TOWN BOARD APRIL 19, 2000 The regular meeting of the Board was called to order at 7:30 p.m. Board present were Mayor Pro-Tern, Klancke, Shapiro, Larson and Wirsing. Staff present were Reid, Winter and Havens. Wirsing approved the minutes of 4-5-00 with a correction, 2nd Shapiro, carried. OPEN FORUM Winter Park Horseman's Association discussed the plans to build a 30'X60' building for picnics and meeting area at the Rodeo grounds. They are seeking financial help for funding this building. The Town was receptive to the idea and will get back to them with the amount that can be given for this project. CDOT representatives gave the Berthoud Pass work schedule for the summer. Work begins next Monday with expected delays during working hours and night closure starting in June. Blaine Gulbranson, owner of High Mountain Lodge asked for a variance to get a directional sign for his out of town business. He would like to be added to the direction . signs placed at County Road 72 & Fraser Parkway. Reid will get back to Gulbranson on this. Kirk Klancke representing the EGWQC board discussed the 2nd access road into Safeway and the mis-communication. That Board is primarily interested in sediment control. Klancke also stated that the County Building department is working with sediment control at building sites. The Town might be interested in allowing the County to take care of this issue on building sites. The next meeting of the Board is June 8th. ACTION ITEMS Final PlatlElk Creek Village Reid reviewed the plat of Elk Creek Village, Filing I. Peter Stalland also reviewed the project and answered questions the Board had. The Planning Commission has approved the plat subject to conditions. After full consideration Wirsing made a motion to approve the final plat for Elk Creek Village, Filing I with the following conditions: 1. Snow storage moved from the comer of Doc Susie and Elk Creek Drive. 2. Duplex I, lot line moved to show set back. 3. Address any issues still outstanding with regards to ownership/plat signers. 4. Address technical issues with the CC&R's and bylaws. . 5. Pursue 5% dedicated park land within the subdivision within the wetlands area. ýÿ C- ...... .. 6. Address and remaining issues on grading plan and erosion control for project. ? Landscaping plan shall include low maintenance grasses. 8. Dust control measures at Town request. 9. Approved Special Improvement agreement filed. 10. All fees outstanding need to be paid. Motion 2nd by Shapiro, carried. RESOLUTION 4-1-00 SETTING FEES FOR EMPLOYEE HOUSING Ordinance 270 Reid presented the proposed Resolution setting fees for the employee housing. Board reviewed this in a work session earlier in the evening. Shapiro made a motion to adopt Resolution No. 4-1-00, 2nd Wirsing, carried. Vote 3-1. Sharkey's Liquor license renewal tabled to the next meeting waiting Sheriff's Dept. comment. DISCUSSION ITEMS Reid advised that staff would be working on the excavation permit Ordinance and increasing the bond requirement to reflect digging in pavement. . BOARD CHOICE Larson discussed speeding in the residential district of Town and the dips. Board would like that Eisenhower is signed for" No Thru Traffic" to discourage Rodeo traffic. Wirsing moved to go into Executive Session regarding a personnel issue, 10:00 p.m. 2nd Shapiro, carried. Wirsing made a motion to come out of executive session 10:20 p.m., 2nd Shapiro, carried. TOWN BOARD I MARCH 3, 1999 I The regular meeting of the Town Board was called to order at 7:30 p.m. Board present were Mayor Johnston, Klancke, Rantz, Sanders and Soles. Staff present were Trotter and Winter. Klancke made a motion to approve the minutes of 2/17/99, 2nd Rantz, carried. MT. VIEW TOWNHOMES III Trotter presented the 3 unit plat for Mountain View Townhomes III. All conditions set by the Planning Commission have been met. There remains a small technical change needed to the mylar prior to signing. Trotter recommends approval of this plat. Rantz made a motion to approve the plat, 2nd Soles, carried. NEW PICKUP FOR STREET DEPARTMENT Jim Tucker gave the Board the 3 lowest bids received for the proposed purchase of a new pickup. Low bidder is Rains Motor in Granby. This purchase is included in the 99 budget. Rantz made a motion to approve the purchase of a new pickup from Rains . Motors in Granby as bid, 2nd soles, carried. SAFEWAY SIGN CODE VARIANCE REQUEST Representatives from Safeway are requesting a sign code variance to allow the new store to have a total of 138 sq. ft. of signage. Trotter reviewed the sign code with regards to , this large of a store and believes that the code does not address large store frontage \ pro'perly and recommended that Safeway ask for a variance. The old store signage was reviewed and determined to be larger that is being requested at the new Safeway site. After lengthy discussion, Sanders made a motion that a total of 138 sq. feet would be allowed for the Safeway building with the following conditions, (1) no other Safeway signs allowed, (2) New sign must be covered with a banner that says opening soon so as not to cause confusion, (3) old sign at the vacated store must be removed within 7 days, (4) Old store facade where the sign was taken down must be cleaned, patched and painted within 30 days after sign taken down, (5) New store trusses are to be painted the rust color as presented to the commission, motion 2nd by Soles, carried. NOISE ORDINANCE Board reviewed the proposed Ordinance and still had various questions. Trotter stated she has direction of concerns and will bring the ordinance back to the Board. This letter describes some of my background. I am one of those persons who worked, raised and educated their kids, bought and eventually paid for their house and saved enough extra to purchase a second home (condo) in the Fraser Valley. Eventually we moved full time to Fraser. I understand the retired, home paid for, living on a pension type of person living in the Fraser valley. However, I also have two daughters currently living and working in the area. I am well aware of how difficult it is when you want to make your home here but are faced with expensive housing and lower paying and seasonal jobs. I have lots of sympathy for the many people in a similar situation. I am not a very political person and doubt that I would care to run for election . when the two years are complete. However, while a trustee I would work hard to learn how the council works. I listen well and consider myself a very fair person. I would make every effort to fit in and work well with the council and for the town and people of Fraser. Open Forum " Last week I stopped, a.contractor who was excavating without a,permit.last week and, the Sheriff Department issued' a ticket, at my request, for violating the municipal code. I asked for the ticket as this excavator cut a Town of Fraser water well control cable on June 24, 1999 and, after repeatedly askirig t;he contractor.to repair the cable, the Town : ': finally had' the cable fixed in December and we billed the contractor for; our expenses in : ,January 2000. The bill had not been paid when this contractor (or their contracting , . company) requested an excavation permit which was denied pending payment on the '~ outstanding bill. Anyway, the contractor doesn' t feelli~e he was treated fairly .and' he'. ' wanted to address the Board about this. A representative of Young Sign Co. was present to discuss the variance and proposed sign. After discussion, and consensus of the Board that the Pharmacy sign . could be within the allowed 138 sq. ft. if changes to other signs were made, Shapiro made a motion to deny the variance request, 2nd Wirsing, carried. Mmrk MeITIO To: Chuck Reid From: Bill Morek Date: Tuesday, May 9, 2000 Subject: Request for sign variance for Fraser Drugstore Fraser Drugstore would like to request a variance on the size of our outdoor signage to increase our maximum square footage allowed by 35% to match the variance already granted to Safeway for their signage, Our reasons for such request are as follows: (1) The Safeway corporation will now directly compete with a local family-owned business for a limited prescription market. During the summer and winter tourist seasons, visibility of our business to patrons unfamiliar with our town is vital to our SUMval, Safeway already has a huge advantage in visibility. The town's sign code already grants them twice the square footage we have and you have granted them a 35% overage above what is allowed in the sign code, We strongly feel that if you are to be fair and even handed in your enforcement of the sign code that we be granted at least the same square footage increase that you have allowed them. . (2) During the winter season, parking lot snow removal builds up a large snow pile in front of the parking lot. It partially blocks full view of our sign from highway 40, The increase in sign square footage would help solve this problem and ensure that passing traffic can spot our business. I have not included a picture of our redesigned sign with dimensions in this request for the variance, Before we go allead with the expense of re-designed signage, we would like to know if we could have the variance first. The new signage would not change very much in appearance. It would only be larger than what is already there.
