Comments
The Federal Commun~cabons Commission ("FCC") is seeking comments from local
governments on "what can be done to ensure that local franchising authonbes do not
unreasonably refuse to award cable franchises to competitive entrants" The League of
Cahfornla Cities Is urging cities to file comments with the FCC to prowde the FCC with
factual ~nformatlon about how franchising has worked to protect c~bzens of their
respective cities

On January 17, 2006, the Lynwood Public F~nance Authonty adopted Resolubon
2006 002 estabhsh~ng the C~ty's 2006 Legislahve Pr~onbes In the C~ty's 2006
Leg~slabve Pnont~es, under Priority Watch category, the Lynwood Public F~nance
Authonty estabhshed pohc~es to support efforts that preserve valuable c~ty
services, support efforts to maintain local governments' authonty ~n franchise
agreement negottabons and support local governments' ab~hty to regulate use of

to the use of our nght-of-way To achieve th~s objecbve, ~t becomes ~mportant

The C~ty's mumc~pal code encourages compebbve franchises Th~s ~s contrary to

C~ty of Lynwood beheves that local governments can ~ssue an appropriate local
franchise for new entrants ~nto the wdeo services field on a t~mely bas~s, just as
they have for established cable services prowders In support of th~s belief, we
w~sh to ~nform the Commiss~on about the facts of wdeo franchising ~n our
community
Cable Franchisinq in Our Community
Community Information
C~ty of Lynwood ~s a c~ty w~th a populabon of 73,212 Our franchise cable
prowder ~s Comcast Our community has negotiated cable franchises since
1972
Competitive Cable Systems
Our community has a small number of cable subscribers, which
makes negobat~ons w~th the current franchise holder d~fflcult ~n
securing favorable terms for our community The C~ty welcomes
compebbon to increase our leverage ~n the negobahons
Our community does have mechanisms ~n place to offer the same or a
comparable franchise to a compebtor upon request The Lynwood
Municipal Code grants nonexcluslve franchise The C~ty reserves the
nght to grant, at any bme, such add~bonal franchises for a cable
communications system, as ~t deems appropnate
Conclusions
The local cable franchising process funcbons well in City of Lynwood As
the above ~nformabon ind~cates, we are expenenced at work~n9 w~th cable
providers to both see that the needs of the local commumty are met and to
ensure that the pracbcal business needs of cable providers are taken into
acoogt~t
Local cable franchising ensures that local cable operators are allowed
access to the nghts of way ~n a fair and even handed manner, that other users of
the nghts of way are not unduly ~nconvemenced, and that uses of the nghts of
way, ~ncludmg maintenance and upgrade of facd~bes, are undertaken ~n a manner
which ~s In accordance with local requirements Local cable franchising also
ensures that our local commumty's specific needs are met and that local
customers are protected
Local franchises thus provide a means for local government to
appropriately oversee the operahons of cable serwce providers ~n the public
interest, and to ensure compliance with applicable laws There is no need to
create a new Federal bureaucracy ~n Washington to handle matters of specific
local interest
F~nally, local franchises allow each community, ~nclud~ng ours, to have a
voice ~n how local cable systems will be implemented and what features (such as
PEG access, institutional networks or local emergency alerts, etc) will be
available to meet local needs The franchise mechamsm also allows us to charge
the prowders for the costs related to the use of our nght of way and
~nfrastructure These factors are equally present for new entrants as for ex~sbng
users
The City of Lynwood therefore respectfully requests that the Commission
do nothing to ~nterfere w~th local government authority over franchising or to
otherwise ~mpalr the operabon of the local franchising process as set forth under
ex~st~ng Federal law w~th regard to e~ther ex,sting cable serwce prowders or new
entrants

WHEREAS, the Federal Commumcabons Commission has ~ssued a
Not~ce of Proposed Rulemakmg that makes a number of assumptions and
asserts that franchising cable services by local governments may be an
unreasonable barrier to entry for new telco prowders, and
WHEREAS, th~s Notice of Proposed Rulemakmg strikes at the heart of
local governments' authority over those using public property in their community
to deliver wdeo services, and could result in the preemphon of local
governments' ability to control their rights-of-way
NOW, THEREFORE the Directors of the Lynwood Informabon
Incorporated do hereby find, determine, order and resolve as follows
Section 1 That the Chairperson of the Lynwood Information Incorporated
achng also as the Mayor of the C~ty of Lynwood be authonzed to file comments
(Exhibit A) with the Federal Communications Commission

The efforts to recall are not based on leg~bmate claims and do not represent the w~ll of the citizens of
Lynwood Since being elected in 2003, Vasquez has fought for the residents of Lynwood Her track
record and dedication speaks for ~tself
There are those who want to continue doing business as usual and don't have the best interest of
Lynwood at heart Why else would efforts to recall Vasquez from office be underway at a time when
that money could be better spent on our streets, schools and parks Th~s ~s an attempt by some to stop
the much needed changes in the way Lynwood does business Th~s effort is not the will of the
people
Vasquez works with local, state and federal officials on behalf of Lynwood She has brought forth many
government reform ~ssues including cutbng Council pay, placing a limit on the Council travel budget,
televis~ng Council meetings, campaign finance reform and estabhsh~ng an independent ethics
commission The people are the only special Interest she cares about

To the Honorable Letlcia Vasquez' Pursuant to Section 11020, California Election Code, the
undersigned registered qualified voters of Lynwood, in the State of California, hereby give
notice that we are the proponents ora recall petition and that we mtend to seek your recall and
removal from the office of City Council, in Lynwood, Califorma, and to demand an electron of a
successor to that office
The grounds for the recall are as follows-
Dehberately misled the Lynwood Voters in 2003 and claimed to be a Teacher Lectures
the public at City Council meetings about her teaching expertise, but she has n._qo
permanent California Teaching Credential Previously claimed to have accomplished
past goals with numerous government groups, yet there exist no proof. Claimed to bye m
Lynwood all her life, yet she was registered to vote m Lakewood.
Violates C~vil Rights: Denies Lynwood residents access to publicly fimded events.
Reckless Behavior: Appointed "an associate" who participates in C~ty events claiming
to be her Aide, but who was never officially approved, thus causing a liability risk to
Lynwood.
She Wants To Increase Taxes. Repeatedly wanted to increase taxes on Lynwood
Residents dunng the Council Budget Review process.
She Violates Lynwood Ordinances &Mtsappropriates City Funds. She failed to get a
Cxty permit to place a new roof on her house and she uses City eqmpment for private
events
Lynwood Residents can not afford a pohtmian who lies and cheats. We have had enough
of that and our City's reputation ~s taking ~ts toll. Let's get rid of this corrupted and
venomous individual, once and for all.
