AN ORDINANCE AF'MMING ORDINANCE NO. 2823-1973, WHICH ALLOWED A
"SPECIAL USE" FOR RESIDENIIAL PLANNED UNIT DEVELOPMENT' IN AN R-2
SINGLE-FAMILY RESIDENTIAL DISTRICT, ADOPTED ON NOV. 5, 1973.
BE IT ORDAINED BY THE COnDN COUNCIL of the City of Richmond, Indiana,
as follows:
Section 1. WHEREAS, the final plan marked exhibit B was adopted as
part of the Ordinance and filed with the Department of City
Planning and provides for a 120' buffer area along the
West boundary of the Country Club Apartments, and
Section 2 WHEREAS, it is the intent and purpose hereof to alter those
development plans to incorporate tennis courts within the
120' buffer zone provided on the West boundary
Section 3 WHEREAS, a study of this Ordinance was conducted by the
Richmond City Plan Commission the 25th day of September
1973, at which time remonstrances were heard from all parties
interested or affected by this ordinance and
Section 4 WHEREAS, the vote of the Richmond City Plan Commission
was 5 to 3 in favor of recommending the passage.
NOW THEREFORE:
Section 5 It is hereby ordained that Ordinance 2823-1973 be amended
to allow the construction of a tennis court.
Section 6. This Ordinance shall be in full force and effect from and
after its passage and approval as by law required.

a request to amend Ordinance No. 2823-73 in order to
allow the erection of one tennis court on the back
portion of said property, 905 South 23rd Street
Dear Mr. Mills, Members of the Council & Mrs. Trimble:
The Richmond City Plan Commission held a public hearing on Tuesday,
February 24, 1976, at 7:30 p.m., in the Council Chambers of the
Richmond Municipal Building to hear the request of Irwin Rose,
9135 North Meridian Street, Indianapolis, Indiana, requesting to
amend Ordinance No. 2823-73 in order to allow the erection of one
tennis court on the back portion of property located at 905 South
23rd Street.
All parties interested in or affected by this request were heard.
Two (2) persons spoke in favor and five (5) persons were present
who spoke in opposition.
The Plan Commission voted five (5) yes, one (1) no, and one (1)
abstain, to deny this petition.
