents signed.

. 4. Warrantee deed necessary to convey common space to Homeowner's
Association.
Klancke made a motion to approve Tucker Townhomes with the 4 conditions as
recommended by staff, 2nd Wirsing, carried.
MH 100 MINOR SUBDIVISION
Winter reviewed the plat. Staff recommends approval of final plat with the following
conditions:
1. All documents signed.
2. Park and school fees paid prior to recording.
3. Suggest to owner that only one water and sewer line be installed to the units.
Wirsing made a motion to approve the final plat for MH 100 subject to the
recommendations of staff, 2n Shapiro, carried.
Klancke made a motion appointing Vicky Winter as Town Clerk, Nat Havens as Town
Treasurer, and Scott Krob as Municipal Judge, 2nd Rantz, carried.
Reid reviewed the proposed resolution setting fees for the Housing Ordinance. Brief
discussion took place. Reid will continue working on it and will a Resolution to the
. Board at the next meeting.
STAFF CHOICE
Reid will look into the Japan city as suggested by Johnston and get more information.
Reid has a cost of $3345 to put natural gas in two of the cul-de-sacs in upper Ptg. Before
the paving goes down. The Town might want to consider a SID for these costs.
CML conference has an elected Officials workshop that Board members might want to
attend.
The May 3rd meeting is cancelled and moved to May 1 ih.
Mayor Soles appointed Vesta Shapiro to the Planning Commission. Soles wants letter of
interest for planning commission and the vacant Town Board seat.
Rantz asked about having a retreat.
Soles will be structuring meetings different regarding public participation. Also asked
for additional agendas for the public and a sign in sheet.
No further business, meeting adjourned at 9:15 p.m.

RESOLUTION
A RESOLUTION ADOPTING A FORMULA TO BE USED IN CALCULATING
AFFORDABLE HOUSING IMP ACT FEES.
WHEREAS, the Fraser Board of Trustees has adopted Ordinance Number 270, which requires
new development to pay an impact fee to offset the housing needs created by new development;
and
WHEREAS, the International Conference of Building Officials provides Building Valuation Data
for new residential construction; and
WHEREAS, Chapter 12 of the Town of Fraser, Colorado Municipal Code requires a minimum
500 square foot home to be considered a habitable living area; and
WHEREAS, local studies have shown that each habitable residential unit of construction creates a
need for .2 employees for on-going servicing of said residential unit; and
WHEREAS, regional studies have shown that the size of residential unit built also has a
correlation to the impact and need for on-going services for said residential unit; and
. WHEREAS, local studies have shown that new commercial development creates on-going needs
for 3.25 employees per one-thousand square feet of new commercial development; and
WHEREAS, the Fraser Board of Trustees finds that it is their intent to only ask developers to
share in 25% of the housing impact created by the new commercial development; and
WHEREAS, the Fraser Board of Trustees finds that commercial development provides additional
tax revenue to the Town of Fraser and that the corresponding impact fee created by commercial
development shall be reduced due to the additional revenues provided by cominercial
development; and
WHEREAS, Section 10-8-1 of the Fraser Municipal Code states that the housing impact fee shall
be set by a resolution adopted by the Fraser Board of Trustees;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN
OF FRASER, COLORADO, AS FOLLOWS:
1. The fee for new residential development shall be determined as follows:
a) For units of 1000 square feet or less:
. New Residential Building Valuation Data X ICBO local area multiplier X 500
(square feet of habitable space) X .1 (employee need generated) = housing impact
fee.

2. The fee for new commercial development shall be determined as follows:
3.25 X square feet of commercial development (in thousands) X. 25 (percentage
allocated to "developers share") X New Residential Building Valuation Data X 500

Grand County Housing Authority
Section One
To qualifY for and be eligible to rent or purchase an affordable housing unit, a person
must meet the following criteria,
A. I\finlmwn percent or Income in Grand COWl!)-
80 percent of all household income must be "earned income" in Grand County.
"Earned income" is defined as wages or salary for persons working in Grand
County. Line 7 of IRS Fom1 1040 and IRS Fonn 1040A and Line 1 of lO40EZ.

All eligible applicants for affordable housing must be a qualified employee as
defined below:
1. Currently working or has been hired to work in Grand County as
an employee or a sole propri~tor \\110 is actively involved in his/her business, and
2. Works a minimum of thirty two (32) hours per week
D. Ownership of Residential Real Estate or a Mobile Home
. Eligible owners or renters of occupied affordable housing shall not own any other

. occupy the affordable unit. If an individual owns vacant land at the time of
admission to affordable housing, as soon as the land is improved ~ith a residence,
the individual must relinquish the affordable housing unit.
E. Reside on Site
Upon purchase or rental of the unit, employee(s) shall occupy the unit as the
primary r~sidence.
F. Assets
No person occupying the unit shall have cumulative assets greater than $50.000,
Cumulative assets include the following:
> Cash on hand, checking accounts,. savings accounts, or other accounts such as but not
limited to certificate of deposits.
> Real property not occupied as the home;
~ Personal property in the fonn of mobile homes, trailers;
> Stocks and bonds and mutual funds not excluded as retirement
)- Mortgages notes and similar properties that can be converted to cash
)- and all other non-retirement assets.
Any amount necessary for the down-payment shall be excluded in the
determination of assets.
. Section Two
Qualifications to reside in Affordable Housing
To RE~1AIN eligible to reside in an affordable housing unit, a person must meet the
following:
1. For residing in a rtmtal unit, a person must meet the requirements of Section
One, A, B. C. D. E and F.
2. For residing in an ownership unit, a person must meet the requirements of
Section One, A, C, D, E and F.

. Affordable Housing Fee Exemotion Policy
A fee of$3,OO per square foot shall be assessed on each commercial and residential
property for new construction or as an addition to an existing residential or commercial
property by the Town or by Grand County: at the time that the Building Permit is issued.
This fee may be exempt for any qualified applicant based on the following criteria:
1. The full amount of the surcharge shall be ex~mpted by Grand County
Housing Authority for any applicant with an annual eligibility income not exceeding ISO
percent of area median income based on household size,
2. P.ersons with incomes above 150 percent of area median income based on
household size shall be ineligible for exemption from Grand County Housing Authority.
3, Developers who agree to deed restrict units for affordable housing shall
receive an exemption of the required amount based on the square footage of the
. affordable units. Developers 'who pay an in lieu fee shall be ineligible for an exemption.
Definitions:
Area Median Income
. Income limits as established by the U.S. Department of Housing and Urban Development
on an annual basis
Affordable Housing
Dwelling units restricted to individuals meeting asset~ income, and work Guidelines
approved by Grand COlUlty Housing Authority. Rental housing must be deed restricted to
serve households with an annual eligibility incomes not exceeding 80% of Area Median
Income
Deed restricted housing that is o\\ned by an eligible family not exceeding 150% of A~fI '
Eligibilitv Income
Eligibility income shall be defined as the gross annual income of all sources of earnings
of all household members 18 years of age and older, based on household size who will ~
occupying the unit regardless of legal status.
Household
A household is defined as members of the family that reside at the property or who will
reside at the property upon issuance of a certificate of occupa.ncy or members of the
family who are designated on the lease to reside in a rental unit.

Affordable Housing Guidelines
With the passage of the Affordable Housing ordinances by the towns ofVrmter Park and
Fraser, it is time that we finalize our affordable housing guidelines that were drafted last
fall. The draft guidelines have not been modified other than an increase in the income
limits that were effective March 10, 2000,
In addition to the Guidelines. a management plan needs to be prepared in order to
establish policies and procedures for implementation of the affordable housing program.
