HomeMy Public PortalAbout11-03-2008PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MONDAY, NOVEMBER 3, 2008 The Common Council of the City of Richmond, Indiana met in regular session Monday, November 3, 2008 in the Council Chambers in said City. PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR PAPPIN President Parker presided and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Bing Welch, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn. APPROVAL OF MINUTES Councilor Miller moved to amend the October 20, 2008 minutes to reflect the vote on Ordinance No. 84- 2008 to be 8 -1 with Councilor Miller dissenting; and, Ordinance No. 87 -2008 failed with a 4 -5 roll call vote with Councilors Wissel, Miller, Pappin, Quinn and Welch dissenting, supported by Councilor Welch. Upon a vote viva voce, the motion passed. Councilor Welch moved to approve the minutes of the meeting of October 20, 2008 as amended, supported by Councilor Miller. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR ■ Leaf pick u p is going well — the Street Department is collecting leaves in neighborhoods every 7- 10 days. This will continue until snow falls. An energy use study will be conducted in city owned buildings. The cost of the study will be recouped in utility bill savings over a period of 10 years. This study is part of the Clean Community Program. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the October 16 & 23, 2008 meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS None MISCELLANEOUS BUSINESS None Common Council Minutes November 3, 2008 Page 2 of 3 Councilor Elstro moved to suspend the rules and read Ordinance No. 85 -2008 on first reading by title only, supported by Councilor Pappin. Upon a vote viva voce, the motion passed. ORDINANCE NO. 85 -2008 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE UNITED WAY OF WHITEWATER VALLEY (WPS) Presented by Edna Mikesell, Widowed Person Service coordinator, this Ordinance would authorize the City of Richmond Parks & Recreation Department to submit a grant application and to accept grant funding in an amount up to Five Thousand Five Hundred Dollars and Zero Cents ($5,500.00) from the United Way of Whitewater Valley. If awarded, said funds shall be appropriated toward operating expenses related to Widowed Persons Services. Councilor Wissel moved to advance Ordinance No. 85 -2008 to second reading and to suspend the rules and read by title only, supported by Councilor Cruse - Nicholson. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 85 -2008 on second reading by title only. Council President Parker declared Ordinance No. 85 -2008 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Elstro moved for engrossment of Ordinance No. 85 -2008, supported by Councilor Welch. Upon a vote viva voce, the motion passed. Councilor Welch moved to advance Ordinance No. 85 -2008 to third and final reading and suspend the rules and read by title only, supported by Councilor Cruse - Nicholson. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 85 -2008 on third reading by title only Ordinance No. 85 -2008 was adopted with a 9 -0 roll call vote. ORDINANCES ON SECOND READING ORDINANCE NO. 72 -2008 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM M -1, TO M -1 SPECIAL USE (2119 Peacock Road) The read Ordinance No. 72 -2008 on second reading by title only. This Ordinance is a petition to rezone the property at 2119 Peacock Road from M -1 Industrial District to M -1 Industrial Special Use District in order to allow a permanent auto auction to be established on the property. The Ordinance was heard at the October 23, 2008 Richmond Advisory Plan Commission meeting. The Planning Staff recommended approval. The Plan Commission voted unanimously to recommend denial of the rezoning. Council President Parker declared Ordinance No. 72 -2008 on second reading and public hearing. Speaking in favor was Keith Ulm, property owner, Sherry Lamberson, petitioner and Terra Musselwhite. Opposing were neighboring property owners Paul Paradiso, Phil Hirschfeld, George Bartindale, Robert Johnson and Jeff Garrus. Councilor Wissel moved for engrossment of Ordinance No. 72 -2008, supported by Councilor Pappin. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Ordinance No. 72 -2008 to third and final reading and suspend the rules and read by title only, supported by Councilor Welch. Upon a vote viva voce, the motion passed. Dissenting were Councilors Cruse - Nicholson, Wissel, Welch, Pappin, Goodwin, Quinn and Parker. ORDINANCES ON THIRD READING None CALL FOR ADJOURNMENT There being no further business, on a motion duly made, seconded and passed, the meeting was adjourned.
