Orange St., PO Box 429, Hillsborough, NC 27278 919-732-1270 | www.hillsboroughnc.gov | @HillsboroughGov BOARD OF ADJUSTMENT MINUTES | 1 of 2 Minutes BOARD OF ADJUSTMENT Remote regular meeting 7 p.m. Nov. 10, 2021 Virtual meeting via YouTube Live Town of Hillsborough YouTube channel Present: Chair Bill Harris, Vice Chair Sean Kehoe, Joe Becker, Richard Chapple Absent: Rob Bray, Raul Herrera and Jenn Sykes Staff: Town Attorney Kevin Hornik and Senior Planner Tom King 1. Call to order and confirmation of quorum Chair Bill Harris called the meeting to order. Senior Planner Tom King confirmed the presence of a quorum. Harris expressed thanks for former member Dustin Williams, whose last meeting was Oct. 13, 2021. Harris introduced new member Richard Chapple, who has filled Williams’ seat as an extraterritorial jurisdiction representative. 2. Agenda changes and approval There were no changes. The agenda stood as presented. 3. Minutes review and approval Minutes from the regular meeting on Oct. 13, 2021. Motion: Vice Chair Sean Kehoe moved approval of the Oct. 13, 2021, minutes as submitted. Member Joe Becker seconded. King called the roll for voting. Vote: 4-0. Ayes: Members Becker, Chapple, Harris and Kehoe. Nays: None. 4. Adoption of 2022 Board of Adjustment schedule Harris introduced Item 4 regarding the board’s 2022 schedule. King confirmed the board’s meetings would continue to be held the second Wednesday of every month as needed. Harris and King confirmed the board’s 2022 meetings are scheduled to be held remotely via Zoom, noting the board could shift to in-person meetings when COVID-19 restrictions are lifted. There was no further discussion. Motion: Becker moved approval of the 2022 Board of Adjustment meeting schedule as submitted. Kehoe seconded. King called the roll for voting. BOARD OF ADJUSTMENT MINUTES | 2 of 2 Vote: 4-0. Ayes: Members Becker, Chapple, Harris and Kehoe. Nays: None. 5. Board training session Harris introduced Town Attorney Kevin Hornik and explained Hornik would present the annual training session to the board members regarding quasi-judicial procedure. Hornik noted the PowerPoint slides are included in the meeting agenda packet. Hornik gave a PowerPoint presentation on the quasi-judicial procedure used by the board and gave an overview of the legal functions of the board. After giving the presentation, Hornik offered to answer any questions. When asked, Hornik clarified what constitutes bias and offered some examples. Harris and King recalled a recent example in which member Jenn Sykes had recused herself from an appeal case before the board due to an inability to change a strongly held position on a case. 6. Committee and staff reports King updated the board regarding staffing. 7. Adjournment Motion: Kehoe moved to adjourn. Chapple seconded. King called the roll for voting. Vote: 4-0. Ayes: Members Becker, Chapple, Harris and Kehoe. Nays: None.
