This is to confirm that at the Public Hearing held by the Town
Commission on June 7, 1996, your Application for a Special
Exception and a Level 3 Site Plan Review to permit additions
to an existing single family dwelling located at 532 Banyan
Road in Gulf Stream, Florida,that fails to meet the combined side
setback requirements,was considered.
The Special Exception was granted as requested and recommended by the
Architectural Review and Planning Board. The Level 3 Architectural/
Site Plan Review was approved as recommended by the Architectural
Review and Planning Board which included approval of either the
rail design as shown on the plans or a simple picket design for
the second floor balcony.

proposed elevated roof line on the west side to create a well balanced north

RE: ARPB File #96 -02: Ground & Second Floor Additions at the Nalen
Residence; 532 Banyan Road
The applicant, Mark Marsh of Digby Bridges, Marsh & Associates as agent for Craig
Nalen, is seeking approval to construct five separate additions to the ground floor and
a second floor addition over the existing garage at the residence located on a parcel of
property described as Lot 7, Polo Cove subdivision. The nature of the request requires
a Board recommendation to the Town Commission for a Special Exception to match an
existing non - conforming wall line and a Level 3 Architectural /Site Plan Review.
Project Description
The proposed ground floor additions consist of two on the front of the house, two on the
rear and one on the east side. On the front, one addition will create an entrance hall and
the other a breakfast room. On the back, the additions will enlarge two existing
bedrooms, while the addition on the east side will enlarge an existing bathroom.
The proposed second floor addition will be located over the existing garage. The
stairway will be inside the structure and will lead up to a guest bedroom and bath.
Across the front of the addition is a covered porch with a decorative rail. The addition
would constitute the only second floor portion of the home.
The Gulf Stream Design Manual requires that both side yard setbacks combined equal
30% of the lot width, and that no side setback be less than 15 feet. The east side of the
home where the garage addition is planned has a 15.7 foot setback; however, the home
fails to meet the combined setback minimum. As a result, both sides are considered
non - conforming and a Special Exception to match a non - conforming wall line is required.

Taken together, the ground floor additions will consist of 529 square feet. The second
floor addition will have 610 square feet of living area and 54 square feet of covered porch.
Altogether, the additions will add 990 square feet to the existing 3,766 square foot home
for a new total floor area under roof of 4,616 square feet. This new total yields a Floor
Area Ratio of about 29 %, or 664 square feet less than the maximum permitted floor area.
Beyond the floor additions, a number of exterior cosmetic changes also are proposed.
The existing home incorporates many of the design elements found on the Gulf Stream -
Bermuda style including, exposed rafter tails, near - symmetrical footprint, mostly stucco
walls and window shutters. However, the home also has an unusual brown "pan tile" roof,
partial brick exterior walls, and jalousie windows on the front. The proposed changes
include a full stucco exterior with corner quoins, single hung windows with muntins,
simple wooden entry columns, and a white cement tile roof.
Special Exception
There are two sets of standards that apply to the requested Special Exception setback.
The first set of standards is contained in Article IV, Section I, item 3 of the Design Manual
(pg. IV-1 0). These standards are specific to the requested setback. The second set of
standards is contained in Chapter 66, Article V.3., section 66 -164 of the Zoning Code.
These eneral standards apply to all Special Exceptions.
As discussed, the applicant wishes to construct a second floor bedroom over the existing
garage and match the existing east side wall of the garage. The garage has a 15.7 foot
setback from the east property line. Ordinarily, this would be a sufficient setback;
however, the west side of the house has only an 11.3 foot setback. Because the Manual
requires that both side setbacks added together must equal 30% of the lot width, both
sides are considered non - conforming.
According to the applicant, the location for the second floor addition was selected based
on internal circulation, external appearance, and structural considerations. The only
conforming locations for the addition would be on ground floor at that back, or a second
floor over the central part of the home. Given the floor plan and structural constraints of
the existing home, these locations were deemed impractical.
Impacts from the addition are mitigated by the fact that the east side of the house meets
the minimum setback of 15 feet. The residence fails to meet the combined setback
criteria because of the 11 foot setback on the west side, and none of the proposed
additions affect the west side. The proposed appearance of the structure also mitigates
any adverse impacts. By converting the home to the Gulf Stream - Bermuda style, the

applicant contends the home achieves a greater consistency of architectural style with
those around it. Further, layered landscaping along the east side also will help mitigate
any visual impacts to views from the east.
Specific Standards
The applicant has attached an additional sheet to the application form which addresses
each of the specific standards found in the Design Manual. Based on the information
submitted by the applicant, staff finds the project, as proposed, to be consistent with all
of these standards.
General Standards
The applicant also has addressed all of the Special Exception standards found in the
Zoning Code in his responses to Part IV E of the application form. Based on the
information submitted by the applicant, staff finds the project, as proposed, to be
consistent with all of these standards as well.
Level 3 Architectural /Site Plan Review
Chapter 66, Article V.1., Sec. 66- 144(b) of the Zoning Code enumerates the 12 standards
applicable to applications for a Level 3 Architectural /Site Plan Review. Based on the
materials submitted by the applicant, staff finds the project, as proposed, to be consistent
with all applicable standards. This finding includes all applicable portions of the Gulf
Stream Design Manual as well. However, staff recommends the applicant and Board
consider a redesign of the second floor porch railing to achieve greater contrast with a
similar railing design used on the home to the west.
Recommendation
1. Motion to recommend approval of a Special Exception for the extension of an
existing non - conforming wall line and thereby reduce the minimum combined side
setbacks of the residence by 3 feet, from 30 to 27 feet, based on a finding that the
building and site plans, as submitted, meet all applicable specific and general
Special Exception review standards.
2. Motion to recommend approval of a Level 3 Architectural /Site Plan Review upon
a finding that the building and site plans, as proposed, meet all applicable review
standards; however, staff recommends the applicant and Board consider a
redesign of the proposed second floor porch railing to provide greater contrast
with a similar railing design used on the home to the west.

NOTICE OF APPLICATION FOR DEVELOPMENT APPROVAL
NOTICE IS HEREBY GIVEN that the Architectural Review and Planning
board of the Town of Gulf Stream will hold a public hearing on Wednesday,
May 22, 1996 at 8:30 A.M., and the Town Commission will hold a public
hearing on Friday, June 7, 1996 at 9:00 A.M., both in the Commission
Chambers of the Town Hall, 100 Sea Road, Gulf Stream, Florida, at which
the following will be considered:
An application submitted by Mark Marsh of Digby Bridges, Marsh
and Associates, as agent for Craig Nalen, owner of the property
located at 532 Banyan Road, Gulf Stream, Florida 33483, that is
legally described as Lot 7, Polo Cove Subdivision, requesting
a Special Exception and a Level III Architectural /Site Plan
Review to permit construction of a second story addition of
610 square feet and five ground floor additions,consisting of
a total of 583 square feet, to an existing non-conforming single
family dwelling that fails to meet the combined side setback
requirements.
The Architectural Review and Planning Board shall make a recommendation to
the Town Commission, and the Town Commission shall make a final decision
regarding the subject application at their respective meetings noticed
above. The meetings /public hearings may be adjourned from time to time
and place to place as may be necessary to hear all parties and evidence.
Complete application materials are in file on the office of the Town Clerk
located at 100 Sea Road, Gulf Stream, Florida 33483 and may be reviewed
during regular business hours which generally include non - holiday weekdays
from 9:00 A.M. to 4:00 P.M.
ALL PARTIES INTERESTED IN THESE MATTERS may appear before the
Architectural Review and Planning Board and the Town Commission of the
Town of Gulf Stream at the times and place aforesaid and be heard.
SHOULD ANY INTERESTED PARTY SEEK TO APPEAL ANY DECISION MADE BY THE
ARCHITECTURAL REVIEW AND PLANNING BOARD OR THE TOWN COMMISSION WITH RESPECT
TO ANY MATTER CONSIDERED AT THESE PUBLIC HEARINGS /MEETINGS, SAID PARTY WILL
NEED A RECORD OF THE PROCEEDINGS, AND FOR SUCH PURPOSE, MAY NEED TO INSURE
THAT A VERBATIM RECORD OF THE PROCEEDINGS IS MADE, WHICH RECORD INCLUDES
