Resolution Approving Water Storage and Pressure Upgrade Project
And Awarding Contract. For Engineer on Project
WHEREAS: City Council of Tiffin, Iowa recognizes an immediate need to expand Water Storage and Pressure
Upgrade for Tiffin, Iowa (City).
WHEREAS: City has solicited "Requests for Proposals" from a selection of Engineering and Consulting Firms
(Consultants).
WHEREAS: City Council has received and has reviewed Proposals submitted by four Consulting firms.
THEREFORE: City Council has made selection of Consultants and is extending the contract for the Planning,
Designing and Construction of Water Storage and Pressure Upgrade Project to HR GREEN, INC., Btranch
Office of Cedar Rapids, Iowa..
THEREFORE: City Council directs Mayor and City Clerk / Treasurer to expedite process of contracting with
Consultants and to coordinate efforts with Northland Securities to secure financing of Project.
On the 9th day of November, 2011 at a regular City Council meeting of the City Council, Tiffin, Iowa, Council
person Chris Ball introduced Resolution 2011-52 A Resolution Approving Water Storage and Pressure
Upgrade Project And Awarding Contract For Engineer on Project seconded by Council person Travis
Weipert and made motion for approval.
Ayes: Chris Ball, Jim Bartels, Travis Weipert
Nay: Mike Gericke, Mark Petersen
Absent: None
With Three votes for City Council approval, Mayor Phillips declared that the Resolution 2011-52 A
RESOLUTION Approving Water Storage and Pressure Upgrade Project And Awarding Contract For
Engineer on Project be adopted and signified his approval of the same by affixing his signature thereto.
Passed and approved this 9th day of November 2011.

CITY OF TIFFIN, IOWA RESOLUTION NO. 2011-51
A RESOLUTION APPROVING THE EMERGENCY STREET REPAIRS ON MADDIE LANE
WHEREAS, the Contractor Masterbuilt Concrete LLC. was conducting street and curb repairs as
awarded by City Council for the 2011-2012 Annual Street and Curb Repairs Project and discovered a
major erosion washout along the north side of Maddie Lane.
WHEREAS, upon inspection by the Tiffin Public Works department, the washout under the street
and several residential driveways was a major safety and hazardous concern.
WHEREAS, the City Attorney issued a statement in response to his`review of the Iowa Code
Section 384.103 in regards to "emergency public improvement repairs" and asked the Mayor to seek
a written opinion from a registered civil engineer appraising his inspection of the street and adjoining
structures.
WHEREAS, Engineer Doug Frederick inspected the site and concludes that the situation is indeed
an emergency situation and agrees with the opinion of the Public Works that this is a safety and
hazardous situation, which overrules Chapter 26 of Iowa Code Section 384.103 requiring the
Competitive Quotation, process to seek two sealed bids for the emergency work. An estimate and
specifications have been prepared by the Engineer at an approximate cost of $44,292.62.
FURTHER, the City now requests Masterbuilt Concrete, LLC to begin repairs as soon as feasibly
possible.

NOW, THERFORE, BE IT RESOLVED, BY THE City Council of Tiffin, Iowa, to approve the
emergency repairs with funds from Road Use Funds Budget and the remaining costs from the Local
Option Sales Tax.
On the 26th day of October, 2011 at a special City Council meeting Council person Weipert
introduced Resolution 2011-51 A RESOLUTION APPROVING THE EMERGENCY STREET
REPAIRS ON MADDIE LANE and made a motion for approval. The motion was seconded by
Councilperson Ball.

WHEREUPON Three Council members voted for approval, Mayor Phillips declared the motion carried
and approved Resolution 2011-51 A RESOLUTION APPROVING THE EMERGENCY STREET
REPAIRS ON MADDIE LANE be adopted and signified his approval of the same by affixing his
signature thereto.
