AN ORDINANCE TO APPROPRIATE FOUR THOUSAND TWO HUNDRED, FORTY ONE
DOLLARS ($4,241.00) FROM THE FEDERAL REVENUE SHARING TRUST FUND,
FOR CERTAIN ORDINARY AND NECESSARY MAINTENANCE AND OPERATING EXPENDI-
TURES AND FOR CERTAIN ORDINARY AND NECESSARY CAPITAL EXPENDITURES
AS AUTHORIZED BY THE STATE OF INDIANA AND BY THE ORDINANCES OF
THE CITY OF RICHMOND, INDIANA.
WHEREAS, the State and Local Fiscal Assistance Act of 1972, Title
I of Public Law 95-512 was approved October 20, 1975,
WHEREAS, Section 51.40 of Part 51, Chapter I, Subtitle B, Title
31 of the Code of Federal Regulations provides as follows:
A recipient Government which receives entitlement funds under
the act shall:
(c) Provide for the expenditure of entitlement funds in
accordance with the laws and the procedures applicable
to the expenditure- of its own revenues;
WHEREAS, pursuant to the said State and Local Fiscal Assistance Act,
the proper legal officers of the City of Richmond, Indiana, have
established a trust fund known as the Federal Revenue Sharing Trust
Fund,
WHEREAS, revenues are available in said trust fund to be used for
certain ordinary and necessary maintenance and operating expenditures
and for certain ordinary and necessary capital expenditures,
WHEREAS, there is a need for funds for certain ordinary and necessary
maintenance and operating expenditures and for certain ordinary and
necessary capital expenditures as authorized by law, and
WHEREAS, certain extraordinary emergencies have developed since the
adoption of the existing annual budget so that it is now necessary
to appropriate more money for the various functions of the City
Government than was appropriated in the annual budget.
NOW THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF
RICHMOND, INDIANA:
SECTION 1. That for the expenses of the City Government and its
institutions for the year ending December 31, 1975, the following
amount of money is hereby appropriated and set apart out of the
Federal Revenue Sharing Trust Fund for certain ordinary and necessary
maintenance and ordinary and necessary capital expenditures, said sum
being subject to all laws governing the same and such amount appro-
priated shall be held to include all expenditures to be made during
the year unless expressly stipulated by law.
SECTION 2. That for the fiscal period there is hereby appropriated
from the Federal Revenue Sharing Trust Fund for the hereafter enumerated
purposes the following specified amount to meet the extraordinary
emergency hereby declared to exist:

Margaret Mellen , City Cleric being first duly sworn upon her oath,
disposes and says;
That she did, on the 4thday of Sept. 1975 post in three
public places in the City of Richmond, Indiana, a copy of the Notice
to Taxpayers of a public hearing to be held on September 15 , 19z-�—,
on the matter of additional appropriations. Said notice was in the
form attached hereto, and was posted in the following places.

EXCERPTS OF THE MEETING OF THE COMMON
COUNCIL OF THE CITY OF RICHMO ND, INDIANA
The Common Council of the City of Richmond, Indiana, met in regular session
in the Council Chambers in the Municipal Building of said City September
15, 1975,at the hour of 7:30 P.M.
Councilman Mercha_nthouse presided with the following members present:. Messrs.
Brown Cornett Elstro Geier
Hilton Marino Mills Williams
Absent: None.
The following business was had to -wit:

The Clerk presented proof of publication of Notice to Taxpayers printed in the
Richmond Palladium Item, a newspaper of general circulation in the City of
Richmond, Indiana, on the dates of Sept. 4 and 59 t. ]1.1975 -
Said notices stated that a public hearing would be held on the k12day of

Se t. 1975 , by the Common Council to consider additional appropria-
t ons as provided or in Ordinance No. 3021-1975 , within the City of
Richmond, Indiana. The proof of publicat on and posting of notices were
examined and found to be correct and in order. Councilman Geier
moved the proof of publication and posting of notices be rece ve an or ered
filed, seconded by Councilman Hiltolj and on voice vote the motion
was carried.
The Clerk read on second reading Ordinance No. 3021-1975 .
Councilman Brown moved for engrossment of Ordinance No. 3021-1975, seconded by Councilman
Williams and on unanimous voice vote the motion was carried.
Councilman Brown moved for suspension of the rules and read Ordinance No. 3021-1975 on
third reading by title only, seconded by Councilman Hilton and on unanimous voice vote
the motion was carried.
The Clerk read on third reading by title only Ordinance No. 3021-1975.
After hearing all persons present, Ordinance No.302 - 975 was placed on
final passage or rejection and on a call of the rol t e o owing was recorded:
