Present: Acting Mayor,Wilfred Scherer; Councilmembers, Robert Mitchell, Stephen Schmit; Clerk -Treasurer, Donna Roehl; Public Works Director, Names Dillman; Zoning Administrator, I.,oren Koren; Police Chief, Richard Rabenort; Engineer, Glenn Cook; Attorney, Ron Batty Absent: Mayor, Thomas Anderson; Councilmember, Anne Theis 1. ADDITIONAL AGENDA ITEMS Moved by Schmit, seconded by Mitchell to discuss the following item to the agenda: DeVac (Hwy. 55-18 Properties) Industrial Development Funds, repayment Motion declared carried 2. MINUTES OF APRIL 17, 1990 Moved by Schmit, seconded by Mitchell to approve the minutes of April 17, 1990, as presented. Motion declared carried 3. MINUTES OF APRIL 26, 1990 Moved by Schmit, seconded by Mitchell to approve the minutes of April 26, 1990, as presented. Motion declared carried 4.* CONSENT AGENDA Wilfred Scherer explained that because 4/5 of the council was not present action could not be taken on the rezoning of the Hans Hagen property and approval of the summary of the PUD ordinance; also action on the Comprehensive Plan would need to be delayed. Stephen Schmit stated that it would probably take two months for council to complete discuss- ion on the Comprehensive Plan and perhaps a special meeting for just that purpose should be scheduled. Moved by Mitchell, seconded by Schmit to approve the consent agenda items. Motion declared carried 5. PUBLIC WORKS DEPARTMENT * U.S. West Moved by Mitchell, seconded by Schmit to adopt Resolution 90-25, allowing U.S. West to bury cable at the Hamel water tower site. Motion declared carried * Northern States Power Co. Moved by Mitchell, seconded by Schmit to adopt Resolution 90-26, allowing Northern States Power Co. to bury underground lines in Cherry Hill subdivision. Motion declared carried * Minnegasco Moved by Mitchell, seconded by Schmit to adopt Resolution 90-27 allowing Minnegasco to bury gas lines in Cherry Hills subdivision. Motion declared carried * Summer Youth Employment Moved by Mitchell, seconded by Schmit to enter into agreement with Twin City Tree Trust for the Summer Youth Employment Program. Motion declared carried Tuckborugh Farm Escrow Glenn Cook reported that shouldering and restoration work remains to be done on Navajo Rd. in Tuckborough Farm and that $10,000 of the escrow funds should be retained. Moved by Schmit, seconded by Mitchell to release $5,750 to Peter Kelly and to retain $10,000 of the escrow funds, as recommended by the city engineer. Motion declared carried -Cherry -Hill Subdivision, Plans and Specifications Glenn Cook stated that plans and specifications for -anitary and storm sewer, water and streets were prepared and that bids could be taken on May 25, 1990 at 10:00 A.M. Moved by Mitchell, seconded by Schmit to adopt Resolution 90-28, approving plans and spec- ifications for sanitary and storm sewer, water and streets in the Cherry Hills subdivision and to accept bids for the project on Friday, May 25, 1990 at 10:00 A.M. Motion declared carried 6. * OLYMPIC FESTIVAL TORCH RUN Moved by Mitchell,seconded by Schmit to approve the route on Co. Rd. 101 for the Olympic Festival torch run from June 3rd through July 6, 1990. Motion declared carried 7. OFFICIAL NEWSPAPER Donna Roehl reported that the Crow River News had gotten approximately 100 new subscriptions as a result of delivery of the free papers that had been sent to Medina residents. Moved by Schmit, seconded by Scherer to appoint Crow River News as official newspaper for the remainder of 1990. Motion declared carried 8. PLANNING AND ZONING DEPARTMENT Paul Piekarski, Conditional Use Permit for Lawn Care Service Loren Kohnen explained that Paul Piekarski had made application to operate a lawn care ser- vice at 3575 Pinto Dr. He stated that the Planning commission had recommended approval with a number of conditions and that the problem of drainage from this property to the south and west needed to be solved. Brad Hagfors, real estate salesman, stated that they were working with the neighbors to resolve the drainage question. Robert Mitchell asked if there was a problem with a residence in a commercial zone. Ron Batty stated that it would be a 'nonconforming use and the house could not be rebuilt or expanded. Stephen Schmit asked what problems there would be if the drainage easements were not obtained. Paul Piekarski asked if letting gravel in the rear of the building would help the situation. Loren Kohnen stated that gravel is considered hard cover. Moved by Mitchell, seconded by Schmit to authorize preparation of a resolution approving a Conditional Use Permit for Paul Piekarski to ^perate a lawn care service from 3575 Pinto Dr. pending satisfactory resolution of the drainage problem by obtaining easements from neigh- boring property owners and upon determination of the financial security by the city engineer. Motion declared carried Robin Ruben, Conditional Use Permit for Horse Stable Loren KOhnen reviewed memos, letters and Planning Commission minutes regarding an application for a Conditional Use Permit from Robin Ruben to operate a horse stable at 4555 Pioneer Tr. He stated that the Planning Commission had discussed whether or not the property should be rezoned from residential to commercial to accomodate what has become a commercial operation. He also explained that there was not an alternate site for a septic system as it had been fenced some time ago and ruined by horses. Realtor, Greg Hahn, stated that there was an undisturbed area south of the riding track. Robert Mitchell asked for information about the drainage problem. George Gubbins, adjacent property owner, stated that he wanted the water to flow away from his property as it had done before Tom Kellin regraded the property. Wilfred Scherer asked if a grass strip could be left between fences. Robert Mitchell asked for information regarding the intersection of Hwy. 55 and Pioneer Tr. Glenn Cook stated that a sufficient space for a level landing is needed and that there should be a 150 ft. separation between Pioneer Tr. north and south of Hwy. 55. Jim Dillman stated that it would cost approximately $15,000 to realign the intersection. Glenn Cook stated that it would cost approximately $100,000 toredo the road base and blacktop. Robert Mitchell asked why the city was requiring the parking area to be blacktopped. Loren Kohnen stated that blacktopping is required for a commercial operation. Robert Mitchell asked if the septic system was working. Loren Kohnen stated that it was working for the number of people now on the property. Robert Mitchell stated that Tom Kellins attorney had said that it was used to its designed capacity. Loren Kohnen stated that it needs to be designed for maximum capacity, not for one bedroom and four employees. Stephen Schmit stated that it should follow commercial guidelines if it is being run as a commercial business. Robert Mitchell stated that a commercial site plan was needed including parking, paddock, roads, green area and septic system. Ron Batty stated that he had raised the issue of use and whether or not it fits under the zoning code as do personal use kennels and stables. The applicants for this permit are requesting a change of use and that he had suggested to them that they make a request for rezoning. Louise Otten, owner of Alpine Farms, stated that in other areas of the country a horse farm and stable are essentially the same and are located in agricultural areas. George Steiner, Realtor, stated that he had spoken to Planning Commission member, Dave Wessin, who had been on the Planning Commission and the Comprehensive Plan committee, who had all intended to keep the area agricultural. William Soules, Attorney for Robin Ruben, asked what the applicant should do, as this operation is more akin to agricultural use than businesses allowed in a commercial zone. Robert Mitchell stated that he would favor a zone applicable to this type of business. Wilfred Scherer stated that the area in question is a long time away from having sewer. George Steiner asked if there was a way in which the Conditional Use Permit could be approved and rezoned later. Robin Ruben asked how long a process the rezoning would be. Robert Mitchell stated that it would take six weeks and a lot of work by the applicant to bring the property into compliance. He asked how long it would be before the road was blacktopped. Wilfred Scherer stated that the base would be completed and in about three year it would be.blacktopped. Ron Batty stated that if a separate zone is created, minimum acreage for this type of operation should be addressed. Moved by Mitchell, seconded by Scherer to authorize preparation of a resolution denying the Conditional Use Permit of Robin Rubin for a horse operation at 4555 Pioneer Tr., as has been requested, as use of the property has changed from the Conditional Use Permit given to Tom Kellin and that the applicant may wish to make application for rezoning to a zone in which a commercial type of horse operation , as is being described, is allowed. Also the applicant needs to - ovide substantiation that there is an alternate septic system site and that the drainage problem is solved. Motion declared carried John Rosholt, Hazardous Building Loren Kohnen read memo and letter from city attorney regarding removal of abandoned house and garage at 3205 Hwy. 55, owned by John Rosholt. John Rosholt explained that he would like to save the existing house for some type of outbuilding and construct a new house on the property, as shown on the site plan. Wilfred Scherer asked if a septic system had been designed. John Rosholt stated that he had purchased additional property to the east and that he had a plan designed for a primary and secondary septic system. Robert Mitchell stated that the cities primary concern is in abating the hazard. He asked if it could be fenced within two wawks. John Rosholt stated that it could be done within two weeks. Loren Kohnen stated that building plans should be submitted and if the property were fenced the fence should also be maintained. Robert Mitchell asked when the house would be built. John Rosholt stated it would be started within the next six months. Moved by Mitchell, seconded by Schmit to allow John Rosholt to keep the building on his property at 3205 Hwy. 55 if it is fenced within two weeks and if either a building permit is obtained or the building removed by November 1, 1990. Motion declared carried Comprehensive Plan Council breifly discussed the com, re'hensive plan as recommended by the Planning Comm- ission, Stephen Schmit suggested holding a meeting just for the purpose of discussing the plan. Resident from 3150 Aspen Ave. stated that she was not in agreement with having a park at Co. Rd. 1.9 and Maple St. Ross Thorfinson, 2165 Cottonwood Tr.; stated that he was in favor of Co. Rd. 116. Robert Mitchell asked how council was to know what concerns and requests the residents had expressed. Donna Roehl stated that a list could be made from the Planning Commission meetings. Planned Unit Development Donna Roehl explained that Thomas Anderson would like members to think about the poss- ibility of having smaller acreage PUD's in sewered areas, as 5 acre minimums are very large for the Hamel commercial area. Robert Mitchell stated that he had spoken to several cities; Plymouth. has 40 acre minimums; Wayzata, 2 acre; Orono 5 acre minimums. Ross Thorfinson stated that Minnetonka has 3/4 acre minimums. Robert Mitchell stated that he would talk with Tom Anderson about the matter. Ron Batty stated that the ordinance has been adopted and an amendment would be needed if council wished to make a change. 9. DEVAC Donna Roehl explained that DeVac had received $2,400,000 in Industrial Development Bonds and could not use $250,000 because the type of equipment they wished to purchase could not be funded according to the regulations, so they wished to pay back the extra amount by increments of $50,000. Moved by Mitchell, seconded by Scherer to approve redemption of the DeVac Industrial Development bonds, as requested, subject to approval of the city attorney. Motion declared carried 10. HANS HAGEN HOMES, CHERRI.HILLS SUBDIVISION Hans Hagen asked that council grant approval for construction of four more houses prior to final approval of the subdivision. He stated that all documents are agreeable and mylars are prepared for signature. Ron Batty stated that a portion of Hunter Dr. needs to be vacated, as Hunter Dr. was not constructed as shown on the TRA plat. Robert Mitchell stated that a special meeting could be called if everything was in order prior to a regularly scheduled meeting. Moved by Mitchell, ec nded bon. li.
