HomeMy Public PortalAbout3040-1975- APPROPRIATE 30000 FROM THE FEDERAL REVENUE SHARING TRUST FUNDORDINANCE NO. 3040-1975 AN ORDINANCE TO APPROPRIATE THIRTY THOUSAND DOLLARS ($30,000.00) FROM THE FEDERAL REVENUE SHARING TRUST FUND, FOR CERTAIN ORDINARY AND NECESSARY MAINTENANCE AND OPERATING EXPENDITURES AND FOR CERTAIN ORDI- NARY AND NECESSARY CAPITAL EXPENDITURES AS AUTHORIZED BY THE LAWS OF THE STATE OF INDIANA AND BY THE ORDINANCES OF THE CITY OF RICHMOND, INDIANA. WHEREAS, the State and Local Fiscal Assistance Act of 1972, Title I of Public Law 95-512 was approved October 20, 1975, WHEREAS, Section 51.40 of Part 51, Chapter I, Subtitle B, Title 31 of the Code of Federal Regulations provides as follows: A recipient Government which received entitlement funds under the Act shall: (c) Provide for the expenditure of entitlement funds in accordance with the laws and procedures applicable to the expenditure of its own revenues; WHEREAS, pursuant to the said State and Local Fiscal Assistance Act, the proper legal officers of the City of Richmond, Indiana, have esta- blished a trust fund known as the Federal Revenue Sharing Trust Fund, WHEREAS, revenues are available in said trust fund to be used for certain ordinary and necessary maintenance and operating expenditures and for certain ordinary and necessary capital expenditures, WHEREAS, there is a need for funds for certain ordinary and necessary maintenance and operating expenditures and for certain ordinary and necessary capital expenditures as authorized by law, and WHEREAS, certain extraordinary emergencies have developed since the adoption of the existing annual budget so that it is now necessary to appropriate more money for the various functions of the City Government than was appropriated in the annual budget; NOW THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA: SECTION 1. That for the expenses of the City Government and its insti- tutions for the year ending December 31, 1975, the following amount of money is hereby appropriated and set apart out of the Federal Revenue Sharing Trust Fund for certain ordinary and necessary maintenance and ordinary and necessary capital expenditures, said sum being subject to all laws governing the same. Such amount appropriated shall be held to include all expenditures to be made during the year unless expressly stipulated by law. SECTION 2. That for the said fiscal period, there is hereby appropriated from the Federal Revenue Sharing Trust Fund for the hereafter enumerated purposes the following specified amount to meet the extraordinary emergencies hereby declared to exist: STREET MATERIALS $ 30,000.00 SECTION 3. An extraordinary emergency exists for the above appropriation and it has been recommended by the City Controller. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval by the Mayor and is subject to the laws of the State of Indiana governing emergency appropriations. Councilman Merchanthouse presided with the following members present: Messrs. Brown , cornett , Elstro Geier , Hilton Marino Mills Williams , Absent: None The following business was had to -wit: (OTHER BUSINESS HAD) The Clerk presented proof of publication of Notice to Taxpayers printed in the Richmond Palladium Item, a newspaper of general circulation in the City of Richmond, Indiana, on the dates of November 20 and November 28 197.5. Said notices stated that a public hearing rwould a eId on the lsttQ of December, 1975 by the Common Council to consider additionaT appropria- ons as Provided or in Ordinance No. 3040-1975 , within the City of Richmond, Indiana. The proof of publication and posting of notices were examined and found to be correct and in order. Councilman Geier moved the proof of publication and posting of notices be receive a'� nd—or�ered filed, seconded by Councilman Elstro and on voice vote the motion was carried. The Clerk read on second reading Ordinance No. 3040-1975 Councilman Williams moved for engrossment of Ordinance No. 3040-1975, seconded by Councilman Brown and on unanimous voice vote the motion .was carried. Councilman Williams moved to suspend the rules and read on third reading by title only Ordinance No. 3040-1975, seconded by Councilman Mills and on unanimous voice vote the motion was carried.
