AN ORDINANCE TO APPROPRIATE SIXTY FOUR THOUSAND DOLLARS ($64,000.00)
FROM THE FEDERAL REVENUE SHARING TRUST FUND, FOR CERTAIN ORDINARY
AND NECESSARY MAINTENANCE AND OPERATING EXPENDITURES AND FOR CERTAIN
ORDINARY AND NECESSARY CAPITAL EXPENDITURES AS AUTHORIZED BY THE
LAWS OF THE STATE OF INDIANA AND BY THE ORDINANCES OF THE CITY OF
RICHMOND, INDIANA.
WHEREAS, the State and Local Fiscal Assistance Act of 1972, Title
I of Public Law 95-512 was approved October 20, 1975,
WHEREAS, Section 51.40 of Part 51, Chapter I, Subtitle B, Title 31 of
the Code of Federal. Regulations provides as follows:
A recipient Government which receives entitlement funds under the
Act shall:
(c) Provide for the expenditure of entitlement funds in
accordance with the laws and procedures applicable
to the expenditure of its own revenues;
WHEREAS, pursuant to the said State and Local Fiscal Assistance Act,
the proper legal officers of the City of Richmond, Indiana, have esta-
blished a trust fund known as the Federal Revenue Sharing Trust Fund,
WHEREAS, revenues are available in said trust fund to be used for certain
ordinary and necessary maintenance and operating expenditures and for
certain ordinary and necessary capital expenditures,
WHEREAS, there is a need for funds for certain ordinary and necessary
maintenance and operating expenditures and for certain ordinary and
necessary capital expenditures as authorized by law, and
WHEREAS, certain extraordinary emergencies have developed since the
adoption of the existing annual budget so that it is now necessary to
appropriate more money for the various functions of the City Government
than was appropriated in the annual budget;
NOW THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF
RICHMOND, INDIANA:
SECTION 1. That for the expenses of the City Government and its insti-
tutions for the year ending December 31, 1975, the following amount of
money is hereby appropriated and set apart out of the Federal Revenue
Sharing Trust Fund for certain ordinary and necessary maintenance and
ordinary and necessary capital expenditures, said sum being subject to
all laws governing the same. Such amount appropriated shall be held to
include all expenditures to be made during the year unless expressly
stipulated by law.
SECTION 2. That for the said fiscal period, there is hereby appropriated
from the Federal Revenue Sharing Trust Fund for the hereafter enumerated
purposes the following specified amount to meet the extraordinary
emergencieg hereby declared to exist:

Margaret Mellen , City Clerk being first duly sworn upon her oath,
disposes and says;
That she did, on the 21st day of November , 19 75 , post in three
public places in the City of Richmond, Indiana, a copy of the Notice
to 'Taxpayers of a public hearing to be held on December 1 , 1975 ,
on the matter of additional appropriations. Said notice was in the
form attached hereto, and was posted in the following places.

2. Wayne County Courthouse

EXCERPTS OF THE FLEETING OF THE COMMON
COUNCIL OF THE CITY OF RICHMOND INDIANA
The Common Council of the City of Richmond, Indiana, met in regular session
in the Council Chambers in the Municipal Building of said City December
1, 1975 , at the hour of 7:30 P.M.
Councilman Merchanthouse presided with the following members present: Messrs.
Brown , Cornett , Elstro , Geier ,
Hilton Marino Mills Williams.
Absent: None
The following business was had to -wit:

The Clerk presented proof of publication of Notice to Taxpayers printed in the
Richmond Palladium Item, a newspaper of general circulation in the City of
Richmond, Indiana, on the dates of November 20 and November 28, 1975
Said notices stated that a public hea ngwoula Id on t e Ist day o
December, 1975 , by the Common Council to consider additional—appropria-
ons as prov a or in Ordinance No. 3039-1975 , within the City of
Richmond, Indiana. The proof of publication and posting of notices were
examined and found to be correct and in order. Councilman Geier
moved the proof of publication and posting of notices be received ar?ered
filed, seconded by Councilman Hilton and on voice vote the motion
was carried.
The Clerk read on second reading Ordinance No.3039-1975
Councilman Brown moved for engrossment of Ordinance No. 3039-1975, seconded by
Councilman Williams and on unanimous voice vote the motion was carried.
Councilman Brown moved for suspension of the rules and read on third reading by
title only Ordinance No. 3039-1975, seconded by Councilman Geier and on unanimous
voice vote the motion was carried.
The Clerk read on third reading by title only Ordinance No. 3039-1975.
After hearing all persons present, Ordinance No.3039-1975 was placed on
final passage or rejection and on a call of the roll the following was recorded:
